The meeting was held in the council chambers, 1751 College Ave., Elko. This meeting was called to order by Mayor Pro Tempore Mandy Simons. CALL TO ORDER The Agenda for this meeting of the City of Elko City Council has been properly posted for this date and time in accordance with NRS requirements. II. ACTION WILL NOT BE TAKEN There were no public comments. V. APPROVAL OF MINUTES A. August 22, 2023 Regular Session The minutes were approved by general consent. VI. PRESENTATION A. Presentation by Kinross Gold Corporation including an update on mine operations and permitting, and matters related thereto. INFORMATION ONLY - NON ACTION ITEM Joe Kemp, Stephanie Hallinan, and Matt Miller from Kinross gave a presentation. They asked that at the next meeting, the City Council consider a letter in support of their Juniper expansion project. VII. PERSONNEL A. Employee Introductions: 1.) Monica Cardenas, Full Time Parks Maintenance Technician, Parks Department Present and introduced. VIII. APPROPRIATION A. Review and possible approval and/or Ratification of Warrants, and matters related thereto. FOR POSSIBLE ACTION ** A motion was made by Council Member Stone, seconded by Council Member Morris to approve the regular warrants FY 2023 in the amount of $802,152.81. The motion passed unanimously. (3-0) ** A motion was made by Council Member Stone, seconded by Council Member Morris to approve the hand-cut check FY 2024 in the amount of $449,489.17. (3-0) ** A motion was made by Council Member Stone, seconded by Council Member Morris to approve the hand-cut checks FY 2023 in the amount of $816,612.36. The motion passed unanimously. (3-0) B. Review, consideration, and possible authorization for Staff to purchase a new 2022 Chevrolet Silverado MD 6500 4x4 Chassis with a Stellar Tmax 1-11 Aluminum Mechanics Truck and Hydraulic Tool Kit from Metroquip of Idaho through Sourcewell Purchasing in the amount of $191,868.00, and matters related thereto. FOR POSSIBLE ACTION This purchase was approved in the FY 2023/24 Budget. The Water Department Non- Operating Expense Equipment Fund has additional funding to cover the over budget amount for this purchase. Staff recommends purchasing the new 2022 Chevrolet Silverado MD 6500 4x4 Chassis with a Stellar Tmax 1-11 Aluminum Mechanics Truck that is currently in production and expected to deliver during the 2023 October/November time frame. The alternative option would be to have a 2024 truck built with a year lead time and that would come with an even higher price point based on current inflation. DJ Jim Kerr, Water Superintendent, explained this is to replace one of our older trucks in the fleet. This truck goes to all jobs and work sites. Councilman Stone noted it says 2022 but it is new? Mr. Kerr answered because of COVID delays; a lot of trucks are just hitting the market. It will save us some money over the 2024 model. ** A motion was made by Council Member Morris, seconded by Council Member Stone to approve authorize staff to purchase a new 2022 Chevrolet Silverado MD 6500 4x4 Chassis with a Stellar Tmax 1-11 Aluminum Mechanics Truck and Hydraulic Tool Kit from Metroquip of Idaho through Sourcewell Purchasing in the amount of $191,868. The motion passed unanimously. (3-0) IX. NEW BUSINESS A. Review, consideration, and possible approval of a request from GBC Theatre to close Pine Street between 4th and 5th Streets, and 4th Street between Court and New Pine Streets on Friday, September 22, 2023 from 5 P.M. to 9 P.M. and Saturday, September 23, 2023 from 8 A.M. to 12 P.M for filming the stone structures for their setting in the play Macbeth, and matters related thereto. FOR POSSIBLE ACTION GBC Theatre is requiring to close Pine Street between 4th and 5th Streets, and 4th Street between Court and New Pine Streets for their stage production of Macbeth this fall. They September 12, 2023 City Council | Minutes Page 3 of 7  will be filming portions of the production and integrating the film into the live performance. This is the first time they have requested closing for filming. KW Kelly Wooldridge, City Clerk, explained this was not on a consent agenda because said she thought Mr. Rice would be here. City Staff have approved the application. Mr. Rice still needs to get permission from the neighbors. Scott Wilkinson, Assistant City Manager, said he has spoken with Paul