MINUTES EAST TROY PLAN COMMISSION 2015 Energy Drive 9/16/2024 5:00 PM Call to order- President Johnson called the meeting to order at 5:00 p.m. Pledge of Allegiance Verification of open meeting notice – Clerk Alexander verified the meeting had been posted according to open meetings laws. Roll call: Present: President Johnson, Trustee Renucci, Commissioners Roger Hayes, Jacob Lederhaus, John Merath, and Scott Seager Others: Zoning Administrator Sumwalt, Administrator Suhm, Clerk Alexander Citizen participation Tom Senft, 2141 Church St., spoke regarding Starbucks/Oak Ridge Cemetery, update on potential ordinance language changes regarding drive-thru operations, neighboring zoning districts, bufferyards and potential additional businesses. Harvey Altenburg, Town of East Troy resident and President of Oak Ridge Cemetery, spoke regarding communication on the development of neighboring properties. Approval of Minutes – August 12, 2024 Motion by Commissioner Seager, second by Commissioner Lederhaus, to approve the August 12, 2024, minutes. Motion carried. Ordinance/Code Amendments 1. Consider an ordinance to amend the Village’s zoning regulations (Chapter 510) 1a. Ord. 2024-12 Regarding accessory building requirements. A. Public Hearing President Johnson opened the public hearing. Zoning Administrator Sumwalt reviewed the history of poly structures that will now by identified as carport canopies, and the amendment to add the definition of carport canopies to the zoning code in reference to these specific structures. President Johnson closed the public hearing. B. Recommendation to the Village Board Motion by Commissioner Seager, second by Commission Hayes, to recommend Village Board approve Ord. 2024-12. Motion carried. 1b. Ord 2024-13 Regarding temporary use requirements for temporary construction storage. A. Public Hearing President Johnson opened the public hearing. It was noted that the ordinance in the packet under item 1b was the draft ordinance regarding temporary use requirements for portable on-demand storage units. Zoning Administrator Sumwalt reviewed the updated language from the existing code to recognize temporary construction storage, to provide clearer definitions and add cargo containers into the code definition. President Johnson closed the public hearing. B. Recommendation to the Village Board Motion by Commissioner Seager, second by Commissar Lederhaus, to recommend Village Board approve Ord. 2024-13 regarding temporary use requirements for portable on-demand storage units with the correction to the ordinance number. Motion carried. 1c. Ord 2024-14 Regarding temporary use requirements for portable on-demand storage units. A. Public Hearing President Johnson opened the public hearing. It was noted that the ordinance in the packet under item 1c was the draft ordinance regarding temporary construction storage. Zoning Administrator Sumwalt reviewed the updated language from the existing code to recognize portable on-demand storage units and to provide clearer definitions added into the code. President Johnson closed the public hearing. B. Recommendation to the Village Board Motion by Commissioner Seager, second by Commissar Hayes, to recommend Village Board approve Ord. 2024-14 regarding temporary construction storage units with the correction to the ordinance number. Motion carried. 2. An ordinance to amend the Village’s zoning regulations (Chapter 510) regarding nonconforming structure requirements. A. Public Hearing President Johnson opened the public hearing. Zoning Administrator Sumwalt reviewed the language from the existing code and how the proposed language would reference many of the older parcels in the village to accommodate changes to existing structures. Discussion requested the ordinance language to be corrected to remain consistent with the use of “structures” to encompass all nonconforming structures, not just garages. President Johnson closed the public hearing. B. Recommendation to the Village Board Motion by Commissioner Seager, second by Commissar Hayes, to recommend Village Board approve Ord. 2024-15 with the change to language in section 2, subsection 4 the word “garage” will be struck and replaced with “structure” to be consistent with language in section 1, subsection b. Motion carried. 3. Discussion related to amending the Village’s zoning regulations (Chapter 510) regarding the final approval of planned development districts. Administrator Suhm explained the conflicting language currently found in the code regarding the three-steps for a PDD and this proposal would change that language to maintain consistency and clarification that the final authority is the Plan Commission. Direction to staff was to draft a public hearing notice to approve the proposed language change. Miscellaneous Business 1. Preliminary consultation with Village of East Troy, petitioner regarding conceptual plans for properties located at approximately Trent Street and Hilcrest Avenue (RXUP 00160, RXUP 00166, RXUP 00167, RXUP 00169, ROP 00170, RMS 00005, RMS 00012); Crucible Materials Corporation Environmental Response Trust C/O Bruce Keyes Foley & Lardner LLP, owner. Zoning Administrator Sumwalt reviewed the background of this item and the history of the property. He stated that a TID may be considered for development of the property. The drawings from Vandewalle show remediations and possible uses. There are many considerations associated with this property before final decisions, including the proximity of Honey Creek, wetland areas, environmental corridors, flood plains, and other challenges for development. The concept drawings are options to consider development for housing and showed two possible layouts. The village is the interested party in any development at this location. The concepts help visualize options. These drawings were provided for visual reference and for feedback to staff, no action is to be taken. Discussion included the level of remediation to be done to residential use rather than industrial use, the need for senior and affordable/workforce housing as both rental and ownership, providing a pathway to ownership and financial equity, thoughts on the density shown in the concept options, suggestion for a blend of the two options to allow a mid-range density while retaining the senior housing component, timeframe for work, consideration of building tax base vs tax drain, and procedural questions regarding potential comprehensive plan changes that would be needed. Consensus was to move forward with consideration of this area for future residential development.
