Minutes Village of East Troy Plan Commission & Architectural Review Board 2015 Energy Drive December 10, 2018 6:30 p.m. 1. Call to order- President Seager called the meeting to order at 6:30 pm 2. Pledge of Allegiance 3. Verification of open meeting notice – Administrator Suhm verified the meeting had been posted according to open meetings laws. 4. Roll call Present: President Seager, Trustee Forty Renucci, Commissioners Edward Arendt, Roger Hayes, Benny Stichmann, Mary Nugent (arrived at 6:50 p.m.), Erin Seaverson Others: Zoning Administrator Tim Schwecke and Administrator Suhm Youth in Government Michael Rosin 5. Approve Plan Commission minutes of November 12, 2018 Motion by Trustee Renucci, second by Commissioner Arendt, to approve the minutes dated November 12, 2018. Advisory – Motion carried, Commission – Motion carried. 6. Citizen participation Matthew Wanasek, N9685 Nature Road, asked the Commission if they were willing to consider an amendment to zoning in highway business to grow gourmet mushrooms. He has been working for several years to start this business. He has found a location, but the current zoning is not appropriate, and he is asking to the Commission to consider his request. 7. Site plan amendment for a temporary and permanent concrete batch plant (previously approved by the Plan Commission on July 9, 2018) located at 2728 Buell Drive (RA280700003); Schmitz Ready Mix; Matthew Schmitz and Todd Schulz, agent (application 2018-54) A. Possible action by the Plan Commission Todd Schultz, spoke representing Schmitz Ready Mix. They made modifications to accommodate their traffic flow and the addition of a 30x30 building for a boiler to be in a separate building. Zoning Administrator Schwecke went through the amendment and noted the changes: modifications to the entrance to accommodate the truck traffic, rotate the placement of the conveyor to a north-south orientation, the addition of a new building for the boiler to the left of the enclosed batch plant and a revision of the location of the washout bays. The washout bays will be expanded and shifted to the south. They would like to enclose the washout area and put heat in for winter. The bays have 22-foot high walls and a roof with a slight pitch. The new washout bay building is an accessory building and as proposed the buildings comply. There will not be names on the towers and the accessory building will match the main building. Motion by Commissioner Arendt, second by Commissioner Stichmann, to approve the proposed site plan amendment and all other aspects of the site plan approved on July 9, 2018 shall remain in effect. Point of clarification was made that there is to be no signage on the tower. Motion by Commissioner Arendt, second by Commissioner Stichmann, to amend the motion to include that there will be no signage on the towers. Conditional use for growing crops at the East Troy Airport (various parcels) which is located in the Light Industrial zoning district; Village of East Troy, applicant (application: 2018-57) A. Public hearing DPW Equitz explained that at the airport site there are about 43 acres of cropland that was used to spread sludge from the WWTP in the past. Since that practice has been discontinued that land has been leased for farming. It has come to his attention that the Village needs a conditional use to farm the cropland at the airport and he is applying to comply with the ordinances. Zoning Administrator Schwecke reviewed the staff report and site plan. The site plan depicted the layout of where crops are grown. Trustee Renucci stated that the Village should have a layout map of the airport, so the area can be marked where the crops are going to be grown so there is not a misunderstanding. The conditional use authorizes growing of crops and if for some reason an area that was not previously farmed could be farmed in the future, then the Village could request the conditional use be amended. Commissioner Seaverson inquired whether it adheres to FAA regulations, and it was confirmed it does. Mary Nugent arrived at the meeting at 6:50 p.m. Present Seager closed the public hearing. B. Possible recommendation by the Plan Commission to the Village Board Motion by President Seager, second by Commissioner Seaverson, to recommend to the Village Board approval of the Conditional Use subject to the terms in the draft Conditional Use order dated 12/5/2018. Advisory – Motion carried, Commission – Motion carried 9. Site plan for growing crops at the East Troy Airport (various parcels) which is located in the Light Industrial zoning district; Village of East Troy, applicant (application: 2018-58) A. Possible action by the Plan Commission Motion by President Seager, second by Commissioner Arendt, to approve Site Plan and Plan of Operation as set forth in the submittal documents provided the Village Board approves the Conditional Use for the proposed use. Advisory – Motion carried. Commission, Motion carried. 10. Conditional use for mini-storage units located at 2566 Energy Drive (RA142000002, RA142000003); Frank C Price, applicant (application: 2018-39) A. Public hearing President Seager opened the public hearing. Village of East Troy Page 3 Plan Commission Minutes December 10, 2018 Zoning Administrator Schwecke explained the intent by the applicant is to withdraw his application because his plans have changed. The original submittal was going to include two parcels, but now will be one parcel, which changes the public notice. He will withdraw this application and when the plans are ready to resubmit it will be a brand-new application. The Plan Commission has been tabling the public hearing for five months now. Technically the Plan Commission will adjourn the Public Hearing to next month’s meeting, but prior to that meeting the applicant will withdraw his application, which will terminate the process. Motion by President Seager, second by Commissioner Arendt, to adjourn the Public Hearing until the January 7, 2018 Plan Commission meeting. Advisory – Motion carried, Commission - Motion carried. B. Possible recommendation by the Plan Commission to the Village Board Note: The applicant submitted a request asking the Plan Commission to adjourn the public hearing to the next meeting on January 7, 2019. 11. Site plan for mini-storage units located at 2566 Energy Drive (RA142000002, RA142000003); Frank C Price, applicant (application: 2018-40) A. Possible action by the Plan Commission Motion by Trustee Renucci, second by President Seager, to table until the January 7, 2018 Plan Commission meeting. Advisory – Motion carried, Commission – Motion carried. 