Village of East Troy Plan Commission

1. Call to order- President Seager called the meeting to order at 6:30 p.m.
2. Pledge of Allegiance
3. Verification of open meeting notice – Clerk Alexander verified the meeting had been posted
according to open meetings laws.
4. Roll call
Present: President Seager, Trustee Renucci, Commissioners Chris Bottoni, Roger Hayes, Jacob
Lederhaus, and John Merath (attending via phone)
Excused: Edward Arendt
Others: Zoning Administrator Schwecke, Administrator Suhm, Clerk Alexander
5. Citizen participation

6. Approve Plan Commission minutes of December 12, 2022
Motion by Trustee Renucci, second by Commissioner Hayes, to approve the minutes as
presented. Motion carried.
7. Three-lot certified survey map in Town of East Troy off of Swoboda Road (PET3100008) (within
the Village's extraterritorial plat review jurisdiction); Justin and Mary Rohrer, applicant
(application 2022-40)
A. Possible recommendation by Plan Commission to Village Board
Motion by Commissioner Bottoni, second by Commissioner Lederhaus, to recommend to the
Village Board the approval of the proposed CSM in the Town of East Troy subject to the following
condition: 1. Prior to the Village signing the final CSM, the property owner shall reimburse the
Village of East Troy for all unpaid costs and expenses of any type that the Village incurs in
connection with this development, including the cost of professional services incurred by the
Village (including engineering, legal, planning and other consulting fees) for the review and
preparation of required documents or attendance at meetings or other related professional
services for this application. Motion carried.
8. New telecommunication tower located at 2485/2491 STH 120 (RXUP 00230A), Village of East
Troy, applicant (application 2022-38)
A. Public hearing
President Seager reconvened the Public Hearing from the Dec. 12, 2022 meeting.
Zoning Administrator Schwecke reviewed the topic and stated that this application is not for a
conditional use as previously stated because several years ago the state legislature made a
separate process for telecommunication facilities applications, and he has revised his staff report
to reflect the development standards that apply. He restated that the FAA has determined the
facility will not harm public air space, Walworth County has shown there is no other site to
accommodate the tower, and the need for landscaping may be waived based on the location.
Administrator Suhm explained that the Financial Guarantee standard is not applicable as the
Village owns the property.
Captain Todd Newman, Walworth County Sherriff’s Department, stated that the County has done
research of the health effects of the tower which states that harmful effects would require a
person to be inside fenced area and remain there for quite a long time before there may be some
effect and that they would have to climb the tower and hold the antenna for over 15 minutes
while the tower was transmitting consistently. The area is secured to prevent access and the
tower will not be transmitting consistently but in bursts. He provided documents to support this
research.
Mark Luberda, Walworth County Administrator, stated that this project is part of the County radio
plan and he wanted to attend to answer any questions for the County from the Commission. He
stated that the County supports this project.
President Seager closed the public hearing at 6:38 pm.
B. Discussion and possible recommendation to the Village Board
Motion by Trustee Renucci, second by Commissioner Bottoni, to recommend to the Village Board
the establishment of a new telecommunication tower based on the finding that the height of this tower
is required to accommodate the Sheriff’s Department needs and no other tower in or near East Troy is
able to accommodate such requirement and that the FAA has determined the height of the tower will
not pose a threat to air navigation and to also install a red beacon on the top of the tower once it is
erected. Motion carried.
9. Site plan for a new telecommunication tower located at 2485/2491 STH 120 (RXUP 00230A),
Village of East Troy, applicant (application 2022-39)
A. Discussion and possible action
Motion by Trustee Renucci, second by Commissioner Lederhaus, to approve the site plan/plan of
operation as set forth in the submittal documents, subject to the following terms and conditions:
1. The Village Board approves the new tower for the proposed use.
2. The landscape requirement around the base of the tower as set forth in § 510-43(I) of the
zoning code is waived because the compound enclosure is not readily visible. The Plan
Commission reserves the right at a later date to impose landscaping requirements should the
existing trees and other vegetation in the vicinity of the tower base are removed or no longer
exist for whatever reason.
3. Prior to construction, the petitioner must submit written documentation to the Village
planner that shows the fall zone will not extend beyond the 100-foot radius as depicted on the
site plan.
Motion carried.
Captain Neumann will provide a fall zone letter from the County.
10. Potential revisions to the zoning regulations with regards to standards for accessory buildings in
the industrial zoning districts
A. Discussion and possible action to set public hearing date
Discussion included the allowed size of such an accessory building and if that should be
determined in square footage or as a percentage of the primary structure. Zoning Administrator
Schwecke will bring this document back at the next meeting with a recommendation of the size
percentage of the primary structure for the public hearing and in ordinance format.
11. Recommendations for future agendas (no packet materials)
• Revise application requirements for rezoning petitions
• Potential regulations/information related to front-yard setbacks on side-loaded homes
12. Next meeting: February 13, 2023 - if needed

Motion by President Seager, second by Trustee Renucci, to adjourn. Motion carried at 6:47 p.m.