and John Rice about the road closure. They intend to minimize it from what is shown in the packet. Mayor Pro Tem Simons called for public comments without a response. ** A motion was made by Council Member Stone, seconded by Council Member Morris to approve a request from GBC Theatre to close Pine Street between 4th and 5th Streets, and 4th Street between Court and New Pine Streets on Friday, September 22, 2023 from 5 P.M. to 9 P.M. and Saturday, September 23, 2023 from 8 A.M. to 12 P.M for filming the stone structures for their setting in the play Macbeth. The motion passed unanimously. (3-0) B. Review, consideration, and possible action with regard to the failure of Anthem Broadband of Nevada LLC to reimburse the City for its claim for property damage, and related expenses totaling Two Hundred Nine Thousand, Two Hundred Six Dollars and Twenty-Five Cents ($209,206.25), and matters related thereto. FOR POSSIBLE ACTION Anthem Broadband of Nevada LLC (Anthem) operates under a Non-Exclusive Franchise Agreement providing broadband service within the city. Anthem has contracted with another company for the installation of its broadband infrastructure. Anthem’s contractor has repeatedly violated provisions of the Nevada Administrative Code and the Nevada Revised Statutes as those pertain to excavations. As a result, Anthem and its contractor have damaged city infrastructure facilities causing significant disruptions to utility service for city residents and resulting in significant expense to the city. The City, through its attorney, has made written requests for reimbursement for damage to its infrastructure and related expenses beginning in December 1, 2022. The City Council considered the item at its meeting on July 25, 2023. During that meeting, Anthem’s representative requested 30 days to provide the City a commitment related to the matter. Anthem has failed to respond in any meaningful manner. SAW Scott Wilkinson, Assistant City Manager, explained there was a representative from Anthem present. We did receive a check from Anthem today so no action is needed. September 12, 2023 City Council | Minutes Page 4 of 7  Mayor Pro Tem Simons called for public comments without a response. NO ACTION X. REPORTS A. Mayor and City Council No report. B. City Manager Jan Baum, City Manager, said Elko Inn was served with the notice of the result of the Public Hearing. The fencing has been installed. We have not talked to them. They refused service of the certified letter but the Sheriff’s Office in Utah had served the order. Mayor Pro Tem Simons said she heard Boys and Girls Club has the plans and asked if we have seen them. Ms. Baum answered no. We saw something a month or two ago but they said they were going out for more designs. C. Assistant City Manager No report. D. Utilities Director Jim Kerr reported the Metzler, Dale Drive bid opening is tomorrow afternoon. The Hospital Second Source project has started and will start boring the highway next week. We had the pre-bid meeting for the Exit 298 Force Main project with a room full of contractors. E. Public Works F. Airport Manager Jim Foster reported next Council Meeting there will be a focus study presentation. They are scheduling a meeting with the Phoenix ADO next month. The new schedule has been in effect all week and the response has been positive. There will be schedule adjustments as we move into the larger aircraft. Don't forget about the restaurant at the airport. We need to get the locals in to support the restaurant. G. City Attorney H. Fire Chief September 12, 2023 City Council | Minutes Page 5 of 7  Councilman Stone asked about the tower truck. Chief Johnston said Tower 2 is on its way back now and then Tower 1 is going to Utah for some repairs. The Fire Prevention Haunted House will be Friday the 13th from 6pm to 8pm. I. Police Chief No report. J. City Clerk Kelly Wooldridge announced that since Debbie came back part-time, she has been working on a project where she goes around town looking for businesses without licenses. We have been working with these businesses aggressively to the point we are overwhelming the other departments with inspections. She and Annette will go on the radio show and talk about business license regulations. K. City Planner No report. L. Development Manager M. Financial Services Director No report. N.
