The single-family residence was built in 1942 with one (1) bedroom and one (1) bathroom. DISCUSSION The proposed addition of 1,344 square feet to the existing single-family dwelling will allow for enhanced livability of the property. If approved, the dwelling will be a total of 2,242 square feet. Pursuant to the EMMC, dwellings within the R-2 zone shall provide a minimum of 1,000 square feet of floor area. The approval of the requested Minor Variance will allow for the dwelling to expand and conform to the minimum dwelling size requirement. The subject site is a substandard lot as it is only 40 feet wide. Per Section 16.26.020 of the EMMC, the minimum lot frontage for a standard lot is 60 feet. Therefore, the substandard lot width is found to deprive the property owner of expanding their dwelling in the same manner as other properties within the same zoning designation. Per Section 17.24-2 of the EMMC, a property within the R-2 zone that is developed with one-dwelling is subject to the R-1A (One- family Dwelling) standards. As such, the minimum first-floor side setback requirement for the property is five (5) feet. The proposed first-floor setback along the south elevation (side setback) is five (5) feet. Further, per Section 17.20-2, the side second-floor setback is required to be an additional five (5) feet from the first-floor wall line. The proposed second-floor along the south elevation is an additional five (5) feet from the first-floor wall line, therefore it is conforming to the EMMC requirements. A Minor Variance is requested to allow the reduction of the second-story setback (from five (5) feet to zero (0) feet) from the first-floor wall line along the proposed second-story addition’s north elevation. The proposed addition (including the second-floor) is setback 12 feet along the north elevation, which is greater than the existing dwelling’s setback of nine (9) feet and ten (10) inches and the minimum five (5) foot side setback requirement. Therefore, the proposed addition and second-floor along the north elevation will appear to be setback from the existing dwelling’s first-floor which reduces the massing of the overall structure. The project also proposes a 425 square foot detached two-car garage. There is not an existing garage, therefore, the proposed garage will bring the site into conformance with the minimum single-family residential parking requirements. In addition, a 775 square foot ADU is proposed to be attached to the rear of the garage (east elevation). It should be noted that an exemption is being pursued pursuant to Section 17.110.030(V)(1) of the EMMC to allow the proposed ADU in compliance with State requirements. ADU law requires that no lot coverage, floor area ratio, open space, or minimum lot size shall preclude the construction of a statewide exemption ADU. PROJECT ANALYSIS Development Standards Per Section 17.24-2 of the EMMC, a property within the R-2 zone developed with one-dwelling is subject to the R-1A standards. The following table provides the development standards for the R-1A zone and determines whether the proposed project complies with each standard. 4530 Huddart Avenue Minor Variance No. 09-22 Table 1. Section 17.125.040 (EMMC) - Necessary conditions outlines the five (5) required findings and conditions to be met in order to approve any Minor Variance: FINDING: A. The Minor Variance will not be detrimental to the public health, safety or welfare or injurious to the subject property or other improvements in the vicinity; 4530 Huddart Avenue Minor Variance No. 09-22 FACT: Granting the request for a Minor Variance to deviate from the required second-story setback (from five (5) feet to zero (0) feet) along the northern elevation of the dwelling will not be detrimental to the public health, safety, or welfare. The proposed project is conditioned to meet all Building and Safety requirements, which would ensure that the proposed is not detrimental to public health and safety. Furthermore, the proposed addition (including the second-floor) will be setback twelve (12) feet from the northern property line which is greater than the existing dwelling’s setback of 9’-10” and the minimum five (5) foot ground-floor side setback requirement. Therefore, the proposed addition and second-floor will appear to be setback from the existing dwelling’s first- floor which reduces the massing of the overall structure and helps to alleviate issues with privacy to the adjacent property. FINDING: B. The Minor Variance will not authorize a use or activity that is not otherwise expressly authorized in the subject property’s zoning classification; FACT: Granting the Minor Variance will not adversely allow a use that is not expressly authorized. The zoning classification is R-2 (Low-Density/Multiple-Family Residential) zone. A property that is developed with a single-family residential dwelling within the R-2 zone is subject to R-1A (Single-Family Residential) development standards which allows for single family residential dwellings. In addition, the request for additional square footage to the existing dwelling will bring the dwelling into conformance with the minimum dwelling size requirement of 1,000 square feet. FINDING: C. There are exceptional or extraordinary circumstances applicable to the property involved (e.g. location, shape, size, surroundings and topography), so that the strict application of this Title denies the property owner privileges enjoyed by others in the vicinity and under identical zoning classifications; FACT: The subject site is a substandard lot as it is only 40 feet wide. Per Section 16.26.020 of the EMMC, the minimum lot frontage for a standard lot is 60 feet. Therefore, the substandard lot width is found to deprive the property owner of expanding their dwelling in the same manner as other properties within the same zoning designation. A Minor Variance is requested to allow the reduction of the second-story setback (from five (5) feet to zero (0) feet) from the first-floor wall line along the proposed second- story addition’s north elevation. The proposed addition (including the second-floor) is setback 12 feet along the north elevation, which is greater than the existing