Roll Call: Acting President Johnson called the meeting to order at 6:30 p.m. Present: President Johnson, Trustees John Alexander, Jim Holm, Mary Nugent, Fortune Renucci, Jason Smalley, and Joe Wisnewski Others: Chief Swendrowski, DPW Director Equitz, Administrator Suhm, Clerk Alexander, Attorney Geary President Johnson took the Consent agenda out of order at this time. Closed session Motion by President Johnson, second by Trustee Smalley, to adjourn to closed session pursuant to Wis. Stats. 19.85 Wis. Stats. 19.85(1)(e) deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting of other specified public business, whenever competitive or bargaining reasons require a closed session and 19.85(1)(g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved (2954 Main Street). Consider approval of Special Event permit for ET Area Chamber of Commerce for Pumpkin Pop-Up Event, Thursday, Oct. 26 – Tuesday, Oct. 31, Village Square, pumpkin display. Waiver requested for 45-day submittal fee and contingent upon receipt of fees. (Square bathrooms will not be available) 8. Consider approval of Special Event permit for American Legion Post 188 for Veteran’s Day Ceremony at Village Square Park, Nov. 11, 2023, from 10:30 am to 11:30 am in conjunction with the Village of East Troy dedication of Memorial Honor Stones at Veteran’s Memorial Wall. Request all fees be waived. (Square bathrooms will not be available) 9. Consider approval of Special Event permit for ET Area Chamber of Commerce for Autumnal Soiree Wine Walk, Village Square and surrounding venues, Saturday, Oct. 21, 4 – 7 pm. Waiver requested for 45-day submittal fee and contingent upon receipt of fees. (Square bathrooms will not be available) Motion by Trustee Smalley, second by Trustee Alexander, to approve the consent agenda. Motion carried. Miscellaneous Business 1. Consider Excel Engineering’s findings/proposal for municipal building Dean Schultz, Excel Engineering, presented findings on their study of the building and HVAC System and their proposal and estimate. Discussion included that any security cameras would integrate with the system approved to be upgraded, finishing walls in the rec room to reach the ceiling deck, any reused ductwork would be cleaned, additional lobby lighting, planning for a kiosk in the lobby for residents to use for transactions, funding, supply chain concerns and timeline for the project. Motion by President Johnson, second by Trustee Nugent, to approve moving forward with the project and have staff work with Excel Engineering to prepare bid documents. Motion carried. 2. East Troy – Mukwonago Multi-Use Path a. Consideration of recommendation to approve Strand Associates task order for TAP grant application related to the East Troy – Mukwonago multi-use path Motion by Trustee Alexander, second by Trustee Smalley, to approve Strand Associate’s task order with the Village portion of $2,700 to be paid with future capital project fund balance. Motion carried. b. Consideration of updated MOU with Town of East Troy and Village of Mukwonago Motion by Trustee Smalley, second by Trustee Alexander, to approve the MOU subject to minor modifications requested by the other municipalities and any significant modifications will be brought back to the Board. Motion carried. 3. Presentation by Natural Resource Invocations, Andy Nelson – Post-Construction Evaluation of former impoundment. Andy Nelson, Natural Resource Innovations, presented an overview of the former impoundment. He congratulated the Village on the project and praised the outcome for  EAST TROY VILLAGE BOARD MINUTES October 2, 2023 Page 3 of 4 today as well as a multi-generational community asset. DPW Equitz Jason provided a handout at the meeting of a map of punch list of items still to be done in the area. There will continue to be opportunities to develop the area. Discussion included property ownership, land stability as it is drying and shrinking, the root structure has helped firmed up the land, along the stream the ground can be soft, the area is being mowed by property owners and DPW. 4. Consider proposal from Benchmark Landscaping for street trees on South Executive Drive Motion by Trustee Renucci, second by Trustee Smalley, to approve the proposal from Benchmark for $9,924.50 for tree replacement in the industrial park. Motion carried. 5. Consideration of grants for the Highway 120 Multi Use Trail Tim Lynch, Lynch & Associates, reviewed the two successful grant applications for the multi-use trail from Mill Pond to S. Executive Drive. The Village was awarded both grants, one through the DOT and one through the DNR, but cannot accept both and will need to decide which grant is more advantageous to accept. Discussion included the pros and cons of each grant including the cost to the Village, who the grant would assign control of the project to, timeline and different steps for each grant, and when the decision needs to be made. The DOT grant may cost less but has additional steps and longer timeline with more unknown construction/inflation costs as the project would be projected for 2025 or 2026 with the DOT in charge of the project, the DNR grant may have a higher cost but could be implemented sooner and the Village would control the project. The direction to staff was to work on a proposal for the project and bring it back to the Board with budget numbers. Ordinances & Resolutions 1. Resolution 2023-18 – Support Transportation Alternatives Program (TAP) Application for East Troy/Mukwonago Multi-Use Path (application cycle 2024-2028) Motion by Trustee Alexander, second by Trustee Smalley, to approve Resolution 2023- 18. Stats. 19.85(1)(e) deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting of other specified public business, whenever competitive or bargaining reasons require a closed session (TID 5 Development and TID 4 Development Agreements and offer to purchase property).
