EMMAUS BOROUGH COUNCIL
The Emmaus Borough Council met in Regular Session on May 2, 2022 in temporary
Council Chambers, located at 139 N. 4th Street, Emmaus, PA 18049 and via Zoom.
CALL TO ORDER
Mr. Labenberg called the meeting to order at 7:00 p.m.

PERSONAL APPEALS, PART I
A. Bob Ortiz, 1440 Shimerville Road – stated that he has an autistic grandson that
lives with him and asked if signage could be placed on Shimerville Road, warning drivers of an
autistic child. Mr. Labenberg referred the item to the Public Safety Committee.
COMMUNITY MINUTE
Mr. Anders stated that the Mopar Madness event held at the Emmaus Community Park
was well attended and both parking lots were full. He stated that there was trouble getting food
trucks, but the organization is working on it. Ms. Baumgartner stated that she and her family
attended the Emmaus Public Library mini golf event on Saturday, and it was very successful.
Mr. Labenberg stated that the Emmaus Farmers’ Market held its ribbon cutting on Sunday and is
officially open. Mrs. Sorg-McManamon reminded everyone that the Market will be open on
Sunday’s from 10:00 a.m. to 1:00 p.m. through November.

READING OF MINUTES
Motion by Mr. Hart, seconded by Mr. Balliet to adopt the April 18, 2022 Council
Minutes as drafted. There were 7 ayes. Motion carried.

COMMUNICATIONS
a. Bernie Patterson – letter about changing the hours at the Compost Site and
questioning the loading fee of $25.00. Referred to the Public Works Committee.

UNFINISHED BUSINESS, PART I
Ordinance No. 1227 – An Ordinance Amending the Provisions of Chapter 5, Part 6 of the
Borough’s Codified Ordinances, the Provisions of the International Property Maintenance Code
§ 5-602 Amendments (1st Reading 4/4/2022) (2nd Reading 5/2/2022).
Motion by Ms. Baumgartner, seconded by Mr. DeFrain to adopt Ordinance No.
1227 - An Ordinance Amending the Provisions of Chapter 5, Part 6 of the Borough’s
Codified Ordinances, the Provisions of the International Property Maintenance Code § 5-
602 Amendments on its 2nd Reading. Roll call vote: Mrs. Sorg-McManamon, aye; Ms.
Baumgartner, aye; Mr. Anders, aye; Mr. Balliet, aye; Mr. Hart, aye; Mr. DeFrain, aye;
Mr. Labenberg, aye. There were 7 ayes. Motion carried.

MAYOR’S REPORT
Mayor Gilbert reported that there are four Proclamations in the iPads.
Proclamation 2022-530 – International Compost Week, proclaiming that the week of
May 1st through 7th, 2002 as International Compost Week, with this year’s theme “Recipe for
Regeneration: Compost” highlighting the overall regenerative agriculture movement and how
compost and organics recycling fit into that process.
Proclamation 2022-531 - Police Week, proclaiming that the week of May 15th through

May 21 , 2022 be known as Emmaus Police Department Week, and urging all the residents and
friends of Emmaus to join in this observance.

Proclamation 2022-532 – Emergency Medical Services Week, proclaiming the week of
May 15th through May 23rd, 2022 be known as Emergency Medical Services Week, with the
theme, “EMS: Caring for Our Communities”, and encouraging the community to observe this
week with appropriate programs, ceremonies, and activities.
Proclamation 2022-533 – National Public Works Week, proclaiming the week of May
15 through May 21st, 2022 be known as National Public Works Week, with the theme “Ready

& Resilient,” and calling upon all citizens, business owners, and visitors to the community to
recognize the substantial contributions of the Public Works Department in making a great
community for all.
Mayor Gilbert reminded everyone that the Memorial Day Parade will be held on
Monday, May 30, 2022 at 9:00 a.m. ending at Memorial Triangle, and the Veteran’s Cemetery
Celebration will be held on Sunday, May 29, 2022.

COMMITTEE REPORTS
a. Public Works Committee
Mr. Anders reported that the Committee met on April 20, 2022 and entertained questions
about the Committee notes. He reported that the next Committee meeting is May 18, 2022.

b. Health, Sanitation, and Codes Committee
Mr. Balliet reported that the April 27, 2022 meeting was cancelled. He reported that the
next Committee meeting will be held on May 25, 2022.
Resolution 2022-23: PennDOT Form TE-160, Application for Traffic Signal Approval at
Chestnut and 6th Streets.
Motion by Mr. Balliet, seconded by Mr. Hart to adopt Resolution 2022-23. There
were 7 ayes. Motion carried.

c. Parks and Recreation Committee
Ms. Baumgartner reported that there is nothing for official action tonight and the next
Committee meeting will be held on May 3, 2022.

She reported that the final Pool Study meeting will be held on Wednesday, May 18, 2022
at 6:00 p.m. via Zoom and invited everyone to attend.

d. Public Safety Committee
Motion by Mr. Hart, seconded by Mr. Balliet to remove the Borough of Emmaus
Emergency Operations Plan from the table. There were 7 ayes. Motion carried.
Mr. Hart reported that the EOP was written sufficiently, however, Chief Price has stated
that there are several amendments that he would like to make at a later date.
Motion by Mr. Hart, seconded by Mr. DeFrain to adopt the Borough of Emmaus
Emergency Operations Plan. There were 7 ayes. Motion carried.
Mr. Hart entertained questions about the Committee notes and reported that the next
Committee meeting is May 26, 2022 at 9:00 a.m. via Zoom.

e. General Administration Committee
Mr. Labenberg reported that the next Committee meeting is Thursday, May 5, 2022 at
1:00 p.m. via Zoom.

f. Budget & Finance Committee
Resolution 2022-24 authorizing payment of the May 2, 2022 Bill List as follows:
Bill List $ 439,442.94
Payroll #8 $ 176,865.53
Payroll Taxes $ 57,836.10
Total $ 674,144.57
Done this 2nd day of May 2022.
Motion by Mr. DeFrain, seconded by Mr. Balliet to adopt Resolution 2022-24.

the Budget Performance for April 2022.
He reported that the next Committee meeting is Thursday, May 5, 2022 at 11:00 a.m. via

Mrs. Sorg-McManamon reported that there is nothing for official action tonight and the
next Committee meeting is Monday, May 9, 2022 at 4:30 p.m.
