Roll Call: President Johnson called the meeting to order at 6:30 p.m. Present: President Johnson, Trustees John Alexander, Jim Holm, Fortune Renucci, Jason Smalley, and Joe Wisnewski Excused: Trustee Nugent Others: Chief Swendrowski, DPW Director Equitz, Administrator Suhm, Clerk Alexander Citizen Participation - None Consent Agenda 1. Approval Minutes – 4/15/2023, Tri-Troy 4/23/24 2. Consider approval of Special Event and Temporary Class B Permits for East Troy Chamber of Commerce for Memorial Day Corn and Brat Roast May 24 – 27 and Brewfest May 26 3. Consider approval of Sidewalk Dining Permit for Sauced, 2886 Main Street 4. Consider approval of Special Event Permit and Temporary Class B License for 11 th Annual Swing into Summer Lady Legends Tournament, May 31 to June 2, 2024, 7:30 am to 10:30 pm. Motion by Trustee Alexander, second by Trustee Smalley, to approve the consent agenda. Motion carried. Miscellaneous Business 1. Presentation of 2023 audit report by Johnson Block & Co., Inc. a. Board Summary b. Draft Financial Report c. Draft Required Audit Communications to the Village Board Kevin Krysinski, Johnson Block & Co., presented the 2023 Audit Report and reported that the Village and Utility financial conditions are in good financial shape. 2. Direction to staff regarding Act 73 Closing Hours for Class B license holders during the RNC, July 15 – 18, 2024 The direction to staff was to acknowledge the Act 73 Closing Hours as they stand and not opt-out. 3. Consideration of recommendation for new planning and zoning administration services Administrator Suhm reviewed the three proposals that were received and reviewed, and the firms were interviewed. The recommendation was to contract with Foth. Expenses for planning will increase for 2024, however their rate was the most favorable and did not vary by planner. She is working with the Village Attorney on reviewing a contract. Motion by Trustee Smalley, second by Trustee Alexander, to approve the contract with Foth for Planning and Zoning Administrative Services upon Village Attorney’s review of the contract. Motion carried. 4. Consideration of recommendations in processing taxing changes for Improvements on Leased Land  EAST TROY VILLAGE BOARD MINUTES May 6, 2024 Page 2 of 3 Clerk Alexander explained the impact of Act 12 on the tax billing for improvements on leased land which will affect the tax billing for the hangars at the airport. She discussed the options available for 2024 and in the future. She is waiting for quotes on the work to create individual parcel descriptions for each hangar should the Board choose to consider that option. The direction to staff was to bring back pricing information for the parcel creation and a plan to put this option in place for 2025 and draft communication with hangar owners regarding what to expect for their 2024 tax bill and in the future. 5. Consideration of Memorandum of Agreement for Weights and Measures Inspection Clerk Alexander explained that this agreement is now required with the State based on the Village population reaching 5,000. The direction to staff was to monitor this billing, and review the services provided once a full billing cycle has been accomplished. Motion by Trustee Alexander, second by Trustee Smalley, to approve the Memorandum of Agreement with the DATCP. Motion carried. 6. Consideration of Approval for Sheboygan Warning Systems to replace warning sirens at Thomas Drive and Frontage Road and replace cabinets at other three sites in the Village. Chief Swendrowski reviewed his memo and will provide a map depicting the coverage areas for the sirens. Motion by Trustee Alexander, second by Trustee Renucci, to approve $55,589.92 for Sheboygan Warning Systems to perform the replacement of the siren at the site of Thomas Drive and Frontage Road and cabinet replacements at the other three sites. Motion carried. 7. Consideration of Contract Amendment for DNR Stewardship grant submission with Lynch Engineering Tim Lynch and DPW Equitz informed the Board that the Village has been selected for both the TAP and DNR grants for this project. The DNR grant amount awarded was the higher amount the DNR recommended to the finance committee due to the assistance of Tim Lynch who reached out to Rep. Robin Vos to address questions or concerns at a state level. The next steps are to go through the design contract review as required by the State, meet with the Parks and Recreation Board and planning of the project with design beginning this year. Motion by Trustee Smalley, second by Trustee Alexander, to approve the amendment for the DNR Stewardship grant for the multi-use trail. Motion carried. 8. Update on Design Firm Selection for Phase 2 of Multi-use Trail. DPW updated the Board that part of the process for the TAP Grant is to select a design firm for the project of the multi-use trail to Honey Creek Road and it is required to follow the Quality Based Selection (QBS) process. There were six firms considered and Kapur and Associates were selected to be sent to the DOT for review and approval. Once the DOT approves the proposal, it will be brought back to the Board for final approval. Ordinances & Resolutions 1. Ord 2024-07- Revision to Subsection 495-46(c) allowing cross access easements for access to lots in highway business and light industrial zoning districts. a. President Johnson closed the public hearing at 7:17 pm. b. Consider recommendation from Plan Commission regarding Ordinance 2024-07 Motion by Trustee Alexander, second by Trustee Smalley, to approve Ordinance 2024-07. Motion carried. 2. Ord 2024-08 – Revision to Section 210-3(A)(1) and 210-5(A)(7) to comply with the Wisconsin State Uniform Dwelling Code Motion by Trustee Smalley, second by Trustee Alexander, to approve Ordinance 2024- 08. Motion carried. Staff Reports 1. Administrator’s Report – Jan-April 2024 – Administrator Suhm was congratulated on her appointment to the Walworth County Housing Strategy Task Force. President Johnson acknowledged and thanked Clerk Alexander for her work for Municipal Clerks Week and all our employees in recognition of Public Service Week. Committee Reports 1. East Troy Area Emergency Services District Minutes – 03/26/2024 – Trustee Smalley stated that the Fire Chief will hold a workshop for the current board on May 11th. Closed session Motion by President Johnson, second by Trustee Alexander, to adjourn to closed session pursuant to Wis. Stats. 19.85(1)(e) deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting of other specified public business, whenever competitive or bargaining reasons require a closed session (Offers to Purchase Property).
