Minutes Village of East Troy Plan Commission 2015 Energy Drive February 10, 2020 6:30 p.m. 1. Call to order- President Seager called the meeting to order at 6:39 p.m. 2. Pledge of Allegiance 3. Verification of open meeting notice– Administrator Suhm verified the meeting had been posted according to open meetings laws. 4. Roll call Present: President Seager, Trustee Renucci Commissioners Roger Hayes, Erin Seaverson, Benny Stichmann Excused: Commissioners Edward Arendt, Chris Bottoni Others: Zoning Administrator Schwecke, Administrator Suhm, Clerk Alexander 5. Approve Plan Commission minutes of January 13, 2020 Motion by President Seager, second by Commissioner Hayes, to approve the minutes. Motion carried, with Trustee Renucci abstaining. 6. Citizen participation - No citizen participation. 7. Conditional use for a contractor shop/showroom located at 2584 Main Street (RA 305700002); David August, owner; Brian Pluess, tenant (application 2020-01) A. Public hearing President Seager opened the public hearing. Brian Pluess was available for questions. Discussion included the showroom space requirements and listed conditions included in the draft Conditional Use order. President Seager closed the public hearing. B. Possible recommendation to the Village Board Motion by Trustee Renucci, second by Commissioner Seaverson, to recommend Village Board approve the conditional use subject to the terms in the draft conditional use order dated February 6, 2020. Motion carried. 8. Site plan for a contractor shop/showroom located at 2584 Main Street (RA 305700002); David August, owner; Brian Pluess, tenant (application 2020-02) A. Discussion by the Plan Commission Zoning Administrator Schwecke reviewed his staff report regarding the site plan. B. Possible action by the Plan Commission Motion by Trustee Renucci, second by Commissioner Hayes, to approve the site plan/plan of operations as set forth in the submittal documents provided the Village Board approves the conditional use for the proposed use. Motion carried. 9. Two-lot certified survey map located on south side of Honey Creek Road (RA314100001); Village of East Troy, applicant (application 2020-06) A. Discussion by the Plan Commission Zoning Administrator Schwecke reviewed his staff report and discussion included the design and use of the parcels, storm sewer easements required, the access to parcel one will be from the existing apartment complex and access to lot 2 will be accommodated by a temporary access from Honey Creek Road until such time as connection to the access road to the business park is possible. Once the access road into the business park is available the temporary access will be abandoned, and access will be from the business park road. B. Possible action by the Plan Commission Motion by Commissioner Stichmann, second by Trustee Renucci, to recommend the Village Board approve the certified survey map based on the general and specific conditions listed and with the addition of the recorded storm sewer easement. Motion carried. It was noted that the easement could be a separate document but would be preferred to be included on the CSM. Rezone a portion of the subject property from LI (Light Industrial) to MR-10 (Multi-family Residential) located on south side of Honey Creek Road (RA314100001); Thomas Larson, applicant (application 2020-04) A. Public hearing President Seager opened the public hearing. Zoning Administrator Schwecke reviewed his staff report to rezone lot 1 to accommodate the multi-family proposed use and the steps that will be required to accomplish this. This is presented as a temporary rezoning to allow for the application for a PUD and will only be rezoned once the CSM is recorded. President Seager closed the public hearing. B. Possible recommendation to the Village Board Motion by Commissioner Stichmann, second by Commissioner Hayes, to recommend the Village Board approve the application to rezone Lot 1 of the proposed CSM subject to the terms and conditions as set forth in the draft ordinance, dated February 6, 2020. Motion carried. 11. Review of general development plan for a multi-use planned development district located on south side of Honey Creek Road (RA314100001); Thomas Larson, applicant (application 2020-05) A. Public hearing President Seager opened the public hearing. Zoning Administrator Schwecke reviewed his staff report and Mr. Larson and Ryan Cardinal, Cardinal Engineering, were available for questions. This is the second step to applying for a Planned Unit Development (PUD). Mr. Cardinal reviewed the project plans and designs noting that the parking area was changed to offer additional above-ground garages in addition to the underground parking and the additional landscaping that was planned. The development has general visitor parking, ADA parking, a walking trail, grilling area, a dog park for residents and a maintenance facility. The storage units will be open to public and will be fenced. The plans will upgrade the exterior sides that will be visible from Honey Creek Road to enhance the visual of the project. There is no outside storage. Discussions included the exemptions being requested such as the shape of lots, density of apartments to mirror the existing complex and the building heights to match the roofline of the existing complex. It was confirmed that if the planned development is not done the parcel zoning will revert back to MR- 10 and LI. The process going forward was discussed and the GDP will be provided to the Village Board as a report and the final development plan and ordinance changes will come to the Plan Commission for recommendation to the Village Board in March. March meeting will review the General Development Plan and Final Development Plan. Section H, Termination, will be changed to reflect December 31, 2024 for a dated for the project to be fully built. President Seager closed the public hearing. B. Possible recommendation to the Village Board Motion by Commission Stichmann, second by Trustee Renucci, to recommend Village Board adoption of the general development plan as set forth in the public hearing draft ordinance as amended in March 2020. Motion carried. 12. Amendment of the Village's land division regulations (Chapter 495 of the Municipal Code) relating to certified survey map requirements (application 2020-03) A. Public hearing President Seager opened the public hearing. Zoning Administrator Schwecke reviewed the purpose of this change to allow successive CSMs to develop land as an industrial park as opposed to requiring a subdivision plat to facilitate development. Discussion included the proposed process options for authority of the Plan Commission and Village Board for approvals. President Seager closed the public hearing. Possible recommendation to the Village Board Motion by Commissioner Seaverson, second by Commissioner Hayes, to recommend approval by Village Board of the ordinance as drafted, based on the findings contained in the proposed ordinance. Motion carried. 13. Potential revisions to the zoning code regarding pavement requirements to access detached accessory buildings (NO MATERIALS IN PACKET) A. Discussion Zoning Administrator Schwecke distributed information on potential amendments to the zoning code relating to accessory buildings. Discussion included the various situations of accessory buildings in back yards and the access to those buildings, door size and styles, how a door may not be accessed by a driveway but through a grass area, determining if the area being used to access the accessory building is becoming a driveway and paving concerns, set back needs to insure a paved access could be installed if desired in the future on the property, concerns of degrading grass areas, possibility to amend the property maintenance ordinance to address concerns and for easier enforcement and size and design of driveways. Direction was to continue working on the language of this potential code revision to clarify intent. B. Possible action to set a public hearing date to review the ordinance, as may be revised No action taken. 14. Potential revisions to the zoning code regarding metal shipping containers (for storage) (NO MATERIALS IN PACKET) A. Discussion Zoning Administrator Schwecke distributed information on the use of shipping containers as detached accessory buildings. Discussion included the exterior materials and styles, door sizes/styles, design features and access. Direction was to bring this topic back to the Commission at the next meeting. B. Possible action to set a public hearing date to review the ordinance, as may be revised. No action taken. 15. Recommendations for future agendas (no packet materials) Pending Items (no packet materials) 1. Possible amendment of the zoning code regarding tree protection standards for new development 2. Possible amendment of the zoning code with regard to front-yard setbacks/garages in residential zoning districts President Seager requested that potential amendments to the Property Maintenance ordinance for driveways be included on a future Village Board agenda for discussion. 16.
