Minutes Village of East Troy Plan Commission 2015 Energy Drive 5/8/2023 6:30 p.m. 1. Call to order- President Johnson called the meeting to order at 6:30 p.m. 2. Pledge of Allegiance 3. Verification of open meeting notice – Clerk Alexander verified the meeting had been posted according to open meetings laws. 4. Roll call: Present: President Johnson, Trustee Renucci, Commissioners Edward Arendt, Roger Hayes, Jacob Lederhaus and John Merath Excused: Chris Bottoni Others: Zoning Administrator Schwecke, Administrator Suhm, Clerk Alexander 5. Citizen participation None 6. Approve Plan Commission minutes of April 10, 2023 Motion by Trustee Renucci, second by Commissioner Hayes, to approve the minutes as presented. Motion carried with President Johnson abstaining (due to not attending that meeting). 7. Proposed amendment of the Village's comprehensive plan by changing the land use classification of Tax Parcel ROP 00008 on the future land use map; McCrete LLC (Jeff McPherson, agent) A. Discussion and possible action Zoning Administrator Schwecke explained that this is the first step in a multi-step process. The two adjoining parcels have different zoning designations, and the applicant would like both parcels zoned the same as GI General Industrial. In order to accomplish this there would need to be a change to the future land use map changing the southern parcel from commercial to industrial. The GI General Industrial property is currently bordered by HB Highway Business parcels and there is a difference in the impact of these two zoning classifications on the surrounding properties. Currently the north property is zoned GI General Industrial and has been for some time now. The buildings there are not the typical but are more commercial in nature. Parcels to the east are more industrial uses such as storage. The HB Highway Business zoning was deemed to be more commercial in nature to accommodate the storage facility. This area would not be created today in an area surrounded by residential use and so near a downtown area. The current use has been in place for a long time. Zoning Administrator Schwecke also explained that this would be a Plan Commission resolution which would then go to the Village Board to consider, and they would hold a public hearing and draft an ordinance to adopt. Motion by Commissioner Arendt, second by commissioner Hayes, to recommend to the Village Board the approval of Resolution 2023-11 dated April 13, 2023, based on the findings contained in the draft resolution. Motion carried. 8. Amend site plan/plan of operation for LD’s BBQ located at 2511 Main Street for various site improvements; Leon Davis, applicant A. Discussion and possible action Zoning Administrator Schwecke stated that the contractor was attending and acting as agent for applicant. The applicant had come before the Commission and Village Board about a year ago for a conditional use/site plan application to allow for the pavilion and the conditional use was approved. The site plan was conceptual and now there is more detailed information to amend the site plan for the pavilion construction. This will be a temporary or seasonal use pavilion and a temporary use facility can, under building code, share the bathrooms with the restaurant. The applicant is aware that this can only be a seasonal use facility. The architecture/construction will match the existing restaurant, parking is close to be required amount and there is space on the property to construct additional parking. The landscaping plan and lighting plans need to be fine-tuned and the draft motion allows final approval at staff level. The south side of the lot will need to have parking curbs as included in the draft motion. Trustee Renucci expressed his concerns about possible parking issues and bathrooms in the restaurant not able to accommodate any events and would like to see plans for the use of portable toilets. His other concern is to not allow attendees to purchase beer from neighboring establishments and bringing it back to LD’s for consumption. While these may be valid concerns, they are outside the scope of the Plan Commission’s site plan review, as some of these concerns tie directly back to the conditional use. Motion by Commissioner Arendt, second by Commissioner Lederhaus, to approve the site plan/plan of operation for the project consisting of the 4,000- square-foot building as set forth in the submittal documents, provided: (1) The petitioner submits an outdoor lighting plan to comply with the maximum lighting level at the lot line to the zoning administrator and obtains approval of the same. (2) The petitioner submits a revised landscaping plan to the zoning administrator to show that more plantings are made within and/or near the parking area especially on the south side. (3) The petitioner obtains a zoning permit from the zoning administrator prior to any land- disturbing activity related to this project. (4) If the use of the pavilion requires additional parking, the petitioner will submit a site plan application amendment to show more parking. (5) The petitioner must comply with the curbing requirements in s. 510-93(F) of the zoning code. Motion carried. 9. Recommendations for future agendas: • Revise application requirements for rezoning petitions • Potential regulations/information related to front-yard setbacks on side-loaded homes 10.
