MINUTES EAST TROY PLAN COMMISSION 2015 Energy Drive 4/14/2025 6:30 PM Call to order- President Johnson called the meeting to order at 6:30 p.m. Pledge of Allegiance Verification of open meeting notice – Clerk Smith verified the meeting had been posted according to open meetings laws. Roll call: Present: President Johnson, Commissioners Roger Hayes, Jacob Lederhaus, John Merath, and Scott Seager Excused: Bryan Harding Others: Zoning Administrator Sumwalt, Administrator Suhm, Clerk Smith Citizen participation None Approval of Minutes – March 10 & 24, 2025 Motion by Commissioner Seager, second by Commissioner Lederhaus, to approve the minutes as presented. Motion carried. Ordinances/Code Amendments 1. An ordinance to amend the Village’s zoning regulations (Chapter 510) regarding access standards. a. Public hearing Zoning Administrator Sumwalt spoke on the draft language for the Ordinance amendment regarding to access standards, specifically 510-91 D. (1) related to the number of access points. “Each lot shall have not more than two access points on any street frontage adjacent to any lot. Said access shall require approval by the Director of Public Works. Upon petition the Plan Commission may, with good cause, allow additional access points for non-residential context of a particular property. “ He mentioned that changing the Ordinance would allow the Plan Commission some flexibility on a case-by-case basis when considering applications for unique parcels, such as the third access point being proposed by the East Troy Middle School to improve public safety. There were no members of the public in attendance for the public hearing and no questions from the Commissioners. President Johnson closed the public hearing. Discussion and recommendation to the Village Board Motion by Commissioner Seager, second by Commissioner Lederhaus, to recommend to the Village Board approval of the proposed Text Amendment as set forth in the draft ordinance dated March 17, 2025. Motion carried. Miscellaneous Business 1. One-lot certified survey map for property located at 3147 Main Street (RXUP 00198); Colleen Anderson (The Climbing Tree Childcare & Family Education Center, Inc.), applicant (application 2025-08) Zoning Administrator Sumwalt told the Commission that the certified survey map was previously approved by the board, and was only being brought before the Commission for re-approval due to a technicality, that the previous CSM had not been recorded with Walworth County. After looking at the Village’s rules regarding re-approval, and because a certain amount of time has passed, the same process had to be gone through again for the CSM approval. The only addition to the original submittal was that he had provided an aerial map that shows the portion of the neighbor’s property the daycare was looking to purchase, which they are already using as an outdoor classroom/play area. The only improvements on the property is an existing shed. Approval of the CSM would create a split-zoned lot, which is not common in the village, but works given the context of the lot’s use and the use of adjacent properties. a. Discussion and possible recommendation to the Village Board Motion by Commissioner Seager, second by Commissioner Merath, to recommend to the Village Board Approval of the Certified Survey Map for Colleen Anderson (The Climbing Tree Child Care and Family Education Center Inc.) for the property located at 3147 Main Street (RXUP 00198) subject to the four conditions presented. Motion carried. Recommendations for Future Agenda • Two-Family Residential Planned Land Use Category • Tiny homes as accessory uses in residential zoning districts • Revise application requirements for rezoning petitions • Potential regulations/information related to front-yard setbacks on side-loaded homes Zoning Administrator Sumwalt noted he will submit the public hearing notice for the June meeting regarding the Comprehensive Plan related to two-family residential zoning.
