Roll Call: President Johnson called the meeting to order at 6:30 p.m. Present: President Johnson, Trustees Brian Harding, Jim Holm, Dan Moody, Mary Nugent, Scott Seager, and Joe Wisniewski Excused: Others: Chief Swendrowski, Administrator Suhm, WWTP Manager Pluess Citizen Participation Consent Agenda (One motion and second will approve all of the following items. Any item may be pulled from the list and voted on separately.) 1. Approval Minutes – 7/21/25 2. Consider approval of 2025 East Troy Bluegrass Festival, Melissa Sherman, Chairperson, Sept. 13-14, 8 am to 6 pm, Village Square - contingent upon receiving signed indemnification agreement and receipt of fees. 3. Consider approval of lease assignment for Hangar B-4 to Jeff Point. 4. Consider approval of appointment of Fortune Renucci to the Board of Review to fill the vacancy by Lois Clark. (no packet materials) Motion by Trustee Nugent, seconded by Trustee Wisniewski, to approve the consent agenda. Motion carried. Miscellaneous Business 1. Update from Victor and Magnolia Stanford on 2954 Main Street project Victor Stanford updated the Board on the status of renovations at 2954 Main Street, stating the exterior framing is complete, the sheathing should be installed by the end of week and in two to three weeks he anticipates window installation. He will then move to the interior of the home. Trustee Seager expressed concern regarding the amount of time it is taking to see progress on the project. Mr. Stanford explained they have been doing the work themselves, are on a tight budget, and working as quickly as they can. 2. Recommendation from Plan Commission to approve Housing Development Opportunity Analysis Motion by Trustee Nugent, seconded by Trustee Harding, to accept the Housing Development Opportunity Analysis. Motion carried. Ordinances & Resolutions 1. Ordinance 2025-04 – Creating Subsection 458-25 (K) Clark Street Parking Motin by Trustee Seager, seconded by Trustee Wisniewski to approve Ordinance 2025-04. Ordinance 2025-05 – Creating Subsection 189-6 (E) pertaining to the Feeding of Feral, Stray or Wild Animals Chief Swendrowski explained there is a worsening feral cat issue on the north side of the Village. He recently received a message from a resident on St. Peter’s Road regarding issues they are encountering including property damage, cats fighting on their property, and the health condition of the cats. They recently took six kittens that were in poor health to Lakeland Animal Shelter and one or two needed to be euthanized. He spoke with the neighbors that were identified as possibly feeding the feral cats and they stated the cats were their outside pets. It is difficult to discern whether they are their pets or if they continue to remain in the area because they are being fed. Current ordinances do require a pet to remain in the owner’s yard or the owner can be cited, but this can be difficult to monitor. He explained to both neighbors there would be an ordinance proposed to prevent feeding of the cats outdoors. Last year, code enforcement trapped approximately 40 cats in the Sterling Oaks Subdivision and took them to an animal shelter, but that has not alleviated the issue. Chief Swendrowski asked Lakeland Animal Shelter if they could assist, but they do not have the resources to address the issue. He was informed that the best approach is to eliminate food, water, and shelter. He presented two options for the proposed ordinance, with the second option including additional language stating that leaving any type of feed outdoors to attract animals running at large, stray, or wild animals is prohibited. He plans to mail the notice to subdivisions north of Highway 20 once and ordinance is approved. Motion by Trustee Seager, seconded by Trustee Nugent, to create Subsection 189-6(E) as proposed in the second version of the ordinance. Motion carried. 3. Ordinance 2025-06 - Amend Chapter 510 of the Village of East Troy Municipal Code Relating to the 2931 Union Street Planned Development District President Johnson explained notices were not sent to the neighboring properties for the Plan Commission meeting. Per ordinance, those notices are not legally required so they were sent to property owners prior to the Board meeting. Steve Lambrechts and a neighbor confirmed the notices were received. Steve Lambrechts, owner of 2931 Union Street, explained that a church would like to rent the upper floor of the prior school building for youth ministry, as well as the church building for services. He would like to have the ability to have retail and add church use for the fellowship hall. He explained there has always been a kitchen in the lower level with some appliances. He also reviewed the existing businesses in the lower and main level of the prior school building that are personal services by appointment only. He explained none of those businesses operate on Sundays when the church holds services. Dan Szpot, 2930 Union Street, stated he lives across the street and welcomes the church and their congregation. He said the angled parking was needed. He expressed concern that the vehicles will be pushed out into the road when it snows. He said the road is typically plowed 18- 24 inches from the curb and losing that space in the road due to snow will present issues. He supports the kitchen being used by the church, but expressed uncertainty about commercial use and inquired whether it could be used by a restaurant.  EAST TROY VILLAGE BOARD MINUTES August 18, 2025 Page 3 of 4 Mr. Lambrechts acknowledged it would not be used by a restaurant but questioned whether it could be utilized by something like a bakery. Administrator Suhm stated current approvals would not allow for a restaurant use. A bakery falls under indoor sales and service, but she felt based on the commercial kitchen and retail use approvals, it could qualify as an allowed use. That use would need to be confirmed with the planner/zoning administrator. Mr. Lambrechts was reminded that prior to the use of that area, a non-residential occupancy permit would need to be applied for with the building inspector. The building inspector will inspect the area to ensure adequate equipment is in place for the proposed use. Motion by Trustee Nugent, seconded by Trustee Seager to approve Ordinance 2025-06 to amend chapter 510 of the Village of East Troy Municipal Code relating to the 2931 Union Street Planned Development District. Motion carried. Motion by Trustee Seager, seconded by President Johnson, to authorize President Johnson to sign the notice for the Marcus property repurchase. Motion carried.
