Minutes Village of East Troy Plan Commission 2015 Energy Drive July 12, 2021 6:30 p.m. 1. Call to order- President Seager called the meeting to order at 6:30 p.m. 2. Pledge of Allegiance 3. Verification of open meeting notice – Clerk Alexander verified the meeting had been posted according to open meetings laws. 4. Roll call Present: President Seager, Trustee Renucci, Commissioners Edward Arendt, Chris Bottoni, Roger Hayes, Benny Stichmann and John Merath Others: Zoning Administrator Schwecke, Administrator Suhm, Clerk Alexander 5. Citizen participation Steve Lambrechts, 2018 Beulah Ave., thanked the Commission for considering the inclusion of the adaptive reuse of institutional buildings in residential areas and asked if the statement of “single ownership” would include a partnership or LLC and suggested changing the word “consistent” to “compatible” in Section 510-253. President Seager took item #10 out of order at this time. 6. Approve Plan Commission minutes of June 14, 2021 Motion by Trustee Renucci, second by Commissioner Arendt, to approve the minutes as presented. Motion carried. 7. Conditional use application for outdoor events located at 2511 Main Street (LD’s BBQ) (RA270200001) Leon Davis, applicant (application 2021-09) A. Public hearing President Seager opened public hearing. Mr. Davis provided overview of his plans including repair work for the northeast driveway area, eliminating the southeast driveway, paving the gravel area on the south of the property for additional parking and the addition of outdoor entertainment with music for up to 15 events per year. Zoning Administrator Schwecke explained that there are two applications tonight, the conditional use amendment and the site plan amendment. To do this properly the three current properties need to be combined and Mr. Davis is working with a surveyor to accomplish that. He stated that the public hearing notices were mailed, no comments have been received and the outdoor entertainment (music) would also be subject to the Village’s noise ordinance. This is the second amendment to the original conditional use permit (the first amendment was to allow for the sale of alcohol). He then reviewed the ongoing conditions proposed for the conditional use amendment approval. Parking availability was discussed however the outdoor events are not part of the day-to-day operations. President Seager closed the public hearing. B. Potential recommendation by Plan Commission to Village Board Motion by Commissioner Stichmann, second by Commissioner Bottoni, to recommend approval of the conditional use to the Village Board subject to the terms stated in the draft conditional use order dated July 9, 2021. Motion carried. 8. Amend site plan for LD’s BBQ located at 2511 Main Street (RA270200001) for various site improvements; Leon Davis, applicant (application 2021-10) A. Possible action by the Plan Commission Zoning Administrator Schwecke stated that Mr. Davis is working with a surveyor to merge the three parcels and provide a more detailed site plan showing the changes in access, additional landscaping, stage placement and size, parking, accessory buildings, and fencing. He is planning to bring that back to the Commission within the next month or two. Motion by Commission Arendt, second by Trustee Renucci, to table item. Motion carried. 9. Potential amendments to the zoning code related to building demolitions in the Downtown Design District (application 2021-12) A. Public hearing President Seager opened the public hearing. Zoning Administrator Schwecke reviewed the history of the topic and the proposed options for demolition applications with and without new development plans. This would set forth landscaping plans required based on the submitted timeframe until new development begins on the site of the proposed demolition. Erin Seaverson, 2040 Emery Street, stated that she feels this type of plan is good to have in place and she supports it because a demolition without a new development plan in place leaves a hole in the community. She asked if there were property maintenance regulations also in place. President Seager replied that code compliance has assumed more responsibility in property maintenance and the property maintenance ordinance allows for enforcement with fines as well as having been revised earlier this year to include timeframes for compliance. It was confirmed that these changes would be going forward and not retro-active. Discussion then focused on the proposed timeframe for completing the landscaping , the concern to avoid irresponsible property owners not fulfilling the landscaping requirements, that building permits are valid for 12 months to match the landscaping timeframe and that there is also protection within the demolition code and permit. President Seager closed the public hearing. B. Potential recommendation by Plan Commission to Village Board Motion by Commissioner Stichmann, second by Commissioner Arendt, to recommend the Village Board approve Ordinance 2021-06 based on findings contained in the proposed draft ordinance. Motion carried. 10. Potential amendments to the zoning code related to adaptive reuse of institutional buildings in residential areas (application 2021-13) This item was taken out of order – see above. A. Public hearing Steve Lambrechts, 2018 Beulah Ave., spoke regarding a property on Union and Clark streets where he has an offer to purchase and discussed the proposed amendment definitions. The current plans for the future of this specific property are to lease space to the church and make the balance of the building into office space, with no plans for the lower level. Zoning Administrator Schwecke reviewed his staff report and stated he agreed with the suggested change in language to section 510-253 of changing the word “consistent” to “compatible”. Erin Seaverson, 2040 Emery Street, stated she feels this is a good idea, asked if this change was for specific uses and if the uses were limited. Zoning Administrator Schwecke explained that the uses were not limited and would depend on the application and the location, but the Commission retains control and can deny based on compatibility, including the requirement of holding a public hearing prior to approval. This change would allow the reuse of an existing building, not a new building. Discussion clarified that single ownership is defined as one entity, and that multiple parcels could be included with the ownership under one single control. President Seager closed the public hearing. B. Potential recommendation by Plan Commission to Village Board Motion by Commissioner Stichmann, second by Commissioner Arendto recommend to the Village Board to approve the proposed draft ordinance with the change of in language to section 510-253 of “consistent” to “compatible”. Motion carried. 11. Potential revisions to the Village’s comprehensive plan A. Review and discussion Zoning Administrator Schwecke presented the draft resolution including the revisions requested by the Commission. Discussion included revising the description of Mixed Residential with the consensus of the Commission was to accept the second proposed language to blend better and provide the Commission the most options in the future, defining infill development properties for future development and building off the proposed map while allowing for public hearings prior to rezoning a property. B. Potential recommendation by Plan Commission to Village Board Zoning Administrator Schwecke was directed to draft the Resolution to include the discussion points and bring back next meeting for final review. Recommendations for future agendas (no packet materials) • Potential revisions to the zoning code with regard to the Downtown Transition area described in the Village’s Comprehensive Plan • Trustee Renucci questioned signage restrictions for Matt’s Wild Foods and staff was directed to review with the Building Inspector. • Zoning Administrator Schwecke explained that there is a potential change to the site plan for the 2919 Main St. property and that they would like to modify some of the outside materials and change canvas awning to more of a metal look. Commission direction was to check the code for allowed awning materials and have the applicant come back with any change in awning materials. 12.
