CITY OF ELKO PLANNING COMMISSION REGULAR MEETING MINUTES 5:30 PM, TUESDAY, JANUARY 3, 2023 ELKO CITY HALL, COUNCIL CHAMBERS 1751 COLLEGE AVENUE, ELKO, NV 89801 I. CALL TO ORDER Jeff Dalling, Chairman of the City of Elko Planning Commission, called the meeting to order at 5:30 p.m. II. PLEDGE OF ALLEGIANCE IV. COMMENTS BY THE GENERAL PUBLIC Leslie Creel, 602 Ellens Way, gave a brief summary on the Lamoille Summit Trail System, which is a 50 mile, stacked loop, multi-use, non-motorized trail system between Jiggs Highway, South Fork Reservoir and Lamoille Highway. She would like to see a portion of trail along the Errecart Boulevard connection. V. APPROVAL OF MINUTES A. December 6, 2022 - Regular Meeting - FOR POSSIBLE ACTION January 3, 2023 City of Elko Planning Commission Meeting Minutes Page 1 of 15 ***Motion: Approve the minutes as they stand. Moved by Michael Irish, Seconded by Tony Odeh * Motion passed unanimously. (6-0) VI. NEW BUSINESS A. PUBLIC HEARING 1. Review, consideration, and possible action on Conditional Use Permit No. 8-22, filed by Ash St Village, LLC., which would allow for the development of townhomes within the RB - Residential Business zoning district, and matters related thereto. FOR POSSIBLE ACTION Multi-family residential units within the RB- Residential Business zoning district require approval of a conditional use permit. Commissioner Michael Irish recused himself from this item, stating this project has been in his office. Ann Steninger, 1091 5th Street, asked a number of questions, to which applicant, Luke Fitzgerald, 2446 Crestview Drive, provided answers: Will these townhomes be owned personally? Yes. Are they tiny homes? No. Are they connected? There are four pods of three, twelve total. Will property taxes go up? I'm not sure how that works, but it will clean up the area. How is it going to be maintained? There will be an HOA to maintain the landscaping and common area and each individual will be responsible for their house. Brenda Turpen, 1092 5th Street, expressed concern over parking. She stated people won't use their garage to park, but rather park on the street. Mr. Fitzgerald responded that there will be oversized, two-car garages with two parking spots in front of each one, in the driveways. People can't park on the street because they'd be blocking somebody's driveway. There will be four additional guest parking spaces, for a total of 52. Ms. Turpen said the last time she spoke with Mr. Fitzgerald, there were only going to be 10 townhomes. Mr. Fitzgerald clarified that originally there were going to be 10, but the parking wasn't working, so they went with 12 townhomes that were lifted, with garages under each one. Ms. Turpen asked if there would be parking on the alley side too. Mr. Fitzgerald answered that there would be a 13-foot strip for parking as well as the two-car garages on that side. Cathy Laughlin, City Planner, state there had been multiple homes on the property that were demolished several years ago. She went over the City of Elko Staff Report dated December 15, January 3, 2023 City of Elko Planning Commission Meeting Minutes Page 2 of 15 2022, which included reference to City Code 3-2-17 for a single family residence parking requirement of two off-street parking spaces per unit, which would be the two spaces inside the garages. There were six findings and 12 conditions, one of which was no recreational vehicle storage on site or in the guest parking stalls. The report recommended conditional approval. She read out Development's conditions, which included that the construction documents show the location of relocated power poles. Michele Rambo, Development Manager, expounded on this condition stating the City would like to see the relocation of the power poles designed through NV Energy before the applicant submits for the building permit so the City knows exactly where the poles will be going in relation to the parking garages in the back and other things in the alley. The building permit won't be approved without that information. Mr. Fitzgerald asked if it was needed prior to the building permit, not construction. Ms. Rambo confirmed, and clarified that construction drawings would be submitted for the building permit. Mr. Fitzgerald asked if he could submit a final map without it. Ms. Rambo confirmed. Bob Thibault, Civil Engineer, had no additional concerns and recommended approval as presented by staff. He stated the City would be happy with the power pole location as long as NV Energy was happy, that the poles don't block garage access, and that a new easement would be provided for them. Mr. Fitzgerald asked if