Minutes Village of East Troy Plan Commission 2015 Energy Drive 3/11/2024 6:30 p.m. 1. Call to order- President Johnson called the meeting to order at 6:30 p.m. 2. Pledge of Allegiance 3. Verification of open meeting notice – Clerk Alexander verified the meeting had been posted according to open meetings laws. 4. Roll call Present: President Johnson, Trustee Renucci, Commissioners Edward Arendt, Chris Bottoni, Roger Hayes, Jacob Lederhaus, and John Merath Others: Zoning Administrator Schwecke, Administrator Suhm, Clerk Alexander 5. Citizen participation Tom Senft, 2141 Church Street, representing Oak Ridge Cemetery, relating to the coffee retailer development, discussed the property clearing and his concern for the privacy and dignity of the cemetery users and is working with the property owner/developer. 6. Approve Plan Commission minutes of February 12, 2024 Motion by Trustee Renucci, second by Commissioner Arendt, to approve the minutes from February 12, 2024. Motion carried with Commissioner Lederhaus abstaining. 7. Amend the Village’s zoning regulations (Chapter 510) with regard to incidental outdoor display in the Light Industrial (LI) District and General Industrial (GI) District; MDC East Troy, LLC (Josh Manthei), applicant (application 2024-03) A. Public hearing President Johnson opened public hearing at 6:41 pm. Zoning Administrator Schwecke presented the application for a text amendment allowing incidental outdoor displays in the Light Industrial (LI) and General Industrial (GI) zoning districts. If this change is made it will apply to all properties zoned Light Industrial (LI) and General Industrial (GI). Discussion included potential scenarios, possibility of allowing as a conditional use, and options to allow Commission to maintain input wherever this is requested, especially for any properties that may be located more centrally within the Village. President Johnson closed the public hearing at 6:48 pm. B. Recommendation to Village Board Motion by President Johnson, second by Trustee Renucci, to recommend approval of the proposed ordinance as amended with Section 1 to read “as permitted by conditional use within those districts”. Motion carried. 8. Amend the Village’s zoning regulations (Chapter 510) with regard to screening of outdoor storage areas in the Mixed Business/Light Industrial Design Overlay District; MDC East Troy, LLC (Josh Manthei), applicant (application 2024-04) A. Public hearing President Johnson opened public hearing at 6:47 pm. This item refers to screening for outdoor storage areas such as a vehicle yard which is outdoor storage and wholesaling. The proposal is to amend the section of the code that requires screening around the outdoor storage area and allow the Plan Commission to review requests on a case-by-case basis and allows the Commission to defer the screen if not needed. Zoning Administrator Schwecke explained that if this were to pass screening or the request of a waiver would come before the Plan Commission as part of the site plan and the Commission could review the layout and allow for restrictions and/or future review if needed for oversight. This would allow for changes in the future should the use change or a neighboring property develops, and screening becomes necessary. President Johnson closed public hearing at 6:51 pm. B. Recommendation to Village Board Motion by Trustee Renucci, second by Commissioner Lederhaus, to recommend to the Village Board the proposed text amendment set forth in the draft ordinance dated February 19, 2024. Motion carried. 9. (ON HOLD) Final development plan for Overlook Ridge, a proposed planned development district with a total of 145 multi-family dwelling units; Sawall Development, applicant (application 2023-37) 10. Discussion related to the regulation of polystructures as an accessory use in residential zoning districts President Johnson explained that there has been a complaint regarding this type of structure to Chief Swendrowski and the history of this topic. Chief Swendrowski found several other situations similar to the complaint within the Village. These structures are not allowed under our current ordinances and the discussion is whether this should be directed to Code Compliance or consider amending the code to allow these structures. Discussion included that these are a violation of current code, should the code be amended to allow permanent structures but not poly structures, structures not allowed in front yards, define permanent car port structures vs poly structures, possibility of a seasonal allowance, difference between plastic, canvas, tarp, soft material, poly versus metal structure that would be installed and fastened permanently, safety of installation, the current standards for accessory structures and would these structures be covered under the a cc es so ry st r uc tu re co de , a n d ho w t hi s wo ul d p ert a i n to s hi p pi n g co nt ai ne rs . The direction to staff was to refer violations to Code Compliance to notify homeowners. Direction to staff is to draft a modification for vehicle storage within the accessory structure section (after checking with building fire codes) that define materials if different from the home, prohibit soft materials, only allowed on side of home with an approach and define temporary use, (such as a party tent). 11. Recommendations for future agendas • Tiny homes as accessory uses in residential zoning districts • Revise application requirements for rezoning petitions • Potential regulations/information related to front-yard setbacks on side-loaded homes • Review the Comprehensive Plan ratio of single-family homes to multi-family due to house shortage. • Storage Container use – review prior information brough on this and bring it back for consideration. 12.
