MINUTES EAST TROY PLAN COMMISSION 2015 Energy Drive 3/10/2025 6:30 PM Call to order- President Johnson called the meeting to order at 6:30 p.m. Pledge of Allegiance Verification of open meeting notice – Clerk Smith verified the meeting had been posted according to open meetings laws. Roll call: Present: President Johnson, Trustee Renucci, Commissioners Bryan Harding, Roger Hayes, Jacob Lederhaus, John Merath, and Scott Seager Others: Zoning Administrator Sumwalt, Administrator Suhm, Clerk Smith Approval of Minutes – February 10, 2025 Motion by Commissioner Seager, second by Commissioner Merath, to approve the minutes as presented. Motion carried. Miscellaneous Business 1. Conditional use for outdoor storage and wholesaling related to the construction of a new industrial building for property located on the northeast side of the cul-de-sac for South Executive Drive bearing Tax Parcel No. RA512200002, MP Systems, Inc., Christopher Wenzler (Briohn Building Corp) agent (application 2025-04). a. Public hearing Zoning Administrator Sumwalt gave an overview of the proposed plan for MP System’s new building, and plans for outdoor storage, screening, landscaping, and parking lot striping. Trustee Renucci asked if the drain pipe is sized large enough for the parcel. Petitioner Chris Wenzler with Briohn Building Corp. explained that he had spoken with the Village engineers, and that based on their engineering calculations, a 36-inch pipe was recommended. b. Discussion and recommendation to the Village Board Motion by Commissioner Seager, second by Commissioner Lederhaus, to recommend to the Village Board approval of the Conditional Use Request for outdoor storage and wholesaling related to an approximately 130,000 square foot industrial building for MP Systems, Inc. at S. Executive Drive for MP Systems, Inc. for the property located at S. Executive Drive, (RA512200002) subject to the nine conditions listed. Motion carried. 2. Site plan and architectural review for an approximately 130,000 square foot new industrial building for light assembly, and storage associated with the prefabrication of panels, electrical conduit components, and tooling packages for property located on the northeast side of the cul-de-sac for South Executive Drive bearing Tax Parcel No. RA512200002, MP Systems, Inc., Christopher Wenzler (Briohn Building Corp) agent (application 2025-05). a. Discussion and action by Plan Commission Zoning Administrator Sumwalt reviewed the proposed Site Plan with the Commission. He said it is a very nice building that meets the standards for the overlay zoning, and the overall parking and lighting all meet the Village’s requirements, although wall signage would need to be presented for approval. He said that the property has two wetlands that are under 10,000 sq. ft., that are being reviewed by the Department of Natural Resources (DNR,) and the Army Corps of Engineers, with the intent to fill the larger of the wetlands, but preserving the smaller wetland on the property, which will have a retaining wall between it and the building and will preserve a number of trees if the grading allows. The Conditional Use Permit approval is contingent on those two entities’ approvals and permits. Under industrial site zoning, the Village’s tree preservation ordinance would not apply. The Village Engineer had reviewed the Site Plan, and recommended shifting the driveway to the north on the property where the future road reservation exists because the drive as depicted on the plans is within the building’s fall zone. The new location of the driveway will require it to be removed in the future when the road is installed. Trustee Renucci mentioned that when the north Business Park was established, he thought that the DNR allowed for “trading” of wetland areas… if one was removed, then another had to be made on the site. He asked if this idea was essentially what was being proposed for this project. Zoning Administrator Sumwalt said that one of the options when a developer is proposing to fill in a wetland is either purchasing credits or create wetlands in a different location. He clarified that this is not what is being proposed, and that the reason the developer brought it up was because there was not anything initially agreed upon for this particular property. Motion by Commissioner Seager, second by Commissioner Hayes, to approve the Site Plan/Plan of Operation Request for MP Systems, Inc. for the property located at S. Executive Drive, subject to the 23 conditions listed. 3. Discussion related to the two-family residential planned land use category from the Village’s Comprehensive Master Plan. Zoning Administrator Sumwalt explained after he received direction at the February Plan Commission meeting, he looked at the areas in and around downtown-- that there is a slight discrepancy between what some properties are currently zoned and what the land use plan calls for. He said some areas zoned TR-8 were a residential land use and other areas were something else, like mixed residential, with no specific mention of two-family residential. His draft future land use map would replace “Single-Family Residential- Sewered” for certain properties in and around downtown zoned TR-8 Two Family Residential, with a new category, called “Single Family and Two-Family Residential.” This new district would allow for single-family and two-family residential land use that acknowledges pre-existing zoning. He added that not only would the amendment assist with the Village’s housing needs but could also assist the owner of a parcel that had sparked the discussion on two-family residential. Although that particular lot is not currently zoned TR-8, Mr. Sumwalt explained that they could propose a land use plan amendment and request rezoning for their parcel to accomplish their goals. Motion by President Johnson, second by Trustee Renucci, to direct staff to put together and post a Class 1 Public Hearing Notice to make the adjustment to the Village’s Comprehensive Master Plan, as discussed. Motion carried. 4. Discussion related to the number of access points allowed on any street frontage adjacent to any lot. Zoning Administrator Sumwalt explained that the discussion started in February when a request by the East Troy Middle School was made to add an access point to their pickup area to separate parent drop/off and pickup from bus traffic. The Commissioners had directed him to come back with ideas that would permit adding access points for situations like the Middle School. Mr. Sumwalt said that in addition to the Middle School, other such requests had come forward since he began working for the Village. He then outlined his proposal to amend §510- 91 D (1) Access Standards to allow the Plan Commission flexibility in determining the appropriate number of access points for non-residential uses. He further explained that any proposed accesses would need approval by the Village’s Director of Public Works, and that any properties on County/State Roads must also meet Walworth County requirements or State requirements as appropriate. Motion by Commissioner Seager, second by Commissioner Lederhaus, to approve the verbiage under §51091 D (1), for staff to complete that for our changes and go to a public hearing afterwards. Motion carried.
