I. CALL TO ORDER
Jeff Dalling, Chairman of the City of Elko Planning Commission, called the meeting to order
at 5:30 p.m.

V. APPROVAL OF MINUTES
A. January 1, 2023 - Regular Meeting - FOR POSSIBLE ACTION
** A motion was made to approve the minutes for the regular meeting held on January 1,
2023.
The motion failed for lack of second.

Chairman Jeff Dalling questioned the date.
Vice-Chairman Stefan Beck modified his motion to reflect the correct date of the meeting.
** A motion was made by Vice-Chairman Beck, seconded by Commissioner Lemich to
approve the minutes for the regular meeting for the Planning Commission held on January 3,
2023.
The motion passed unanimously. (7-0)
VI. NEW BUSINESS
A. MISCELLANEOUS ITEMS, PETITIONS, AND COMMUNICATIONS
1. Review, consideration, and possible recommendation to City Council for Vacation
No. 1-23, filed by County of Elko, for the vacation of 6th Street between Idaho
Street and Court Street consisting of an area approximately 18,133 sq. ft. as well
as the public alley right-of-way of Block 4, Map of the Town of Elko recorded as
File No. 1, consisting of an area approximately 6,003 sq. ft., and matters related
thereto. FOR POSSIBLE ACTION
County of Elko has recently purchased all of the parcels on Block 4 of the Map of
the Town of Elko, recorded as File No. 1, and would like to merge all the parcels
with the existing Courthouse and Administration building to build a new Judicial
Center, County of Elko Complex. Vacation of the street between the blocks as well
as the alley is the start of this process. CL
Corey Rice, Elko County Surveyor and Senior Planner, introduced himself as the applicant. He stated
there were two reasons for the request to vacate - the 6th Street area would primarily be for court
security and the alleyway area would be for additional parking and future development of the Elko
County Judicial Center. The County would eventually submit another application to merge the Block
4 parcels into one. Once there are plans for the Judicial Center, the County will relocate the utilities
within the alleyway so the entire parcel can be used for buildings and parking structures. There are
existing utilities within both the alleyway and 6th Street, so he is currently drafting a Grant of
Easement to the City of Elko.
Cathy Laughlin, City Planner, stated there are several encroachments on the west side of 6th Street
of buildings and landscape walls. The City is requesting an easement for the entire proposed area to
be vacated minus the encroachments. She went over the City of Elko Staff Report, dated January 25,
2023. Regarding the Master Plan, when the County returns for the Block 4 parcel merger, the City
can do a Master Plan Amendment to change it from Mixed-Use Downtown to Public. The properties
are within the redevelopment area. As such, this application will be considered by the Redevelopment
Agency. It has been placed on their agenda, for consideration next Tuesday, February 14th. The
report listed five findings and recommended forwarding a recommendation of conditional approval
to City Council. The conditions were read.

Michele Rambo, Development Manager, had no comments or conditions.
Bob Thibault, Civil Engineer, stated his two conditions were listed in the Staff Report.
Jamie Winrod, Fire Marshal, had no further comments or conditions beyond what was listed in the
Staff Report.
Jan Baum, City Manager, had no changes and recommended approval.
** A motion was made by Secretary Mendive, seconded by Commissioner Odeh to forward
a recommendation to City Council to adopt a resolution which conditionally approves the
proposed vacation with the following conditions:
1. Approved conditions are to be included in the Resolution.
2. The applicant is responsible for all costs associated with the recordation of the vacation.
3. Written response from all non-City utilities is on file with the City of Elko with regard to
the vacation in accordance with NRS 278.480(6) before the order is recorded.
4. A public utility easement be granted to the City of Elko over the area being vacated with
the exception of the building encroachments. The easement shall be recorded with Elko
County Recorder after the recordation of the resolution vacating the public right-of-way.
5. All future maintenance will be the responsibility of the County of Elko.
6. Emergency vehicle access must be maintained within the vacated portion of 6th Street.
Secretary Mendive’s findings to support her recommendation were the proposed vacation is
partially in conformance with the City of Elko Master Plan Land Use Component. The
proposed vacation is in conformance with the City of Elko Master Plan Transportation
component. The proposed vacation is in conformance with NRS 278.479 to 278.480, inclusive.
The proposed vacation is in conformance with the Redevelopment Plan and meets several goals
and objectives listed in the Plan. The proposed vacation is in conformance with City Code 8-7.
The motion passed unanimously. (7-0)
2. Review, consideration, and possible action on the 2022 Annual Report of Planning
Commission activities, and matters related thereto. FOR POSSIBLE ACTION
Pursuant to City Code Section 3-4-23, the Planning Commission is required to
prepare and present an annual report of its activities to the City Council.
Rachel Randall, Planning Technician, went over the Planning Commission 2022 Annual Report.
** A motion was made by Vice-Chairman Beck, seconded by Commissioner Kamps to
approve the 2022 Annual Report of Planning Commission Activities as presented, and forward
a recommendation to City Council to approve the report.
The motion passed unanimously. (7-0)

3. Review, consideration and possible recommendation to City Council for the 2023
City of Elko Land Inventory update. FOR POSSIBLE ACTION
City of Elko Land Inventory is to be updated when necessary.
Ms. Laughlin stated the last land inventory update was done two years ago, with a couple of minor
changes. This update has a significant amount of changes due to an audit completed last year that
showed the City of Elko's asset listing didn't match the land inventory. In addition, the land inventory
didn't reconcile with Elko County records. She went over the Land Inventory Update Memo, dated
January 19, 2023. Displaying the inventory list, she stated that everything highlighted in yellow were
the changes being proposed.
Commissioner John Lemich asked how it works for the parcels not owned by the City that have
wellheads.
Ms. Laughlin responded that they have access easements.
** A motion was made by Commissioner Odeh, seconded by Secretary Mendive to forward
a recommendation to City Council to accept all proposed changes and update the City of Elko
Land Inventory.
The motion passed unanimously. (7-0)
VII. REPORTS
A. Summary of City Council Actions
Ms. Laughlin reported that at the January 10th City Council meeting, an easement from Ash St.
Village LLC was accepted. A revocable permit for the VA along Jennings Way and Rocky Road for
landscaping in the right-of-way was approved. An easement from Elko Ruby Vista LLC for the Manor
was accepted. A change to City code for vacations was initiated. Current code reads that for
vacations, a petition has to be accepted by the Planning Commission or City Council. Then it goes
to Planning Commission. Then it goes back to City Council as a resolution. NRS requires it just to
have one meeting by the governing body. So there will no longer be a petition and there will no
longer be a Planning Commission review. It will just be City Council. The 2023 Planning
Commission Work Program was accepted. The first reading of the Lighting Industrial, General
Industrial zoning district changes was conducted. The vacation of Ash St Village LLC was approved.
The vacation of that easement under the Manor was approved.
At the January 24th meeting, City Council approved the Annual List of Appraisers. Bergeron Village
Phase 1 and Phase 2 final maps and performance agreements were approved. A possible land
exchange between the City of Elko and Jordanelle Third Mortgage that will help accommodate the
extension of Errecart Boulevard was approved. The petition for the Elko County vacation that was
heard earlier tonight was accepted. The second reading on the zoning amendment to amend City
Code 3-2-12 was conducted.

B. Summary of Redevelopment Agency Actions
Ms. Laughlin reported that there will be a Redevelopment Agency meeting next Tuesday, February
14th. Agenda items include their annual report, the Elko County vacation, and Infrastructure Grant
documents for possible approval. Applications for the Storefront Grant program are currently being
accepted until March 31st. If there aren't any applications the RDA can extend the application
period.
