p.m.

V. APPROVAL OF MINUTES
A. August 1, 2023 - Regular Meeting - FOR POSSIBLE ACTION
** A motion was made by Commissioner Odeh, seconded by Secretary Kamps to approve
the minutes from the August 1, 2023 regular meeting.
The motion passed unanimously. (5-0)

VI. NEW BUSINESS
A. MISCELLANEOUS ITEMS, PETITIONS, AND COMMUNICATIONS
1. Review, consideration and possible approval of Final Map No. 2-23, filed by Ash
Street Village, LLC for the development of a subdivision entitled Ash Street
Village involving the proposed division of approximately 0.401 acres of property
into 12 lots for townhome development and one (1) common lot within the RB
(Residential Business) Zoning District, and matters related thereto. FOR
POSSIBLE ACTION
Subject property is located at the northeast corner of 5th Street and Ash Street.
(APNs 001-067-017 and 001-067-018)
Luke Fitzgerald, applicant, was available for questions.
Scott Wilkinson, Assistant City Manager, speaking on behalf of Development, said the City of Elko
Staff Report, dated August 16, 2023, was provided in the agenda packet. It detailed background
information and conformance to various applicable master plan and city code sections. This was a
final map for a subdivision. It had been gone through in detail at the tentative stage. As a result of
the analysis, there were eleven findings and a recommendation for conditional approval. There were
35 conditions listed, from various departments. He was available for any questions.
Cathy Laughlin, City Planner, concurred with Mr. Wilkinson and recommended approval. Any
conditions from Planning were included in the staff report.
Bob Thibault, Civil Engineer, recommended conditional approval. He read the conditions from
Engineering, listed in the staff report.
Chairman Jeff Dalling asked the applicant if he was good with the conditions.
Mr. Fitzgerald responded in the affirmative.
Jamie Winrod, Fire Marshal, recommended approval.
Jan Baum, City Manager, recommended conditional approval.
** A motion was made by Secretary Kamps, seconded by Commissioner Mendive to
forward a recommendation that the City Council accept, on behalf of the public, the parcels of
land offered for dedication for public use in conformity with the terms of the offer of
dedication; that the final map substantially complies with the tentative map; that the City
Council approve the agreement to install improvements in accordance with the approved
construction plans that satisfies the requirements of Title 2 Chapter 3, and conditionally
approve Final Map 2-23 with conditions listed in the Staff Report dated August 16, 2023, listed
as follows:

Development Department:
1. The Developer shall execute a Performance and Maintenance Agreement in accordance
with Section 3-3-21 of City code. The Performance Agreement shall be secured in
accordance with Section 3-3-22 of City code. In conformance with Section 3-3-21 of City
code, the public improvements shall be completed within a time of no later than two (2)
years of the date of Final Map approval by the City Council unless extended as
stipulated in City code.
2. The Performance and Maintenance Agreement shall be approved by the City Council.
3. The Developer shall enter into the Performance and Maintenance Agreement within 30
days of approval of the Final Map by the City Council.
4. The Final Map for Ash Street Village is approved for 12 townhome residential lots and
1 common lot.
5. The Utility Department will issue a will-serve letter for the subdivision upon approval
of the Final Map by the City Council.
6. Site disturbance shall not commence prior to approval of the project’s construction
plans by the Nevada Department of Environmental Protection.
7. Site disturbance, including clearing and grubbing, shall not commence prior to the
issuance of a grading permit by the City of Elko.
8. Construction shall not commence prior to Final Map approval by the City Council and
issuance of a will-serve letter by the City of Elko.
9. Conformance with the conditions of approval of the Tentative Map is required.
10. The Owner/Developer is to provide the appropriate contact information for the
qualified engineer and engineering firm contracted to oversee the project along with the
required inspection and testing necessary to produce an As-Built for submittal to the
City of Elko. The Engineer of Record is to ensure all materials meet the latest edition
of the Standard Specifications for Public Works. The Engineer of Record is to certify
that the project was completed in conformance with the approved plans and
specifications.
11. Water and sewer service lines require a documented inspection by the Building
Department.
12. Conformance with all conditions stipulated for the approval of Conditional Use Permit
8 22 is required.
13. Final Map – Show a section or quarter-section tie.
14. Final Map – Revise the FEMA notes to reference the current maps.
15. Final Map – Surveyor’s Certificate statement 4 is incomplete.
16. Construction Plans – Project Specifications, Note 12 – Reconcile with page 11 section
2.9.1 of the geotechnical report.
17. Construction Plans – Project Information, Note 13 – Verify the lot areas shown on the
Final Map include the deck areas.
18. Construction Plans – Show wheel stops on the Ash Street parking area.
19. Construction Plans – Sheet 2 of 9; correct the APN for the city property.
20. Revisions to the Final Map and Construction Plans are required prior to City Council
consideration for approval of the subdivision.
Engineering Department:
21. Final Map – Provide ties from interior lots to the outer lot corners, or at least offset
distances from the interior lot lines to the exterior lot lines.
22. Final Map – Provide a parcel name and area for the common area.
23. Final Map – Note 5 references Parcel A. Define and label Parcel A.

