I. CALL TO ORDER
Jeff Dalling, Chairman of the City of Elko Planning Commission, called the meeting to order at
5:30 p.m.

VI. NEW BUSINESS
A. PUBLIC HEARING
1. Review, consideration, and possible action on Conditional Use Permit No. 4-22,
filed by Kado Properties LLC., which would allow for the development of an
apartment complex within the C- General Commercial zoning district, and
matters related thereto. FOR POSSIBLE ACTION
Multi-family residential units within the C- General Commercial zoning district
require approval of a conditional use permit.
Tom Hannum, Summit Engineering, 1150 Lamoille Hwy, was available to answer questions.
Cathy Laughlin, City Planner, went over the City of Elko Staff Report dated June 23, 2022. Staff
recommended conditional approval with the findings and conditions listed in the Staff Report.
Commissioner Garret Kamps pointed out that he saw one dumpster with a surround. He asked if
that was all that was required. He added that the dumpster was at an extreme end, where most of
the apartment units are going to be far from it. The Family Dollar and Aarons both have dumpsters
behind their buildings. He asked if it was going to become an issue if people started using the
business' dumpsters.
Ms. Laughlin explained that right now the code doesn't require a certain number of dumpsters per
units. There is just a requirment for a secured trash enclosure. She said that was a question that the
applicant could probably address.
Chairman Jeff Dalling said the good news was that this was a Conditional Use Permit, so they
could add a condition if they felt it was necessary. He added that no one was going to walk from
the front building all the way over to the dumpster.
Ms. Laughlin thought they could easily put another one on the site, and she pointed out a few
different locations.
Commissioner Kamps asked if they had exactly enough parking for the buildings.
Ms. Laughlin explained that they were three over, but with Ms. Rambo's condition for two turn
arounds some parking would be lost and then they would be exact.
There was further discussion regarding parking, relocating the dumpster, and adding an additional
dumpster.
Michele Rambo, Development Manager, stated that Ms. Laughlin mentioned one of her conditions,
but she had an additional condition. There was concern with the delivery trucks to the stores

interfering with the people parking along the access. She added a condition to work with stores to
come up with a solution for that. The Development Department had no other comments or
conditions.
Commissioner Lemich asked if there was street parking on the access behind the stores.
Mr. Hannum explained that there were three stalls provided behind the stores.
Ms. Laughlin explained the parking behind the stores and showed them on the GIS Map.
There was further discussion regarding parking behind the stores and parking for the delivery
trucks.
Jamie Winrod, Fire Marshal had no comments or concerns.
Mr. Wilkinson had no comments or concerns.
Chairman Dalling asked if everyone felt good on the parking. He asked Ms. Rambo what her
condition was regarding the parking for the delivery trucks.
Ms. Rambo said it was to work with commercial neighbors to ensure that parked delivery trucks do
not block the apartment parking spaces along the shared driveway.
Chairman Dalling thought they would figure it out.
Mr. Hannum said with a shared driveway there would be a lot of discussion between the owners.
Commissioner Kamps asked if there was a known issue with the trucks pulling through there at this
point.
Ms. Rambo said she had pictures from other issues that she had been working on through Code
Enforcement of trucks parking on the far side of the shared access and unloading.
Chairman Dalling pointed out that there was nothing there right now.
Ms. Rambo said they should be able to adjust once the building starts.
Commissioner Kamps asked if signage would be recommended.
Mr. Wilkinson said the Planning Commission could place that as a condition on the apartments.
They would be required to maintain the signage. It is not a public street, so the City wouldn't be
involved.
Mr. Hannum stated that there wasn't room for signage along the frontage.
Chairman Dalling thought they would figure it out as soon as there were apartments there.

