1. Call to order- President Johnson called the meeting to order at 6:30 p.m.
2. Pledge of Allegiance
3. Verification of open meeting notice – Administrator Suhm verified the meeting had been posted
according to open meetings laws.
4. Roll call
Present: President Johnson (attended remotely), Trustee Renucci, Commissioners Edward Arendt, Chris
Bottoni, Roger Hayes, Jacob Lederhaus and John Merath
Excused:
Others: Zoning Administrator Schwecke, Administrator Suhm
5. Citizen participation
Lois Clark, 2754 Frontage Road, addressed the Commission regarding item 11 on the agenda related to
polystructures in residential zoning districts. She thanked the Commission for placing this on the
agenda for discussion and possible action. Ms. Clark discussed a property that has had a polystructure
in place for approximately 18 months, referring to a prior memo stating the building inspector’s opinion
was this type of structure is not compatible with surrounding buildings nor is it complementary to the
architectural style or materials of the principal building. She urged Commissioners when reviewing the
code to take into consideration the intent of the code and expressed concerns the particular property
she is referring to is a corner lot so even if it were moved to the rear yard, it would be visible from a
street.
Rosemary Bennett, 3004 South Street, stated she has a couple of questions related to the Overlook
Ridge development. She questioned whether the traffic study has been completed, how a TID works,
whether a TID allows an automatic zoning change, and when a TID will be formed. She expressed
support for a lot of what is going on in the Village, stating we also need to be careful about what we
vote yes for.
6. Approve Plan Commission minutes of March 11, 2024
Motion by Trustee Renucci, seconded by Commissioner Hayes to approve the Plan Commission minutes dated
March 11, 2024. Motion carried.
7. Three-lot certified survey map in ETZ located at N8356 Weber Lane (P ET2300005); Fred and Judith Kmiec,
applicant (application 2024-05)
A. Recommendation to Village Board
The property owner’s surveyor, Mike Greeson, stated the County has done a preliminary review found the
easements acceptable.
Motion by Commissioner Bottoni, seconded by Commissioner Merath to recommend to the Village Board
approval of the proposed CSM in the Town of ET subject to the terms and conditions as listed, conditions 1-2.
Motion by Commissioner Bottoni, seconded by President Johnson, to amend the motion adding a third
condition to change the name of the Village President to Robert M. Johnson. Motion carried.
Vote on the original motion carried.
8. Final development plan for Overlook Ridge, a proposed planned development district with a total of 145 multi-
family dwelling units; Sawall Development, applicant (application 2023-37)
A. Action by Plan Commission
Kevin Sawall, applicant, reviewed the changes to the site plans which included the addition of the walking
path and shifting of the building due to the primary environmental corridor. The traffic study is still in
process and is expected to be complete within a couple of weeks.
Commissioner Merath questioned whether another driveway for ingress/egress should be on the east side
of the property to get out in an emergency. The Commission discussed egress in an emergency such as a fire
and that it is not desirable for the fire department to have residents leaving by vehicle, the east driveway
would be across another owner’s property, the Fire Chief has reviewed the plans, and this discussion was
not included in the prior approval steps (preliminary and general)
Discussion also included a question regarding stormwater plans accommodating a 100-year flood and the
stormwater management plan the developer is required to prepare, bufferyard requirements along the
adjacent single-family residential property, conditions of approval in the staff report, the formation of a tax
incremental district (TID) is a separate process and public notice is given for those meetings, and whether
the traffic study should be reviewed at a staff level. Also discussed the results of the traffic study will likely
be the alignment of an entrance or something of that nature. A main arterial road is typically able to handle
this level of traffic.
Kevin Sawall acknowledge he has reviewed the staff report and has no questions. His Engineer has begun
working through some of the conditions of approval. Zoning Administrator Schwecke reminded him to use
the conditions a checklist and make sure everything is addressed prior to permit issuance.
Motion by Commissioner Hayes, seconded by Commissioner Arendt, to not approve the site plan as
submitted. Motion failed 3-4 (Yes=Commissioners Arendt, Hayes, and Merath; No=President Johnson,
Trustee Renucci, Commissioners Bottoni and Lederhaus)
Motion by Commissioner Bottoni, seconded by Renucci to approve the development plan subject to 25
conditions listed in the staff report and adding a 26th condition to complete a traffic study and acceptance by
staff that it is okay to proceed. Motion carried 4-3. (Yes=President Johnson, Trustee Renucci,
Commissioners Bottoni, and Lederhaus; No=Commissioners Arendt, Hayes, and Merath)
If staff sees an issue with the traffic study they were directed to bring it back to the Plan Commission.
9. One-lot certified survey map to merge 5 existing parcels located off of Main Street at the intersection with
School Street; Overlook Ridge Exchange LLC (Kevin Sawall), applicant (application 2024-07)
A. Recommendation to Village Board
Motion by Commissioner Bottoni, seconded by Commissioner Lederhaus, to approve the one-lot certified
survey map based on general conditions 1-4 and specific conditions 1-3. Motion carried 6-1 with
Commissioner Hayes voting no.
10. Amendment of the Village's land division regulations (Chapter 495)
A. Recommendation to Village Board
Motion by Trustee Renucci, seconded by Commissioner Bottoni, to recommend to the Village Board adoption of
draft ordinance as proposed. Motion carried.
11. Discussion related to the regulation of polystructures as an accessory use in residential zoning districts (no
packet materials)
President Johnson mentioned an e-mail received from a resident regarding a garden type canopy/pergola and the
need to word any ordinance so this type of structure/use is not prohibited. Administrator Suhm will discuss the
prior Plan Commission direction to have code enforcement address polystructures with the Chief of Police.
12. Recommendations for future agendas (no packet materials)
• Tiny homes as accessory uses in residential zoning districts
• Revise application requirements for rezoning petitions
• Potential regulations/information related to front-yard setbacks on side-loaded homes
• Commissioner Hayes suggested adding shipping containers to the list
13. Next meeting: May 13, 2024 at 6:30 pm, if needed

Motion by President Johnson, second by Commissioner Hayes to adjourn at 7:22 p.m. Motion carried.

under the jurisdiction of the Plan Commission, whether on the agenda or not. The Plan Commission should
not engage in a discussion regarding comments because it was not part of the publicly noticed agenda.
Upon conclusion of this Citizen Participation segment, members of the audience are not allowed further
comment unless they are participating in a public hearing or if specifically allowed by a majority vote of the