it was preferred that the poles be outside of 5th Street right-of-way. Mr. Thibault confirmed. Jamie Winrod, Fire Marshal, had no comments or concerns. Scott Wilkinson, Assistant City Manager, recommended conditional approval as presented by staff, with an amendment to the Development department's first condition to clarify at what point in the process those documents would be required. He also agreed with Mr. Fitzgerald's comment about on-street parking - that the layout discourages on-street parking because it would interfere with driveway and garage access. Commissioner Garret Kamps asked if the area to the right of the buildings on the site plan would be used for trash receptacles. Mr. Fitzgerald answered that area would be for guest parking. Individual trash cans would go in the garages. Commissioner Kamps asked if the property would be gated. Mr. Fitzgerald answered that it had not been decided, but that it's not planned to be gated at this time. Ms. Steninger asked who was going to set up the home owner's association (HOA) rules. Mr. Fitzerald answered that the HOA would be developed ahead of time with guidelines about what people would and would not be allowed to do. Mr. Fitzgerald confirmed, stating the covenants, conditions, and restrictions (CC&Rs) would have to be recorded as a lien on the property ahead of time. Ms. Steninger asked if an owner of a townhome would be able to rent it out. Mr. Fitzgerald confirmed. Ms. Rambo interjected that the City requires a copy of the CC&Rs to be provided with the submittal of the subdivision map. The CC&Rs could be enforced by the HOA as well as City Code Enforcement. Ms. Turpen asked if there would be a limit on the percentage that can be owner occupied. Mr. Fitzgerald answered in the negative. It could wind up being all rentals if that's what the owners intend to do with their properties. Regardless, the owners would be held liable for the CC&Rs and maintenance of the property under the HOA. Mr. Turpen asked if there was a price point yet. Mr. Fitzgerald answered in the negative. Ms. Steninger asked if only the owners would be a part of the HOA, not the renters. Mr. Fitzgerald confirmed. ***Motion: Conditionally approve Conditional Use Permit 8-22 based on the facts, findings and conditions as presented in Staff Report dated December 15, 2022, with one addition - construction documents to show the location of the relocated power poles and should be submitted prior to the building permits being issued. Review, consideration and possible action on Variance No 4-22, filed by Gerald R. and Bonnie Ann Vega, for a reduction of the required lot width from 60’ to 50’ for proposed Parcel 1 and a reduction of the required lot area for proposed Parcel 1 from 6,000 square feet to 5,000 square feet in an RMH-2 (Residential Mobile Home) Zoning District and matters related thereto. FOR POSSIBLE ACTION The applicant has submitted a parcel map in conjunction with this variance. If the parcel map is approved for the division of one parcel into three parcels, each parcel would not be in conformance with minimum required lot width and minimum required lot area within the RMH-2 zoning district. Gerald Vega, 2024 Antler Road, introduced himself as the applicant and stated he would refer questions to staff. January 3, 2023 City of Elko Planning Commission Meeting Minutes Page 4 of 15 Ms. Laughlin explained that the parcel has three mobile homes, but is on a block zoned RMH-2, mobile homes on individual lots. She also explained that City Code once required a minimum lot area of 50 feet wide by 100 feet deep, but has since changed to 60 feet by 100 feet. This variance and the two following would bring it into conformance with the RMH-2 zoning district. She went over the City of Elko Staff Report dated December 16, 2022. Regarding parking, each mobile home currently has off-street parking that won't be changing, so it will remain as legal, non- conforming. Regarding the six variance items the application has to meet, existing conditions were sited. The report had 11 findings and recommended approval with one condition, that Parcel Map 7-22 be approved and recorded prior to recordation of the variance. Ms. Rambo commented that this is the best example she had seen in a long time of where a variance would be appropriate. It would fit in with the neighborhood and it wouldn't give any special privileges. She recommended approval. Mr. Thibault recommended approval as presented by staff. Ms. Winrod had no comments or concerns. Mr. Wilkinson recommended approval as presented by staff. Commissioner Michael Irish asked how the three mobile homes all