Mr. Hannum thought communicating with the owners would take care of it.
Ms. Laughlin said one thing that was not addressed, but was shown on the map, was there is a large
storm water easement that they would be vacating and relocating.
There was further discussion regarding the location and details of the storm drain.
Commissioner Michael Irish asked if the applicant had any plans for any community spaces, such
as a park or playground for kids.
Mr. Hannum said the project was next to Angel Park. There is no trail or sidewalk, but it has easy
access to the park. They would be providing a landscaped area with grass.
Commissioner Lemich said they hadn't talked about the screenwall.
Chairman Dalling asked how tall the screenwall would have to be if they were required to do it.
Ms. Laughlin explained that the code requires a screen wall to be 6 feet, with no visibility through
it.
Chairman Dalling said it could be a chain link fence with slats.
There was further discussion regarding property lines and fences on neighbors properties. It was
decided not to require a screenwall.
***Motion: Approve conditionally approves Conditional Use Permit No. 4-22 subject to the
conditions in the City of Elko Staff Report dated June 23, 2022, listed as follows:
1. That Conditional Use Permit No. 4-22 shall be personal to the permittee and applicable
only to the submitted application conforming to the exhibits as presented.
2. The Conditional Use Permit will expire within one (1) year of the date of approval if the
Applicant is not actively engaged in developing the property.
3. The complex shall comply with the development standards as outlined in City Code Section
3-2-5(E)6.
4. That the development shall comply with City Code Section 3-2-17.
5. Exterior lighting for the complex shall be shielded and cutoff with minimal lighting spilling
over into the neighboring properties. An illumination schedule is required to ensure lighting
is adequate for safety with minimal impact to adjacent properties.
6. There shall not be any placement of any mail gang boxes, kiosks or signage in association
with this complex placed in the city’s right of way and shall remain internal to the complex.
7. The common area to be landscaped with a combination of trees and shrubs and shall be
maintained by the property owner. A Landscaping Plan showing locations and quantities of
all landscape materials will be submitted and approved during building permit submittal.
8. The property and the buildings to be maintained in an acceptable condition at all times.

Development Department:
1. Add turnaround areas at the end of both parking lots per Elko City Code Section 3-2-
17(G)(4).
2. Work with the commercial neighbors to ensure that parked delivery trucks do not block
the apartment parking spaces along the shared driveway.
Commissioner Mendive’s findings to support the recommendation were the proposed
development is in conformance with the Land Use Component of the Master Plan. The
proposed development is in conformance with the existing transportation infrastructure and
the Transportation Component of the Master Plan. The site is suitable for the proposed use.
The proposed development is in conformance with the City Wellhead Protection Program.
The proposed use is in conformance with City Code 3-2-10 (B) General Commercial with the
approval of the Conditional Use Permit. The proposed development is in conformance with 3-
2-3, 3-2-4, 3-2-17, 3-8 and 3-2-18 of the Elko City Code. Due to the extreme difference in
topography, the screen wall requirement stated in 3-2-3(J) is not necessary between this
parcel and the residential parcel on Dotta D

B. MISCELLANEOUS ITEMS, PETITIONS, AND COMMUNICATIONS
1. Special election of Secretary for the remainder of 2022, and matters related
thereto. FOR POSSIBLE ACTION
Pursuant to Section 3-4-1 (E) of the City Code, vacancies occurring otherwise
than through the expiration of term shall be filled for the unexpired term. The
planning commission appointed Mr. Gratton Miller Secretary of the Planning
Commission and has recently received his letter of resignation on June 8, 2022.
*Commissioner Jeff Dalling nominated Mercedes Mendive for Secretary; a vote was taken
and passed unanimously.
VII. REPORTS
A. Summary of City Council Actions
Ms. Laughlin reported that at the June 14th City Council meeting they accepted the resignation of
Gratton Miller and approved the Tentative Map for the Colt Drive Townhomes. On June 28th, the
City Council presented a plaque to Gratton Miller; they approved the 3rd amendment to the Ygoa
Revocable Permit, and accepted a petition to vacate a portion of Main St. They also adopted a
Resolution to vacate a portion of Carlin Ct.

Ms. Laughlin reported that there was an RDA Meeting to take action regarding the art pedestal
project in the downtown. The RDA took action not to do the pedestals because of the cost of
construction. They would rather do the next project, which are the sidewalks on Railroad and
Commercail in the 400 Block and Commercial in the 500 Block. They left it open ended to bring it
back if construction prices come down, or if we get some good submissions for artwork.

Ms. Laughlin there was an Ethics Train held last week. No one from the Planning Commission
attended. Ms. Laughlin said she would send out the video. It is really important to follow the ethics
law. In the packet, a Planning Conference flyer was included. The tentative schedule of classes is
out now. Ms. Laughlin said she would send it out. Registration is $50 and the City will pay for the
Commissioners.
