CITY OF ELKO PLANNING COMMISSION REGULAR MEETING MINUTES 5:30 PM, TUESDAY, SEPTEMBER 6, 2022 ELKO CITY HALL, COUNCIL CHAMBERS 1751 COLLEGE AVENUE, ELKO, NV 89801 I. CALL TO ORDER II. ROLL CALL Present: Jeff Dalling Stefan Beck Mercedes Mendive Garret Kamps Michael Irish Tony Odeh Absent: John Lemich City Staff Present: Scott Wilkinson, Assistant City Manager Cathy Laughlin, City Planner Michele Rambo, Development Manager Bob Thibault, Civil Engineer Jamie Winrod, Fire Marshal Shelby Knopp, Administrative Assistant III. PLEDGE OF ALLEGIANCE IV. COMMENTS BY THE GENERAL PUBLIC There were no public comments made at this time. V. APPROVAL OF MINUTES A. August 2, 2022 - Regular Meeting - FOR POSSIBLE ACTION ***Motion: Approve the minutes from the August 2, 2022 regular meeting as presented. Moved by Stefan Beck, Seconded by Garret Kamps * Motion passed unanimously. (6-0) VI. NEW BUSINESS September 6, 2022 City of Elko Planning Commission Meeting Minutes Page 1 of 4 A. MISCELLANEOUS ITEMS, PETITIONS, AND COMMUNICATIONS 1. Review, consideration and possible granting of Parking Waiver 1-22, filed by DKH Investments to waive two required off-street parking spaces in connection with a proposed professional office within the C (General Commercial) Zoning District, and matters related thereto. FOR POSSIBLE ACTION The property has lost legal nonconforming status and therefore needs to be brought into conformance with current codes. Commissioner Michael Irish announced that he would need to recuse himself, as his firm was contracted as the Design Professional for the project. Cathy Laughlin, City Planner, went over the City of Elko Staff Report dated August 24, 2022. Staff recommended granting the Parking Waiver with the conditions and findings listed in the Staff Report. Michele Rambo, Development Manager, had no comments or concerns. Bob Thibault, Civil Engineer, recommended approval as presented by staff. Jamie Winrod, Fire Marshal, had no comments or concerns. Scott Wilkinson, Assistant City Manager, had no comments or concerns. Commissioner Garret Kamps, asked if there was any presedent for this, and if it had been done before. Ms. Laughlin explained that parking waivers had been done before, mostly in the Central Business District. The majority of the time it has to do with ADA parking, because the access isle takes away a parking stall. We did it for a Hair Salon down the street. On new development, we wouldn't consider a Parking Waiver, but on something that is already existing, then we do support it. ***Motion: Grant Parking Waiver No. 1-22 with the conditions in the City of Elko Staff Report dated August 24, 2022, listed as follows: 1. The parking waiver is based on the future occupancy of the building being a professional office requiring one off-street parking stall per 300 sq. ft. or any other commercial occupancy in which less than four off street parking stalls are required. 2. Completion of the parking stalls and accessible route to the business be completed prior to any business license being issued. 3. Parking waiver to be recorded with the Elko County Recorder within thirty days after letter of completion or certificate of occupancy has been issued by the City of Elko Building Department for the permitted work. Any outstanding issues with the City of Elko Building Department concerning unpermitted work to be resolved prior to recordation of the waiver. Commissioner Mendive’s findings to support the recommendation was the proposed use is in conformance with the Land Use Component of the Master Plan. The proposed use is compatible with the Transportation Component of the Master Plan and is consistent with the existing transportation infrastructure. The property is located in the Redevelopment Area and meets several goals and objectives of the Redevelopment Plan. The proposed use is in conformance with the Wellhead Protection Plan. The proposed use is in conformance with Section 3-2-10 of City Code. The proposed ADA parking stall and access aisle takes away the possibility for additional standard parking stalls resulting in an off-street parking deficit. Moved by Mercedes Mendive, Seconded by Garret Kamps * Motion passed unanimously. (5-0) VII. REPORTS A. Summary of City Council Actions Ms. Laughlin reported that at the August 8th City Council meeting they reappointed Stefan Beck and Michael Irish to the Planning Commission. They approved conditional acceptance of the Zephyr Heights Subdivision Phase 1. At the August 23rd meeting the City Council adopted Resolution 24-22 for the vacation of a portion of W. Main St. They also sold 5.88 acres of City owned property at a public auction. They conducted the 1st reading of Ord. 874 for the rezone of Bergeron Village Subdivision. B. Summary of Redevelopment Agency Actions Ms. Laughlin reported that there was an RDA meeting and they took action on a few items. They authorized Catherine Wines to work with staff on grant opportunities for the art pedestals downtown. They also authorized staff to start working on another grant program for the downtown for businesses to be able to apply for up to $15,000 to help with ADA upgrades, restroom upgrades, fire spinklers, ect. C. Professional articles, publications, etc. 1. Zoning Bulletin a Zoning Bulletin - INFORMATION ONLY - NON-ACTION ITEM D. Miscellaneous Elko County E. Training Ms. Laughlin reported that the Rural Planning Conference was a success. September 6, 2022 City of Elko Planning Commission Meeting Minutes Page 3 of 4 Commissioner Stefan Beck said he had never gone to one of those conferences before. He loved it and thought it was fun and informative. VIII. COMMENTS BY THE GENERAL PUBLIC There were no public comments made at this time.
