CITY OF ELKO STORMWATER ADVISORY COMMITTEE (SWAC) SPECIAL MEETING 1:30 PM, Thursday, August 11, 2022 Elko City Hall, Council Chambers 1751 College Avenue CALL TO ORDER The meeting was called to order by Chairman Dennis Strickland. ROLL CALL: Dennis Strickland, City of Elko Public Works Director, Chairman Kelly Wooldridge, City of Elko Clerk Bob Thibault, City of Elko Engineer, Board Member Adeline Thibault, City of Elko Environmental Coordinator Lana Carter, Carter Engineering, Board Member Cindy Neisess, NDOT Kristie Black, NDEP Clair Morris, Councilman, Board Member ABSENT BOARD MEMBERS: Jason Demaline, NDOT, Board Member COMMENTS BY THE GENERAL PUBLIC Pursuant to N.R.S. 241, this time is devoted to comments by the public, if any, and discussion of those comments. No action may be taken upon a matter raised under this item on the agenda until the matter itself has been specifically included on a successive agenda and identified as an item for possible action. ACTION WILL NOT BE TAKEN. There were no public comments. APPROVAL OF MINUTES FOR POSSIBLE ACTION. A. November 16, 2021 - Regular Meeting - FOR POSSIBLE ACTION B. May 17, 2022 - Regular Meeting - FOR POSSIBLE ACTION *** A motion was made by Bob Thibault seconded Lana Carter by to approve the minuets as presented with the correction of May 17, 2022 to change nest to next. The motion passed unanimously. (4-0) V. NEW BUSINESS A. Review, consideration, and discussion of possible updates to the SWAC Bylaws, including changes to Article II Section 1 and 2, Article III Section 1, Article VI and other grammatical fixes in the document, and matters related thereto. FOR POSSIBLE ACTION August 11, 2022 Stormwater Advisory Committee (SWAC) | Minutes Page 1 of 3 Adeline Thibault, Environmental Coordinator, discussed that she reviewed the other bylaws with other committees within the City. The bylaws for the Chair for Stormawter was the only one to have the Chair elected by City Council. Therefore, the bylaw changed to have the board elect the Chair. She also removed herself as the secretary because the Clerk has been taking on the responsibilities instead. If there is anything else that the board felt they needed changed let her know so they could make those adjustments. The board agreed to the changes of the bylaws. Bob Thibault, City Engineer, advised the board of next steps by advising them of the three step process. It was initiated in this meeting, and will need to be acted on in the next meeting. Once there is action, the City Council will be sent a recommendation to approve it. *** A motion was made by Bob Thibault, seconded by Lana Carter, to initiate the changes to the bylaws. The motion passed unanimously. (4-0) B. Review consideration, and discussion of ongoing interfacing items with the Nevada Department of Transportation, and matters related thereto. DISCUSSION ITEM No report. C. Review City of Elko Stormwater Permit – A review of ongoing enforcement of the City of Elko’s MS4 Permit, and projects associated with the MS4 Permit, and matters related thereto. DISCUSSION ITEM Ms. Thibault said she had a field trip with 5th graders and NDOT was also able to join. The goats are by the river, which helps keep chemicals out of the river. She sampled the river and it was not flowing by 12th Street. She stated that it was flowing at Miller Ranch and was able to take a sample. She has not had many complaints with the construction sites or landscapers. She is looking forward to having the permit and updating the BMP manual. She is starting to work on the annual report, which is due December 1, 2022. Chairman Strickland said there was a large event and they swept after the event. NDOT swept after the event as well. C. Review consideration, discussion and possible action to develop a list of comments to be submitted concerning the Nevada Department of Environmental Protection’s Draft 2022 Construction General Permit update, and matters related thereto. FOR POSSIBLE ACTION Ms. Thibault has reviewed the permit thoroughly. They are all requirements that have been rolled down. She had questions on how everything will look. Perhaps it would be easier as a statement on a checklist from the Building department to contact NDEP to see if a permit is required, as long as the City does not have to track or enforce the obligation. The MS4 permit does not have staff to manage or enforce it. Also, there needed to be clarification on the definition of arid. Who would determine it and what years are averaged. However, she does not think it is a bad change. Cindy Neisess, Nevada Department of Transportation (NDOT), advised under 2.0 that the changes require both the owner and operator to submit an NOI. The owner gets the permit and has a contractor, who is the operator. They do not detail how things will be done and only the product. She does not have an answer and NDOT may need to rewrite the terms and conditions to confirm who the responsible party would be. Kristie Black, NDEP, said the way it is written is that every owner and every operator should have permit coverage. NDOT and the operator should have been getting a permit. The permit can be filed jointly so it is only under one permit. The responsibility would be laid out on how the contract is written. Mr. Thibault said he had heard asphalt millings would not be allow as final stabilization. It is allowed in waterways and/or sediment basins, which he is glad to hear. The trainings for inspector qualifications changed and wanted to know if the trainings will be provided. Ms. Neisess said the trainings are not required. The EPA training is a free training or have in- house training. NO ACTION VI. SET NEXT MEETING DATE The next meeting will be November 15, 2022 at 3:00 P.M. VII. FOR POSSIBLE ACTION The Nevada Department of Environmental Protection has released a new version of the Construction General Permit. This permit is required of any project being developed in the City consisting of one acre or more. Once in place, this permit could potentially be in effect for the next 5-10 years. Therefore, City of Elko staff feels that it is imperative that we provide comprehensive comments back to NDEP on any issues or concerns that may negatively impact the development community within the City of Elko.
