Minutes Village of East Troy Plan Commission & Architectural Review Board 2015 Energy Drive August 13, 2018 6:30 p.m. 1. Call to order – Administrator Suhm called the meeting to order at 6:30 pm 2. Pledge of Allegiance 3. Verification of open meeting notice - Administrator Suhm verified the meeting had been posted according to open meetings laws. 4. Roll call Present: Trustee Forty Renucci, Commissioners Roger Hayes, Mary Nugent, Benny Stichmann Excused: President Seager, Commissioners Edward Arendt and Erin Seaverson Others: Zoning Administrator Tim Schwecke, and Administrator Eileen Suhm In the absence of President Seager, Administrator Suhm asked for a motion to appoint a chairperson Motion by Commissioner Nugent, second by Commissioner Stichmann, to appoint Trustee Renucci as chairperson. Motion carried. 5. Approve Plan Commission minutes of July 9, 2018 Administrator Suhm noted a correction to the meeting start time in the heading of the minutes, stating it should be 7:00 p.m. Motion by Commissioner Nugent, second by Commissioner Stichmann, to approve as corrected. Motion carried. 6. Citizen participation No citizen participation. 7. Status update on Welcome Signs (no action to be taken) Trustee Renucci thanked Lorri Alexander for coordinating and the great work she did along with DPW Equitz and Commissioner Seaverson. Administrator Suhm shared positive feedback. Commissioner Stichmann expressed a desire to see some landscaping around the signs, especially for the sign on Hwy 20 off I-43 and suggested this could be reviewed in spring. 8. Site plan amendment for hangar BA-1 at the airport (widen approach and regrade swale); John Schreib, applicant (application 2018-38) A. Possible action by the Plan Commission Details are available online: https://s.zoninghub.com/G182Z815WD Motion by Commissioner Nugent, second by Commissioner Stichmann, to approve the site plan of the expanded approach to hangar BA-1 as proposed and the site grading subject to the final review and approval of the Village Engineer. Motion carried. 9. Amend conditional use approval for LD's Barbecue with regard to the sale of alcohol located at 2511 Main Street (RA270200001); Leon Davis, applicant (application 2018-46) A. Public hearing Trustee Renucci opened the public hearing. Zoning Administrator Schwecke reviewed his staff report dated August 8, 2018. The only change is to allow the sale of alcohol as part of the conditional use application and this is the first amendment to the conditional use order. B. Possible recommendation by the Plan Commission to the Village Board Motion by Trustee Renucci, second by Commissioner Stichmann, to recommend to the Village Board the approval of the first amendment of the conditional use order for LD’s Barbeque subject to the terms in the draft order dated August 8, 2018. Motion carried. 10. Amend building plans for LD's BBQ located at 2511 Main Street (RA270200001); Leon Davis, applicant (application 2018-48) A. Possible action by the Plan Commission As part of the construction process it was found that they needed to eliminate some of the windows. The changes are fairly minor, but necessary due to structural issues discovered during construction. Motion by Commissioner Nugent, second by Commissioner Hayes, to approve the revised building design. Motion carried. 11. Conditional use for a telecommunication tower located at 2030 Young Street (RXUP00209B1); AT&T, applicant; Phase 1 Consulting, Sal Randazzo agent (applicant 2018-39) A. Public hearing Trustee Renucci opened the public hearing. Dan Burney, applicant, is proposing 110-foot tower at 2030 Young Street to increase coverage for AT&T and first responders network they are building across the nation. The applicant stated they considered co-location on the existing tower but felt there would be issues with being so close to the water tower that the frequency would bounce back. The applicant understands that a sworn statement from the radio frequency department is needed. He stated there would only be a light installed on the tower if required by the FAA. Kevin Powerard, the attorney for SBA, existing owner of the tower at 2029 Young Street spoke to the Commission. He stated the existing tower is approximately 888 feet from the proposed tower and is 107 feet in height. It does have capacity for additional tenants on the tower. They believe what the proposed project is attempting to achieve can be achieved through co-location on the existing tower. Per Ordinance and State Statute a new tower can only be permitted if the applicant provides a sworn statement that co-location of an existing or planned tower within the applicant’s search ring would not result in the same mobile service, functionality, coverage and capacity, is technically infeasible or is economically burdensome to the mobile service provider. If the applicant does not provide such analysis and sworn statement the application shall be denied per Village ordinance 510-43. SBA has not received any communication from the applicant regarding co-location and SBA objects to the application. They would like additional time to further investigate how the proposed new tower would affect his client and the surrounding properties. Asking for additional time to supply the Commission with more information regarding the impact of this proposed tower. Zoning Administrator Schwecke stated the petitioner and SBA are both asking for more time. He questioned how soon both parties could submit the additional information. The applicant and objector agreed they can get that information to Administrator Suhm within two weeks. The public hearing will continue at next month’s meeting. Zoning Administrator Schwecke reviewed his staff report dated August 8, 2018, for the proposal to install a monopole of 110 feet with a 50x50 compound surrounded by a security fence, with access off Young Street through current access drive. This is treated as a Conditional Use and a recommendation