met the setbacks, and that each proposed parcel would get 5000 square feet. Ms. Laughlin responded that the division of the block was done by multiple parcel maps and at the time, 50 feet by 100 feet lots were allowed. Regarding the setbacks, the City probably still had a 15 foot setback requirement. ***Motion: Approve Variance No. 4-22 for a reduction of required lot width to 50' and a reduction of required lot area to 5,000 sq. ft. for the proposed Parcel 1, based on findings of fact as stated in Staff Report dated December 16, 2022. Ms. Laughlin stated this is for proposed Parcel 3 on the same lot. This variance is identical to the previous two applications. Ms. Rambo had no additional comments or concerns. Review, consideration and possible action on Variance No 8-22, filed by Dixon Properties LLC., for a reduction of the required lot area for proposed Parcel 1 from 6,000 square feet to 4,938 square feet and a reduction of the required front yard setback from 15’ to 12’ in an RMH-2 (Residential Mobile Home) Zoning District and matters related thereto. FOR POSSIBLE ACTION The applicant has submitted a parcel map in conjunction with this variance. If the parcel map is approved for the division of one parcel into two parcels, this proposed Parcel 1 would not be in conformance with minimum required lot area and front yard setback within the RMH-2 zoning district. Frankie Dixon, 602 South 3rd Street, introduced himself as the applicant and deferred to staff. Ms. Laughlin showed the location of the parcels for this variance and the following three as being on the same block as the previous variances, on two parcels that are 100 feet by 100 feet, excepting a curved radius on the Adams Street/South 3rd Street corner. The site plan showed the existing conditions on each lot, as well as the proposed property lines. Each proposed parcel will be unique to itself due to existing conditions for off-street parking and fencing. She went over the City of Elko Staff Report dated December 19, 2022, which stated the properties are currently not in conformance with the RMH-2 zoning district because there are two mobile homes on one parcel each. Approval of the parcel map and the variances would put these properties in conformance. Regarding parking, each mobile home currently has off-street parking that won't be changing, so it will remain as legal, non-conforming. Regarding the six variance items the application has to meet, existing conditions were sited. Staff feels there would be no significant advantage to approving a setback variance for the existing mobile home, but if it were to be removed and replaced, the new home would have to comply with the standard front yard setback. The report had 11 findings and recommended approval with one condition, that Parcel Map 8-22 be approved and recorded prior to recordation of the variance. Ms. Rambo had no additional comments or concerns. Mr. Thibault recommended approval as presented. Ms. Winrod had no comments or concerns. Mr. Wilkinson recommended approval as presented by staff. Commissioner Irish asked what triggered the variances. Ms. Laughlin answered that the previous owner passed away and left the properties to family members. Creating separate parcels would give them the opportunity to sell to the current tenants of the mobile homes. January 3, 2023 City of Elko Planning Commission Meeting Minutes Page 7 of 15 Ms. Laughlin went on to say that there are some fencing encroachments into the adjacent neighbors, which will be a condition of the parcel map. The parcel map will be approved administratively. Chairman Jeff Dalling asked Mr. Dixon if he was okay with the new fence lines. Mr. Dixon confirmed. ***Motion: Approve Variance No. 8-22 for a reduction of the required front yard setback to 12’ for the existing mobile home and a reduction of the required lot area to 4,938 sq. ft. based on findings of fact as stated in Staff Report dated December 19, 2022. The front yard setback approval is for the existing mobile home and not any future development. Moved by Stefan Beck, Seconded by Garret Kamps * Motion passed unanimously. (6-0) 6. Review, consideration and possible action on Variance No 9-22, filed by Dixon Properties LLC., for a reduction of the required lot area for proposed Parcel 2 from 6,000 square feet to 5,062 square feet and the reduction of the required frontage width from 60’ to 36.57’ in an RMH-2 (Residential Mobile Home) Zoning District and matters related thereto. FOR POSSIBLE ACTION The applicant has submitted a parcel map in conjunction with this variance. If the parcel map is approved for the division of one parcel