dwelling’s setback of nine (9) feet and ten (10) inches and the minimum five (5) foot side setback requirement. Therefore, the proposed addition and second-floor along the north elevation will appear to be setback from the existing dwelling’s first-floor which reduces the massing of the overall structure and helps to alleviate issues with privacy to the adjacent property. FINDING: D. The Minor Variance will not provide special privileges for the property involved, which are inconsistent with other properties in the vicinity and within the same zoning classification; FACT: The approval of such Minor Variance to reduce the second-floor side setback requirement from five (5) feet to zero (0) feet will not provide special privileges for the property involved. The subject site is a substandard 40 foot wide lot and is believed to deprive the property owner of expanding their dwelling while meeting the setback requirements. Allowing the deviation of the side setback requirement will allow the property owner to expand the existing 898 square foot dwelling; thus, enhancing the livability of the property while maintaining the single-family characteristic. In addition, the approval of the requested Minor Variance will allow for the dwelling to conform to the minimum dwelling size and minimum single-family residential parking requirements. FINDING: E. The Minor Variance will not adversely affect the purpose, goals and policies of the General Plan, the Zoning Code and any applicable Specific Plan. FACT: The approval of the request to deviate from the minimum side setback requirement will not adversely affect the Comprehensive General Plan. Policy LU-1.1-Code Compliance ensures land compatibility through adherence to the policies, standards, and regulations in the Municipal Code; Policy LU-1.6-Quality of Life, encourages protecting the quality of life of residents. Allowing the reduction in the minimum side setback requirement will enhance the livability of the property while maintaining the single-family characteristic of surrounding properties while preserving the integrity of the neighborhood. 4530 Huddart Avenue Minor Variance No. 09-22 CONDITIONS OF APPROVAL: Staff recommends that the Zoning Review Committee hereby approve Minor Variance No. 09- 22 for the Project in accordance with the California Environmental Quality Act (CEQA) of 1970 and the CEQA Guidelines, as amended, subject to the following conditions: General 1. The project shall substantially conform to the site plan, floor plan and elevation plans on file with the City’s Planning Division and as presented to the Zoning Review Committee on February 14, 2023, and as amended herein. 2. Project shall comply with all City Department/Divisions regulations, guidelines, and conditions of approval including Building, Engineering, Planning, and the Los Angeles County Fire Department. 3. The approval of Minor Variance No. 09-22 is valid for one (1) year from the date of approval. During this time period, the applicant is responsible for obtaining the required City permit(s) for the proposed project. 4. A copy of the final decision letter with the conditions of approval shall be submitted with the building plans. Building and Safety 5. Project shall comply with the 2022 California Building Standards with 2023 Los Angeles County Amendments and the El Monte Municipal Code. Public Works Engineering 6. The estimated amount of Development Impact Fees associated with the project based upon the site plan documentation submitted as part of the Project Approvals include but are not limited to the following fees and deposits; applicable sewer fee, street fee, storm drain fee, traffic fee, park facility Impact fee, Quimby (dedication or in lieu Parkland Fees), deposits, technology enhancement fees, and all applicable fees associated with demolition of existing structures, drainage, site development, and construction are based on actual square footage of any commercial development and number of residential units. EMMC 15.08 and EMMC 16.34.030 Sewer $ - Storm Drain $ - Street $ 703.37 Traffic $ 58.60 Park Facility Impact Fees $ 5,205.79 Tech Enhancement $ 124.67 Quimby $ - Total $ 6,092.43 4530 Huddart Avenue Minor Variance No. 09-22 The foregoing amounts of the various development impact fees are subject to refinement and changes based on the design plans for the project as approved by the City and/or changes in the City development impact fees. Development impact fees are due prior to the issuance of Building Permits. 7. An encroachment permit will be required for all work within the public right-of-way. 8. Project Applicant shall obtain approval from the Los Angeles Fire Department (LACFD) for development’s fire protection, fire flow requirements, emergency access circulation for development, etc. and shall construct all Fire Department required improvements. LACFD approval will be required: i. Prior to Grading/Building Permits (LACFD Building Division). 9. The Project Applicant shall provide such additional data and information and shall deposit and pay such fees as may be required for the preparation and processing of environmental review documents pursuant to the City’s procedures for implementation of the California Environmental Quality Act. 10. Engineering Geology and/or Seismic Safety Report. A preliminary engineering geology and/or seismic safety report, prepared in accordance with Los Angeles County guidelines, is required if the property lies within a “medium risk” or “high risk” geologic hazard area, as shown on maps on file contained within the safety element of Los Angeles County. 11. Comply with the City’s ordinances and regulations pertaining to construction debris recycling. Contact the Building & Safety Department to obtain a Construction & Demolition Debris Diversion Program form. The Construction & Demolition Debris Diversion Program is also applicable with respect to the grading process. 12. The disposal, removal, recycling and diversion of all construction and demolition waste and debris generated by the Project must be performed exclusively by the City’s duly authorized and duly franchised construction and demolition solid waste hauler. The City’s construction and demolition hauler is Valley Vista Services whose contact information is as follows: (626) 961-6291 or info@valleyvistaservices.com. 13. All USA/Dig Alert graffiti markings must be removed by the contractor from the sidewalk, curb & gutter and/or asphalt pavement prior to final approval. 