from the Plan Commission to the Village Board. He reviewed the six factors to be considered, confirmed the Public Notice was published and no comments have been received as of this date. He reviewed the need for more landscaping for the buffer and that the outdoor lighting will be security lighting only. The applicant agreed to adjourning the public hearing until the September Plan Commission meeting. Motion by Trustee Renucci, second by Commissioner Nugent, to adjourn the public hearing until September 10 at 6:30 p.m. Motion carried. B. Possible recommendation by the Plan Commission to the Village Board 12. Site plan for a telecommunication tower located at 2030 Young Street (RXUP00209B1); AT&T, applicant; Phase 1 Consulting, Sal Randazzo agent (applicant 2018-42) A. Possible action by the Plan Commission Motion by Commissioner Nugent, second by Commissioner Stichmann, to table the site plan. Motion carried. 13. Conditional use for mini-storage units located at 2566 Energy Drive (RA142000002, RA142000003); Frank C Price, applicant (applicant 2018-39) A. Public hearing Trustee Renucci opened the public hearing. Frank Price stated his proposal is three mini storage warehouses. His original building was built in 1985 and he retired from the business two years ago. He decided to pursue mini warehouses for the property. He thinks it is a good use for the property based on the surrounding businesses. He also discussed the fact that the 100-year floodplain was moved approximately 10 years ago. Zoning Administrator Schwecke reviewed his staff report dated August 10, 2018 and stated the proposal involved two different parcels. This is a basic concept plan and the applicant’s intent is to get some information to the Plan Commission for the overall consideration of whether this is a good parcel for mini storage. He explained the Commission would normally have a complete site plan and plan of operation that depicts buildings, landscaping, parking, etc., to review. He stated plans also need to address the flood plain issue as the current flood plain map shows the flood plain almost approaching Energy Drive. This plan needs more specific details on how it will be laid out with regard to that. He had discussed with the applicant the need for a more complete site plan. The applicant is agreeable to provide this if the Plan Commission believes this is good uses of this land. Commissioner Stichmann stated he felt it was a good use of the land and storage for residents is a good idea and Commissioner Nugent agreed. Motion by Commissioner Nugent, second by Commissioner Hayes, to adjourn the public hearing until September 10 at 6:30 pm until we can get more information. Motion carried. B. Possible recommendation by the Plan Commission to the Village Board 14. Site plan for mini-storage units located at 2566 Energy Drive (RA142000002, RA142000003); Frank C Price, applicant (applicant 2018-40) A. Amend conditional use approval for East Troy Brewery located at 2905 Main Street (ROP 00093), with regard to fencing around outdoor patio areas; TEBS, LLC (Ted Zess, agent) (application 2018-43)a. A. Public hearing Trustee Renucci opened the public hearing. Zoning Administrator Schwecke reviewed his staff report dated August 10, 2018 for the Conditional Use amendment. As drafted there was a requirement to have a fence around the patio where alcohol was to be served and the applicant would like this requirement removed. The only item being changed is the fencing around the patio. The site plan amendment has been incorporated in the packet as the fencing was shown there. Commissioner Stichmann questioned if it was originally there because of sidewalk dining. Ann Zess stated that there is a fence along the front near the sidewalk, but the fence is open near the back and parking area with a decorative fence that will hold the lights. Motion by Commissioner Nugent, second by Commissioner Stichmann, to close the public hearing. Motion carried. B. Possible recommendation by the Plan Commission to the Village Board Motion by Commissioner Nugent, second by Commissioner Stichmann, to recommend to the Village Board the approval of the first amendment of the conditional use order for East Troy Brewery subject to the terms in the draft order dated August 10, 2018. Motion carried. 16. Amend site plan for East Troy Brewery located at 2905 Main Street (ROP 00093) with regard to fencing around outdoor patio areas; TEBS, LLC; Ted Zess, agent (application 2018-44) A. Possible action by the Plan Commission Motion by Stichmann, second by Nugent, Approve the amended site plan/plan of operation by removing the requirement for fencing if alcohol is being served. All other aspects of the initial approval remain unchanged. Motion carried. 17. Sign permit for East Troy Brewery located at 2905 Main Street (ROP 00093); TEBS, LLC, applicant; Ted Zess, agent (application 2018-45) A. Possible action by the Plan Commission Zoning Administrator Schwecke reviewed his staff report dated August 10, 2018. This review of signage is because it is in the central business district. The sign area complies with the frontage requirement and the handout depicted the color scheme. Signs are not lit and are mounted wall signs. Discussed any new lighting added to the building, such as a gooseneck light for the sign, which was not on the site plan, would need to be brought to the Plan Commission for approval. Motion by Trustee Renucci, second by Commissioner Nugent, to approve the two wall signs as proposed based on the four above-mentioned criteria listed in the zoning code. Motion carried. 18. Possible amendment of the zoning code regarding architectural standards in the new tax increment financing district e. Possible amendment of the zoning code regarding the zoning for RXUP 00256 (west side of STH 120 and South of I-43) Zoning Administrator Schwecke indicated that Landscaping Preservation was added at last meeting but had not been added to this list. 20.