into two parcels, the proposed Parcel 2 would not be in conformance with minimum required lot area and minimum frontage width within the RMH-2 zoning district. Ms. Laughlin showed the location of proposed Parcel 2, listed the variances being requested, and stated the application was identical to the previous one as well as the staff report summary. Ms. Rambo had no additional comments or concerns. Mr. Thibault recommended approval as presented. Ms. Winrod had no comments or concerns. Mr. Wilkinson recommended approval as presented by staff. ***Motion: Approve Variance No. 9-22 for a reduction of the required lot area to 5,062 sq. ft. and a reduction of the required frontage width to 36.57’ based on findings of fact as stated in Staff Report dated December 19, 2022. FOR POSSIBLE ACTION The applicant has submitted a parcel map in conjunction with this variance. If the parcel map is approved for the division of one parcel into two parcels, the proposed Parcel 3 would not be in conformance with minimum required lot area, minimum required frontage width and front yard setback within the RMH-2 zoning district. Ms. Laughlin showed the location of proposed Parcel 3, listed the variances being requested, and stated the staff report and compliance with all other sections of code were identical to the previous two applications. Review, consideration and possible action on Variance No 11-22, filed by Dixon Properties LLC., for a reduction of the required lot area for proposed Parcel 4 from 6,000 square feet to 5,220 square feet and the reduction of the required frontage width from 60’ to 56.69’ in an RMH-2 (Residential Mobile Home) Zoning District and matters related thereto, FOR POSSIBLE ACTION The applicant has submitted a parcel map in conjunction with this variance. If the parcel map is approved for the division of one parcel into two parcels, the proposed Parcel 4 would not be in conformance with minimum required lot area and minimum frontage width within the RMH-2 zoning district. Review, consideration, and possible action on Zoning Ordinance Amendment 2- 22, Ordinance No. 879, an amendment to the City Zoning Ordinance, specifically Section 3-2-12; LI, GI Industrial Districts, and matters related thereto. FOR POSSIBLE ACTION City Council, at the November 22, 2022 meeting, took action to initiate an amendment to the City Zoning Ordinance Title 3, Chapter 2, Section 12. Ms. Laughlin went over the proposed changes to the zoning ordinance provided in the agenda packet. Anything highlighted, bolded and underlined was an addition, while anything bolded and lined through was a removal. The proposed changes came from a collaboration between departments. Ms. Rambo stated it's always better to have schools on arterial collectors instead of on residential streets, so it is fairly common to see them in light industrial areas. Mr. Thibault stated any comments from the Engineering department were incorporated into the document as presented. Ms. Winrod had no comments. Mr. Wilkinson recommended approval as presented by staff. Commissioner Odeh asked if somebody who had a residential home they wanted to sell in the zone could do so. January 3, 2023 City of Elko Planning Commission Meeting Minutes Page 10 of 15 Ms. Laughlin confirmed it could be sold as residential as long as it still had legal, non-conforming status. ***Motion: Forward a recommendation to City Council to adopt an ordinance which approves Zoning Ordinance Amendment 2-22 of the Elko City Code specifically Section 3-2- 12. Moved by Tony Odeh, Seconded by Garret Kamps * Motion passed unanimously. (6-0) B. MISCELLANEOUS ITEMS, PETITIONS, AND COMMUNICATIONS 1. Review, consideration and possible approval of Final Map No. 7-22, filed by DBG Investment, Inc. for the development of a subdivision entitled Bergeron Village Phase 1 involving the proposed division of approximately 44.345 acres of property into 16 lots for residential development and 2 remainder lots within the R (Multiple-Family and Single-Family Residential) and R1 (Single-Family Residential) Zoning Districts, and matters related thereto. FOR POSSIBLE ACTION Subject property is located on the west side of East Jennings Way north of Puccinelli Parkway. (APN 001-562-015) Scott MacRitchie, 1947 Amber Way, stated that if approved, there would be some multi-family and single family residential. There would be a limited purpose HOA to maintain a trail system running through the project and a sub-HOA for townhome lawn care and exterior maintenance. This item and the next would be phases one and two of a much larger project. Ms. Rambo, stated this is phase one of five of a