ELIZABETHTOWN TOWN COUNCIL AGENDA SPECIAL CALLED MEETING May 16, 2022 at 12 o’clock Noon Council Room • OPENING AND CALL TO ORDER • INVOCATION Agenda Item No. 1 – PUBLIC HEARING – Zoning Text Amendment and Zoning Map Amendment The Planning Board forwards to Town Council their recommendation for Town Council to consider a text amendment to the Zoning Ordinance to amend Article 6. Zoning Districts: Table 6.6 for allowable uses as well as a map amendment as outlined in Memo from Planning Board Chairperson Bobby Kinlaw (ATTACH. #1). Council is requested to follow the Public Hearing procedure outlined below: HEARING PROCEDURE: a) Open the hearing and call upon Planning Director Rusty Worley to present the information; and b) Solicit relevant public comments and information; and c) Close the hearing after receiving or not any public comments. (To be considered in Agenda Item #4) Copy of Public Hearing notice provided (ATTACH. #1-A). Agenda Item No. 2 – PUBLIC HEARING – Amendment to Code of Ordinances – Stormwater Protection Planning Director Rusty Worley is requesting an amendment to the Code of Ordinances as it relates to Stormwater Protection – Chapter 53, Section 1. Council is requested to follow the Public Hearing procedure outlined below: HEARING PROCEDURE: d) Open the hearing and call upon Planning Director Rusty Worley to present the information; and e) Solicit relevant public comments and information; and f) Close the hearing after receiving or not any public comments. (To be considered in Agenda Item #5) Attached for ready reference are copies of the Public Hearing Notice and Code of Ordinances Amendment for Chapter 53., Section 1 (ATTACH. #2). Agenda Item No. 3 – Resolution of Support – TOE Stormwater Plan Review – Commitment to Implementation The attached resolution (ATTACH. #3) is in support of a grant application that is being prepared for a Stormwater Plan Review. The stormwater transmission line on King Street and the residential area, Glenwood Drive, are two areas that are being identified for improvements if funding is received. Assistant Town Manager Pat DeVane may be called upon to present. REQUEST: Council is requested to approve the Resolution. Agenda Item No. 4 – Ordinance Approval for Text Amendment and Zoning Map Amendment – CDB Boundary Changes With the public hearing having been conducted, Council is requested to approve or disapprove the proposed text amendment and map amendment. Prior to adopting or rejecting any zoning text or map amendment, the Town Council shall adopt one of the following statements which shall not be subject to judicial review. • A statement approving the zoning amendment and describing its consistency with an adopted comprehensive plan and explaining why the action taken is reasonable and in the public interest. • A statement rejecting the zoning amendment and describing its inconsistency with an adopted comprehensive plan and explaining why the action taken is reasonable and in the public interest. • A statement approving the zoning amendment and containing at least all of the following: -A declaration that the approval is also deemed an amendment to the comprehensive plan. The Town Council shall not require any additional request or application for amendment to the comprehensive plan. -An explanation of the change in conditions the Town Council took into account in amending the Ordinance to meet the development needs of the community. -Why the action was reasonable and in the public interest. Agenda Item No. 5 – Ordinance Approval for Code of Ordinances Amendment for Stormwater Protection With the Public Hearing having been conducted, Council is to consider adopting Ordinance No. 2022-06 – Chapter 53. Stormwater Protection, Section 1 (ATTACH. #5). REQUEST: Council is requested to adopt the Ordinance. Adjournment – Mayor Campbell shall entertain a motion and a second to adjourn.
