Minutes Village of East Troy Plan Commission 2015 Energy Drive December 13, 2021 6:30 p.m. 1. Call to order- President Seager called the meeting to order at 6:30 p.m. 2. Pledge of Allegiance 3. Verification of open meeting notice – Clerk Alexander verified the meeting had been posted according to open meetings laws. 4. Roll call Present: President Seager, Trustee Renucci, Commissioners Edward Arendt, Chris Bottoni, and John Merath Excused: Roger Hayes Others: Zoning Administrator Schwecke, Administrator Suhm, Clerk Alexander 5. Citizen participation No citizen participation 6. Approve Plan Commission minutes of November 8, 2021 Motion by Trustee Renucci, second by Commissioner Arendt, to approve the minutes from November 8, 2021. Motion carried. 7. Amend site plan to accommodate outdoor events and other site improvements at LD’s BBQ located at 2511 Main Street (RA270200001), Leon Davis (application 2021-10) A. Possible action by Plan Commission Zoning Administrator Schwecke explained that this item is a continuation of the previous conditional use approval that was subject to site plan and plan of operations once his three properties were merged. The site plan shows the items that are currently on the property and the pavilion is shown for future consideration. At some point in the future, he may need to apply for a planned development district to allow for additional structures on the site if he needs them. Discussion included concerns with the traffic pattern in the parking lot with the location of the stage. Motion by Trustee Renucci, second by Commissioner Bottoni, to approve the site plan for the subject property, except for the proposed pavilion, which will be reviewed at a later date. Motion carried. 8. Petition to waive the bufferyard requirements pursuant to Section 510-119(E) of the zoning regulations for property off of South Executive Drive (RA498700003); MP Systems Inc, applicant (Application 2021-40) A. Possible action by Plan Commission Zoning Administrator Schwecke explained that this property is currently being developed and they are requesting a waiver for a portion of the bufferyard because there is substantial difference in the grade (of about 40’) from the parcel to the property to the west. They are requesting to waive the bufferyard along the west and south lot lines. They proposed installing a solid fence along the south lot line, from the southeast corner to the west for 220’ and another along the west lot line for about 350’ from the northwest corner to the south. Both of these locations will also utilize the trees and shrubs that are already in place. Motion by President Seager, second by Commissioner Bottoni, to approve the request to waive the bufferyard requirements pursuant to Section 510-119(E) of the zoning code based on a finding that the grades of the adjoining parcels are significantly different, but not in these specified areas: (1) along the north lot line where a minimum of 756 landscape points are needed; (2) along the west lot line, where a solid fence is required along with a minimum 387 landscape points; and (3) along the south lot line, where a solid fence is required along with a minimum 232 landscape points. Motion carried. 9. Discussion related to potential revisions to the zoning code and comprehensive plan with regard to the Downtown Transition area described in the Village’s Comprehensive Plan Zoning Administrator Schwecke discussed the draft ordinance reflecting previous Commission discussion points. Discussion included the impact of the changes on existing properties that don’t meet the requirements and how that would be handled, how the draft ordinance is a mix of TR-8 and Central Business District standards, if an existing parcel is non-conforming they can work to meet standards to be developed or be considered on a case by case basis, that if an owner should want to do something different with their property, such as a small scale retail business, this would be allowed even if the property is non-conforming as long as the use is permissible, a property owner cannot worsen a non-conforming situation such as enlarge a building, this ordinance will amend the current zoning code and modifies the existing tables. Direction is to bring back to the Plan Commission the draft ordinance with the map showing the additional parcels, the new CBD classification language, and the amendment to the Comprehensive Plan to show the Downtown Transition area on the land use map. 10. Recommendations for future agendas (no packet materials) • Revise application requirements for rezoning petitions • Revisions to floodplain regulations based on new DNR model ordinance and new flood maps • President Seager suggested discussion on the allowed driveway area and width. 11.
