Council Members – City Building Official Peterson – Public Hearing – Discussion Only – Consideration and possible approval of appeal by Richard W. Nall estate representative Aaron Nall regarding building code violation at 736 Avenue G, Ely, Nevada. 8. DISCUSSION/POSSIBLE ACTION ITEMS PERTAINING TO THE PUBLIC HEARING. 1. Council Members – City Building Official Peterson – Discussion/For Possible Action – Consideration and possible approval of appeal by Richard W. Nall estate representative Aaron Nall regarding building code violation at 736 Avenue G, Ely, Nevada. 2 The City of Ely is an equal opportunity provider and employer. 9. THE MAYOR WILL RECESS THE REGULAR CITY COUNCIL MEETING FOR A MEETING OF THE ELY PROSTITUTION LICENSING BOARD. 1. Board Members – Discussion/For Possible Action – Approval of Prostitution License to the Stardust located at 190 High Street, Ely, Nevada, owned by Nicole Freeman. 10. THE MAYOR WILL RECESS THE REGULAR CITY COUNCIL MEETING FOR A MEETING OF THE ELY LIQUOR LICENSING BOARD. 1. Board Members – Discussion/For Possible Action – Approval of Class III Liquor License to Nicole Freeman d.b.a. Stardust located at 190 High Street, Ely, Nevada. 2. Board Members – Discussion/For Possible Action – Approval of Class IV Liquor License to Terrill Trask d.b.a. Perigo Corner Market located at 696 Aultman Street, Ely, Nevada. 11. ITEMS FOR DISCUSSION/POSSIBLE ACTION OF THE ELY CITY COUNCIL AS RECOMMENDED BY THE MUNICIPAL UTILITIES BOARD. 1. Councilman Carson - Discussion/For Possible Action – Approval to waive Landfill disposal fees in the amount of approximately $225.00 for Golf Course tin shed. 2. Councilman Carson - Discussion/For Possible Action – Approval to renew the Agreement for Consulting Services between Basin Engineering Corporation and the City of Ely. 3. Councilman Carson – Discussion/For Possible Action – Review of proposed Water Department projects provided by the City Engineer to be paid for with community service funds, with possible approval to complete engineering and go out to bid on any or all of them. 4. Councilman Carson – Discussion/For Possible Action – Review of proposed Sewer Department projects provided by the City Engineer to be paid for with community service funds, with possible approval to complete engineering and go out to bid on any or all of them. 5. Councilman Carson – Public Works Supervisor Cracraft – Discussion/For Possible Action – Approval to purchase of Caterpillar Model 304 C3 TH Hydraulic Excavator in the amount of $74,000, budgeted in FY23 Water/Sewer Funds. 12. ITEMS FOR DISCUSSION/POSSIBLE ACTION ONLY OF THE ELY CITY COUNCIL. A. CONSENT AGENDA (These items may be approved in one motion by the Council as its first action of business under For Discussion/Possible Action items.) Approval of the Consent Agenda approves each of these items. Council Members may remove any item from the Consent Agenda by notifying the Mayor or Mayor pro temp. Councilman Spear – Councilman Alworth – Discussion Only – Update on Porter Group efforts on the City of Ely’s behalf to secure federal and State funding. 2. Councilman Alworth – Discussion/For Possible Action – Review of Commnet’s written answers to questions regarding Connect America Fund (CAF) Phase II as it relates to White Pine County, their Broadband Infrastructure Program grant application and the Middle Mile Broadband Infrastructure grant program with possible direction regarding City’s response. 3. Councilman Alworth – Human Resources Director Trask – City Attorney Cahoon - Discussion/For Possible Action – Presentation of written plan to transition the Public Works Supervisor position to a Public Works Director position, with possible direction to initiate said transition. 4. Councilwoman Williams-Harper – Discussion/For Possible Action – Approve Thank You letter to Tesla, Inc. for their scheduled installation of a privately-funded electric vehicle supercharger station at Ridleys, as well as a Thank You letter to Ridley’s Family Markets for making their Ely location available. 5. Council Members – City Treasurer/HR Director Trask – Discussion/For Possible Action – Leavitt Group Insurance Representative –Renewal proposal of healthcare coverage for the City of Ely, December 1, 2022-November 30, 2023. 6. Council Members – City Clerk Lee – Discussion/For Possible Action – Approval to hold the second regular meeting in November on the 17th and only one regular meeting in December on the 8th, due to the Holidays. 13. ADJOURNMENT: THE MEETING MAY BE ADJOURNED BY APPROPRIATE MOTION OF THE CITY COUNCIL. * Open session – Action/Discussion – Personnel** The meeting may be closed by appropriate motion for the purpose of discussion on any matter allowed under N.R.S. 241.031 and 241.033, (1) nothing contained in this chapter prevents a public body from holding a closed meeting to consider the character, alleged misconduct, professional competence or physical or mental health of a person/employee. (2) A public body may close a meeting upon a motion, which specifies the nature of the business to be considered. (3) This chapter does not: (a) Apply to judicial proceedings. (b) Prevent the removal of any person who willfully disrupts a meeting to the extent that its orderly conduct is made impractical. (c) Prevent the exclusion of witnesses from a public or private meeting during the examination of another witness. (d) Require that any meeting be closed to the public. (e) Permit a closed meeting for the discussion of the appointment of any person to public office or as a member of a public body. (4) The exception provided by this section, and electronic communication, must not be used to circumvent the spirit or letter of this chapter in order to discuss or act upon a matter over which the public body has supervision, control, jurisdiction or advisory powers. In accordance with Federal civil rights law and U.S. Department of Agriculture (USDA) civil rights regulations and policies, the USDA, its Agencies, offices and employees, and institutions participating in or administering USDA programs are prohibited from discriminating based on race, color, national origin, religion, sex, gender identity (including gender expression), sexual orientation, disability, age, marital status, family/parental status, income derived from a public assistance program, political beliefs, or reprisal or retaliation for prior civil rights activity, in any program or activity conducted or funded by USDA (not all bases apply to all programs).