24. Final Map – Note 6 is missing the first parcel number.
25. Final Map – Provide a subdivision name; i.e. “Final Map of …..” rather than “Final
Map for (owner)”.
26. Final Map – Provide a mailbox location and mailbox easement on the map.
27. Final Map – Remove the public utility and drainage easement conflicting with Lots 5
and 11.
28. Construction Plans – Show a mail box location.
29. Construction Plans – Correct bar scales on all sheets.
30. Construction Plans – Sheet 3, Note 15 – Correct spelling for coliform.
31. Utility Pole relocations are required prior to final acceptance of the project by the City
Council.
Utility Department:
32. Consider adding a note that no mitigation is required if 200 psi HDPE pipe is utilized
from the meter pit to residence and it is a continuous jointless pipe.
Planning Department:
33. It appears that the backflow, irrigation and possibly trees are located within the 5th
Street r-o-w. A revocable permit is required to location these projects elements within
the r-o-w per City code 8-22-2.
Building Department:
34. Exterior walls and projections shall comply with 2018, IRC Table 302.1(1) or 302.1(2).
Fire Department:
35. Provide the fire flow for existing hydrant F-088.
Commissioner Kamps' findings to support the recommendation were the Final Map for Ash
Street Village has been presented before expiration of the subdivision proceedings in
accordance with NRS 278.360(1)(a)(2) and City code. The Final Map is in conformance with
the Tentative Map. The proposed subdivision is in conformance with the Land Use and
Transportation Components of the Master Plan. The proposed development conforms with
Sections 3-3-9 through 3-3-16 (inclusive). The Subdivider shall be responsible for all required
improvements in conformance with Section 3-3-17 of City code. The Subdivider has submitted
construction plans in conformance with Section 3-3-18 of City code. The Subdivider has
submitted plans to the city and state agencies for review to receive all required permits in
accordance with the requirements of Section 3-3-19 of City code. The Subdivider has submitted
construction plans which, having been found to be in conformance with Section 3-3-20 of City
code, have been approved by City staff. The Subdivider will be required to enter into a
Performance Agreement to conform to Section 3-3-21 of City code. The Subdivider will be
required to provide a Performance and Maintenance Guarantee as stipulated in the
Performance Agreement in conformance with Section 3-3-22 of City code. The proposed
development conforms to Sections 3-2-3, 3-2-4, 3-2-5(E), 3-2-5(G), 3-2-17, and 3-8 of City code.

VII. REPORTS
B. Summary of Redevelopment Agency Actions
Ms. Laughlin reported at the last RDA meeting, the agency approved to dissolve the Redevelopment
Advisory Council, with a 4-0 vote. It will continue to move forward with its redevelopment activities.
A. Summary of City Council Actions
Ms. Laughlin reported at the July 8th City Council meeting, a 0.336 acre parcel of land was approved
for sale without going to auction. It was a small remnant that City Council had to find was only best
to sell to the adjacent property owner. She was in the process of getting it appraised. A grant of
easement for Kado Properties was accepted. It was for an apartment complex behind Family Dollar,
between it and the park (Angel Park). A grant of easement for Ash Street Village was accepted. It
was for the subdivision that was just heard, for the sewer and storm drain. There was a second
reading of Ordinance 880, for City Code, Section 3-2-10, Planned Commercial and Commercial
Districts (ZOA 1-22). There was a second reading of Ordinance 886, for the Benti property rezone
(Rez 3-23).
C. Training
Ms. Laughlin said there was a flyer for the State Planning Conference in the agenda packet. It will
be held in October in South Lake Tahoe. If any of the commissioners were interested in attending, to
please let her know as soon as possible so she can make arrangements.
Commissioner Stefan Beck asked about the dates and accommodations.
Ms. Laughlin said it was going to be on October 16, 17 and 18, which would be on a Monday,
Tuesday and Wednesday. The city would pay the attendance fee, hotel, and provide a daily per diem.
Commissioner Beck said he would go.
