Call to order- President Johnson called the meeting to order at 6:30 p.m.
Pledge of Allegiance
Verification of open meeting notice – Clerk Alexander verified the meeting had been posted according
to open meetings laws.
Roll call:
Present: President Johnson, Trustee Renucci, Commissioners Jacob Lederhaus and John Merath
Excused: Commissioners Bottoni, Hayes, and Seager
Others: Zoning Administrator Sumwalt, Administrator Suhm, Clerk Alexander
Citizen participation – None
Approval of Minutes – May 13, 2024
Motion by Commissioner Merath, seconded by Commissioner Lederhaus, to approve the minutes from
May 13, 2024. Motion carried.
Miscellaneous Business
1. Preliminary consultation with Adam Duda, petitioner regarding conceptual plan for property
located at 2031 Division Street (RA495400002); Duda at Division Street, LLC, owner; Jason
Dupuis of R.H. Batterman & Co., Inc., agent
Jason Dupuis and Kristine Belongla, R.H. Batterman & Co., Inc., were present to represent the
developer. Zoning Administrator Sumwalt reviewed his staff memo and explained this is a
preliminary consultation of a concept plan for a project to include four (4) two-family residential
lots, nine (9) single-family residential lots, and one (1) out lot on approximately 4.819 acres.
Proposed lots range from approximately 9,038 SF to 14,438 SF.
Discussion included Comprehensive Plan/Future Land Use designation of the referenced
property for Mixed Residential use, zoning and the request to rezone the property from SR-4
Suburban Residential to TR-8 Two-Family Residential, the density allowed by these zoning
districts, the use of a new street off Division Street as a cul du sac, use of the out lot for
stormwater in the southwest corner of the property, full review by Village Engineer had not
been completed as this is a concept consideration, size of the sidewalk proposed, developer
would be asked to fund and bear the cost of upgrades to Village systems, how snow removal
would be handled, desired look of the exterior design of the buildings to blend with the
surrounding neighborhood, parking, width of the road, fences, and attention to the stormwater
capacity.
The applicant stated they have been in communication with Village Staff regarding DPW needs
and that the four lots closest to Division Street are the planned two-family sites. There is no
official timeline for the project but would like to continue to move forward within the next few
months.
The next steps were outlined as moving forward with a preliminary plat application and rezone
application to the Plan Commission and once that additional information is provided the final
plat and development agreement would come back to the Plan Commission. At the hearing for
the preliminary plat the applicant will be presenting more information on the details of the
development including the style possibilities for the homes.
Ordinances/Code Amendments
1. Discussion and direction to staff regarding a potential code amendment related to
polystructures and cargo containers as accessory uses in residential zoning districts
Zoning Administrator Sumwalt reviewed the history of the topic and provided sample language
from other municipality’s ordinances on the issue for review and discussion.
Discussion on polystructures included definitions of the various components for clarification,
long term vs short term use, information that will be provided by the Building Inspector,
consideration of adopting the Uniform Building Code for accessory structures, consideration of
roof material for snow loads, setback requirements, identification of “active vehicles”, perhaps
broadening the definition of “carport”, and require a building permit and inspection.
The direction was to draft language once information is received from Building Inspector to be
presented for a Plan Commission workshop and request the Building Inspector attend the
meeting
Discussion on cargo containers used as accessory structures included review of the provided
sample language that does not allow them used as an accessory structures but does allow an
exception for construction use or a temporary short term need use, requiring permission,
considered on a case by case basis, not to have them used as an accessory storage building or if
allowed to be used as an accessory storage building be subject to the regular code, how difficult
would it be to fit into the code, retaining architectural standards would probably not be met
with this use and would need to be addressed. Regarding use as an accessory dwelling building
would probably require drafting a new code for use as an office, in-law suite, etc. Other
communities do allow this with rules and regulations. Discussion included national trend in
planning to consider this option to ease the housing crisis by allowing more than one dwelling
on a single-family property.
The direction was to address the issue of carports/polystructures, then consider cargo
containers and then the idea of accessory structure dwelling units.
Recommendations for Future Agendas
• Comprehensive plan as it relates to affordable housing
• Tiny homes as accessory uses in residential zoning districts
• Revise application requirements for rezoning petitions
• Potential regulations/information related to front-yard setbacks on side-loaded homes