tentative map approved by City Council in September. Review of the final map showed conformance with the tentative map, and all applicable City codes, regulations and documents. A traffic study was completed for the tentative map submittal which recommended making the intersection of Ruby Vista and East Jennings into a four-way stop. That has been included in the staff report as a condition. The staff report had 11 findings and 14 conditions. Ms. Laughlin had no further comments. Mr. Thibault listed Engineering's two conditions, both of which the applicant had already sent revisions in for review. Ms. Winrod had no comments. Mr. Wilkinson recommended approval as presented by staff. January 3, 2023 City of Elko Planning Commission Meeting Minutes Page 11 of 15 Commissioner Irish inquired about the trail system for Phase 1. Ms. Rambo clarified that for Phase 1, the sidewalks would be the trail system. The formal trail system would begin in Phase 2. Commissioner Irish asked if the trails would be dirt. Mr. MacRitchie stated they would be gravel trails. Commissioner Irish asked if a total distance for the trail system was known. Mr. MacRitchie responded in the negative. He went on to state that the trail system would wind between and behind homes. Typical trails have a width of 8 feet and are called out on maps as common area/PUE (public utility easement), which wouldn't conform as an individual lot. Commissioner Irish stated he was very much in favor of this type of development. Mr. MacRitchie responded that it would create a different type of pedestrian activity and adds value to this project. Mr. Thibault added that the common areas would be owned by the HOA so that the trails could be build and maintained. They would be legal parcels, but not developable/buildable lots. Mr. Wilkson concurred, likened it to the common area for CUP 8-22, heard earlier in the meeting. ***Motion: Recommend that the City Council accept, on behalf of the public, the parcels of land offered for dedication for public use in conformity with the terms of the offer of dedication; that the final map substantially complies with the tentative map; that the City Council approve the agreement to install improvements in accordance with the approved construction plans that satisfies the requirements of Title 2 Chapter 3, and conditionally approve Final Map 7-22 with findings and conditions listed in the Staff Report dated December 16, 2022. Review, consideration and possible approval of Final Map No. 6-22, filed by BELDCO, LLC for the development of a subdivision entitled Bergeron Village Phase 2 involving the proposed division of approximately 23.476 acres of property into 24 lots for residential development and 2 remainder lots within the R (Multiple-Family and Single-Family Residential) and R1 (Single-Family Residential) Zoning Districts, and matters related thereto. FOR POSSIBLE ACTION Subject property is located on the northeast side of East Jennings Way north of the future Zephyr Heights subdivision. (APN 001-562-014) January 3, 2023 City of Elko Planning Commission Meeting Minutes Page 12 of 15 Ms. Rambo stated the final map had been found to be in conformance with the tentative map and all of the codes, regulations and various required documents. The same condition about the intersection of Ruby Vista Drive and East Jennings Way applies to this item. The Staff Report dated December 16, 2022, had 11 findings and 13 conditions, with a recommendation of approval. Ms. Laughlin has no other comments or concerns and recommended approval. Mr. Thibault reviewed his conditions from the Staff Report. Chairman Dalling asked Mr. MacRitchie if he was up to speed with all of the conditions. Mr. MacRitchie confirmed. Ms. Winrod had no further comments. Mr. Wilkinson recommended approval as presented by staff. Commissioner Stefan Beck asked for more information about how the material for the trails was decided. Mr. MacRitchie responded that with asphalt there is no absorbable area for water to go except to someone's lot. Ms. Laughlin reviewed the Elko Planning Commission 2023 Work Program provided in the agenda packet. She reported that at the last Rural Planning conference, the need for Planning Commissioner training was brought up. Currently there is a five person committee working on putting together a one day training session. Chairman Dalling and Commissioner John Lemich both expressed that they would like the training to be held in-person. Commissioner Irish stated he would like to see a continuing education requirement for commissioners. ***Motion: approve the Elko Planning Commission's 2023 Work Program.
