ACTION WILL NOT BE TAKEN V. CONSENT AGENDA A. Approval of Minutes for the October 28, 2025, Regular Session. FOR POSSIBLE ACTION VI. PRESENTATION A. Reading of a proclamation by the Mayor in recognition of November as Flood Awareness, and matters related thereto. INFORMATION ONLY, NON-ACTION ITEM. B. Presentation, discussion and possible approval of the City of Elko providing a letter of support for the Source Water Protection Program in Nevada and matters related thereto. FOR POSSIBLE ACTION Alison Cramer; Environmental Specialist for Resource Concepts Inc. (RCI) will do a presentation on the Source Water Protection Program in Nevada. She will also speak about other participating communities and other liaison involvement which includes Nevada Department of Environmental Protection (NDEP). This plan has no cost impact on the City of Elko. JK C. A brief update on the City of Elko’s Threat and Hazard Identification and Risk Assessment (THIRA) and Stakeholder Preparedness Review (SPR), focusing on local vulnerabilities and capability levels related to earthquakes, wildland fire, flooding, and hazardous materials incidents. The presentation by Emergency Manager/Fire Chief James Johnston will highlight November 12, 2025 Elko City Council Agenda Page 2 of 5  current preparedness strengths, identified gaps, and areas of council support, and matters related thereto. INFORMATION ONLY, NON-ACTION ITEM. VII. APPROPRIATION A. Review and possible approval and/or ratification of warrants, hand cut checks and matters related thereto. FOR POSSIBLE ACTION B. Review, consideration and possible award for the Parks Rehabilitation Project (Main City Park Outdoor Courts and Southside Park Pickleball Courts) and matters related thereto. FOR POSSIBLE ACTION City Council authorized Staff to solicit bids for the Parks Rehabilitation Project on July 22, 2025. A total of three (3) Bids from Great Basin Engineering, Resource Development Co., and MKD Construction were received and opened on October 29, 2025. All three (3) bids were reviewed and deemed responsive by City Staff. The bids range from $1,399,208.64 to $2,411,123.50. The lowest responsive bidder was Great Basin Engineering JW VIII. NEW BUSINESS A. Review, consideration, and possible ratification of a Settlement Agreement and Mutual Release of all Claims between the City of Elko and Union Pacific Railroad Company, a Delaware corporation, and matters related thereto. FOR POSSIBLE ACTION On February 28, 2024, there was significant damage caused by the UPRR train derailment to Water Street. Water Street was reconstructed this year, and the city is now seeking reimbursement from UPRR for the damage. The Settlement Agreement and Mutual Release of all Claims constitute a complete and final resolution of all issues, claims, and liabilities arising out of the train derailment. The agreement will also allow UPRR to release the reimbursement payment to the City of Elko for the repairs. DJ B. Review, consideration, and possible approval of a request from Jeremy Muth DBA Atlas Towing & Recovery to partially close the intersection at VFW Drive and Silver Street on Sunday, November 16, 2025, for four to five hours sometime during 9 AM and 4 PM and matters related thereto. FOR POSSIBLE ACTION Mr. Muth is requesting to partially close the intersection at VFW Drive and Silver Street so the film crew from Wrecked & Rescued can film Atlas Towing & Recovery for a future episode of this show. Atlas Towing’s storage yard is located at 332 VFW Drive, which is a short distance from this intersection. Mr. Muth has requested to film on a Sunday to reduce impact to traffic and businesses around this intersection. AR IX. PETITION, APPEAL, AND COMMUNICATION A. Ratification of the Police Chief issuing a 26-day Temporary Packaged Liquor License and issue a regular Packaged Liquor License, to Ryan Stevens, DBA Smokey Vibes LLC, located at 588 Commercial Street, Elko, NV 89801, and matters related thereto. FOR POSSIBLE ACTION November 12, 2025 Elko City Council Agenda Page 3 of 5  B. Review, consideration and determination of grievance appeal submitted by the Elko Police Officers Protective Association, Communications Workers of America, AFL-CIO, Local 9110 (EPOPA), following denial by the City Manager; possible action to uphold, modify or reverse the decision, and matters related thereto. FOR POSSIBLE ACTION Pursuant to Step 4 of the Contract Grievance Procedure outlined in the EPOPA Collective Bargaining Agreement, on October 15, 2025 the EPOPA submitted three grievances (9.3.25 Kellum Grievance, 9.3.25 Bogdon Grievance, and 9.13.25 Kellum Grievance) to the City Manager. The grievances were denied by the City Manager on the grounds that the grievances were untimely and unsupported by the language of the contract. Step 5 of the Contract Grievance Procedure states that in the event the matter is not resolved by the City Manager’s or his/her designee’s response, the matter may be submitted to the City Council at the first possible City Council meeting. Accordingly, the EPOPA Grievance Committee is bringing the matter to the City Council. Note this is not a meeting pursuant to NRS 241.033. The process will move forward in the following sequence: • Public comment – limited to 5 minutes per speaker. • EPOPA presentation (15 minutes) – testimony from Grievance Committee Members and/or designees and affected officers. • City response (15 minutes) – presentation from City management and/or designees. • Council question and answer session with presenters. • Council deliberation and decision – possible actions include upholding, modifying or reversing the decision of the City Manager. The Council’s decision must be supported by appropriate findings. JB X. 5:30 P.M. PUBLIC HEARING A. Public Hearing and Second Reading of Ordinance 906 an ordinance amending Title 2, Chapter 1 of the Elko City Code entitled "Building Regulations and Administrative Code,” and matters related thereto. FOR POSSIBLE ACTION The proposed ordinance amends Title 2, Chapter 1 and clarifies and updates various requirements related to the Building Regulations Administrative Code to reflect current standards, technologies, best practices and establishes clear administrative procedures for the enforcement, interpretation, and implementation of building regulations. JF B. Review, consideration, and possible action on Resolution No. 20-25, a resolution and order vacating a portion of Sage Street right-of-way consisting of an area approximately 729 sq. ft. adjacent to APN 001-620-007, which is located within the City of Elko, Nevada, to the abutting property owner, Patrick Pemelton, filed and processed as Vacation 5-25, and matters related thereto. FOR POSSIBLE ACTION NRS 278.480 states "If the governing body is satisfied that the public will not be materially injured by the proposed vacation; it shall order the street or easement vacated."