14. No encroachment into the City right-of-way from private property will be allowed. 15. The City Engineer may require other information or may impose additional conditions and requirements as deemed necessary to protect health and safety, and to benefit the public. 16. The Grading and Drainage Plan must include standard City of El Monte NPDES and Grading and Drainage Notes and be prepared in accordance with the City of El Monte Grading Manual. 17. A Hydrology Study Report, based on a 50-year frequency design storm for Capitol Facilities and a 25-year frequency design storm for all other instances as dictated by the LA County 4530 Huddart Avenue Minor Variance No. 09-22 DPW 2006 Hydrology Manual, must be submitted to the Engineering Division. The study must provide hydraulic calculations based on the given area and the ability of the proposed/existing storm drain infrastructure to receive and support the allotted drainage runoff. Drainage calculations shall adhere to City of El Monte standards, NPDES, and environmental regulations and requirements. 18. Historical drainage patterns from adjacent lands to the property shall be identified and maintained. The Project shall accept and include in the drainage design any current drainage from adjacent land. 19. Comply with all Federal, State, and local agency requirements pertaining to the Clean Water Act, which established regulations, set forth in the Countywide National Pollutant Discharge Elimination System (NPDES) Permit. 20. Low Impact Development (LID) is a requirement of the NPDES Permit No. CAS004001, Order No. ORDER NO. R4-2012-0175 and City of El Monte Ordinance No. 2840 This permit was issued by the State of California Regional Water Quality Control Board, Los Angeles Region on December 28, 2012 and the City Ordinance was passed and adopted June 10, 2014. The LID is a narrative report that explains the type of development and drainage of the site. It must address the post-construction water quality and habitat impact issues. Once the site has been developed, how will runoff be maintained? Was there a system that was designed to treat the runoff prior to discharging into the public system? Best Management Practices (BMPs) should be implemented to address storm water pollution and peak flow discharge impacts. All BMPs must be sized to meet specified water quality design and/or peak flow discharge criteria. i. Filtration and infiltration methods must be used to defray a large percentage of the storm water runoff into the storm drain system, or ii. Comply with requirements for Non-Designated Project (See County of Los Angeles Public Works Department Low Impact Development Standards Manual – February 2014). 21. Project Applicant / Civil Engineer shall show the location of the sewer mainline, nearest manholes, lateral serving the project and configuration of the onsite sewer including diameter and material of the onsite sewer. i. Sewer cleanouts must be positioned at 100-foot intervals on the lateral coming off the main sewer line and at property line. ii. Project Applicant must obtain Will Serve Letter from County Sanitations District of Los Angeles County in customary form prior to issuance of a grading permit for the Project. 22. It is the Project Applicants’ responsibility to contact the Water Purveyor (San Gabriel Valley Water Company) to obtain approval of service and that the purveyor has adequate water to provide such service. A Will Serve letter from San Gabriel Valley Water Company will be required. 23. Provide acceptable analysis to verify sufficient water pressure and flow for: i. General conditions ii. During the MID (maximum instantaneous demand) conditions 4530 Huddart Avenue Minor Variance No. 09-22 iii. During fire flow and MID conditions. 23. The water supply system serving the development shall be adequately sized to accommodate the total required domestic water and fire flows, in compliance with the San Gabriel Valley Water Company and Los Angeles County Fire Department requirements. i. Project Applicant / Civil Engineer shall submit water system improvement plans and calculations for the development to the City for review and approval; or ii. Project Applicant / Civil Engineer shall submit copy of all water system improvement plans and calculations required and approved by San Gabriel Valley Water Company for coordination and verification. 24. All existing water services no longer as part of the Project shall be abandoned at the mainline. 25. Relocate existing water meter out of existing drive approaches. 26. Project Applicant shall underground any existing overhead utilities that are to serve the property in accordance with EMMC Chapter 16.28.110. The final scope and design of the undergrounding of these overhead facilities is subject to SCE and other relevant utility provider approval. 27. Any utility poles conflicting with the proposed improvements shall be relocated at the expense of the Project Applicant. 28. All parking lots and driveways shall be surfaced with asphaltic concrete to a minimum thickness of three (3) inches over a minimum aggregate base of six (6) inches or surfaced with Portland Cement concrete with a minimum thickness of five (5) inches over a three (3) inch aggregate base. After review of the probable vehicular traffic and the soils report for the project, additional material may be required at the discretion of the City Engineer (EMMC 17.08.030) and/or in accordance with recommendations of the Geotechnical Engineer. 29. All drive approaches shall be ADA compliant. Insufficient width in the parkway will require Project Applicant to dedicate an easement at each drive approach to the City to accommodate a compliant drive approach. 30. All Streets fronting property shall be improved to meet current General Plan requirements for Right of Way and Roadway. Use Geotechnical Engineer’s Report and APWA standard plans and specifications for roadway improvements.