12. Amend the Village’s zoning code with regard to conditional uses and related matters; Plan Commission, applicant (application 2018-56) A. Public hearing President Seager opened the public hearing. Zoning Administrator Schwecke reviewed his staff report, including a draft for Ordinance 2018-09 with the intent to modify the use table of the zoning code. Exhibit A shows the changes as proposed. This was initiated due to Act 67 regarding treatment of conditional uses. Zoning Administrator Schwecke confirmed that the Public Hearing has been noticed as a Class II public notice and that as a text amendment the Plan Commission makes a recommendation and the Village Board makes the final decision. President Seager closed the public hearing with no further comments. B. Possible recommendation by the Plan Commission to the Village Board Motion by President Seager, second by Commissioner Arendt, to recommend to the Village Board the approval of Ordinance 2018-09 based on the findings contained in the ordinance. Discussion related to fire response capabilities of the East Troy Fire and Rescue Department (no packet materials) Steve Bartle, First Assistant Chief of the Fire Department, discussed these capabilities at the prior meeting, but could not engage in discussion because he was not on the agenda. He has been a Fire Department member for 36 plus years and is also an EMT. Trustee Renucci asked Steve to come in and present the capabilities of the Fire Department to the Plan Commission and what the current equipment capabilities are relating to height limitations in the zoning code. A single-family structure is limited to a 35-foot roof height, which is an average roof height. In the future some buildings may be taller. Regarding a conceptual senior center that may be proposed and other taller buildings he wondered if the Plan Commission should review the building height. Mr. Bartle explained that the East Troy Fire Department currently has the capability of an 85-foot tall aerial platform. This still has limits for the zone and base needs for the equipment. Neighboring departments have 100’ platforms. The East Troy Fire Department is a member of MABAS (Mutual Aid Box Alarm System) and that gives them the capability of accessing more equipment than East Troy has. They can an cover 4-story buildings and those buildings would need to have sprinklers which would be a help. President Seager asked if they needed bodies of water, such as the area near the current dam, to assist in fighting fires. Mr. Bartle replied that they have used that water source in the past because the water system in the Village wasn’t as good as it is currently. This has improved with more pumps and a second water tower. They can go down to 12-feet in the tower and then they would be done using the municipal water source because it still must supply the municipality. They have used the lake in the past, but they have other sources if that is not there. If additional equipment were needed, with MABAS it allows them to draw further and deeper into the State of Wisconsin to meet those needs. This help is also available for any long-term needs. As a side note, The Heritage is three stories and there have been two fires there without any issues. 14. Discussion related to Comprehensive Plan update (time permitting) This discussion was a continuation from the last meeting on October 23 relating to the memo from the first meeting, dated June 11. Discussion included goals, objectives and policies of the Comprehensive Plan. To begin the discussion Zoning Administrator Schwecke provided sample language to review that pertained to “cottage housing”. The example was adopted in Wisconsin Rapids. “Cottage housing” is a single parcel development proposed by a developer, that provides small detached homes that have shared resources such as parking and open space. These groupings of cottage houses are like condos and are small structures with a specified size range. (Not mobile homes or “tiny houses”) The development must meet set design principles, size, architectural standards and provide high quality small homes. Each unit is separately owned, like condos. This was informational only now and the process to consider allowing this would be done through the zoning process and the Village would Village of East Troy Page 5 Plan Commission Minutes December 10, 2018 have control over placement, etc. This would not be included in the comp plan but included as a short sentence or paragraph that could be added to the plan. Zoning Administrator Schwecke questioned if the Commission would like to revisit the comp plan vision statement to make it more user friendly and more in line with the Village economic development strategy. The Commission felt this should be explored and asked Zoning Administrator Schwecke to draft an updated statement. The Comp Plan discussion included the section on housing and neighborhood goals. Discussion covered: • Under Goals: Revolving loans and CDBG program for potential rehabilitation of housing. These are the type of programs that can encourage reinvestment in housing. • Regarding Goal #3 – add language to include “interconnected efficient, well designed business and employment centers”. • Under Objectives: The future land use map can identify preferred redevelopment areas and specify what the Village is looking for in those areas as part of the long-term vision to transition from a current building to something else. • Under land use goals, objectives and policies: providing for multifamily housing in appropriate preferred location on arterial routes. (Commissioner Arendt left the meeting at 7:53 p.m.) • Under Objectives: Identification of key devolvement locations and special standards that would apply to those locations. • Include language regarding food clusters and food tourism as an objective for economic development. • Under Policies: Encourage high quality, but attainable, development. • Under Policies: Encourage improvements to existing buildings and sites consistent with standards for newer development to the extent practical. The discussion will continue with #6 for the next workshop. 15. Discussion related to possible amendment of the zoning code regarding architectural/design standards in the new tax increment financing district (time permitting) This was not discussed. A. Communicating with downtown square businesses regarding design review and related matters: Administrator Suhm has written this communication and will provide it to the Commission at the January meeting for review prior to mailing. The Commission requested that the next meeting include the item “Potential zoning amendment to allow light industrial use in highway business district” to discuss the process for addressing the issue presented during Citizen’s Participation. 17.
