MEETING MINUTES
MONDAY, NOVEMBER 17th, 2025
ERWIN, NORTH CAROLINA
The Town of Erwin Planning Board held its regular meeting in the Erwin Municipal Building Board Room
100 West F Street, Erwin NC on Monday, November 17th, 2025, at 7:00 PM.
Board members present were Vice Chairperson Jim Hartman, In-Town Board Members Marsha Woodard,
Rebecca Kelly, Michael Jackson, Grace Watts, and Kathryn Moore, and Out-of-Town Board Member
Howard Godwin.
Board member absent was Chairperson Member Nicholas Skatell. Also absent were In-Town Alternates
Dean Downing and Karen Beitar.
Staff members present were Town Manager Snow Bowden, Town Planner Dylan Eure, and Deputy Clerk
Katelan Blount.
Vice Chairperson Jim Hartman called the meeting to order at 7:00 PM.
Board Member Kathryn Moore gave the invocation.
Board Member Marsha Woodard led the Pledge of Allegiance.
CONSENT ITEMS
Board Member Kathryn Moore made a motion to approve the minutes of October 20th, 2025, and was
seconded by Howard Godwin. The Board voted unanimously.
OLD BUSINESS
Updates:
Town Planner Dylan Eure informed the Board that the rezonings for both Walter Drive and E Jackson Blvd
were both approved in November at the Board of Commissioners meeting. Once the minutes are
approved, the updates will go to Harnett County GIS.
NEW BUSINESS
Data Centers and Crypto Mines Text Amendment
Town Planner Dylan Eure informed the Board that this amendment is not because we’ve had a request to
put a Crypto Mine in Erwin, but rather to have an ordinance that outlines the process clearly so that if
there are requests, there is a process to follow. Some items required would be that it would only be
allowed within M1 District, a sound study would be required, there would be requirements for noise
buffers, and limits on the number of data centers or crypto mines within a certain area.

Board Member Marsha Woodard asked if this would be similar to a solar farm, which was confirmed by
Town Planner Dylan Eure.
Board Member Michael Jackson asked if that was due to the increase in utilities and infrastructure.
Town Planner Dylan Eure confirmed that yes, there is a very large increase in water usage, but also an
increase in noise in the area. There would be requirements for the applicant for the noise studies before
the application would be accepted.
Board Member Howard Godwin made a motion to approve the text amendment, which was seconded by
Marsha Woodard. The Board voted unanimously.
Vice Chairperson Jim Hartman asked the Board to read the Statement of Consistency.
Board Member Marsha Woodard read the following Statement of Consistency:
“The proposed text amendment is compatible with all of the Town of Erwin’s regulatory documents.
According to Erwin’s 2023 Land Use Plan, and Erwin’s Code of Ordinances, the proposed text amendment
would ensure that Erwin has clear guidelines and regulations for data centers and crypto mines, should
one to construct in Erwin or its planning jurisdiction.
Therefore, it is recommended that this text amendment be approved.”
Board member Howard Godwin made a motion in the affirmative, which was seconded by Kathryn
Moore. The Board voted unanimously.
Lots Accessible through Unimproved Roads Text Amendment
Town Planner Dylan Eure informed the Board that this is a proposed text amendment to Chapter 36,
Article XV, entitled General Provisions, within a reserved section between Sec. 36-446 and Sec. 36-453, to
allow the development of parcels that have previously been platted with unimproved access points, as
well as requiring improvements to occur to said access points. The reasoning for this amendment is to
allow orderly development while ensuring adequate access ways to parcels previously platted before
Erwin’s incorporation.
Town Planner Dylan Eure showed an example of a property that this would affect, located at Antioch
Church Road and Bate Road. He explained that this would require an aggregate base to prevent ruts, not
just a mud or dirt path. Many jurisdictions require paving; Erwin’s regulations wouldn’t be that strict.
This would also be only for new lots, not for grandfathered, platted, old lots.
This would fall under the developer for new lots, or anyone building a primary structure on a lot. There
would be no requirement if there was an unimproved lot bought and sold. This mostly affects lots in the
ETJ.
Board Member Howard Godwin made a motion to approve the rezoning request, which was seconded by
Rebecca Kelly. The Board voted 5-1 (Michael Jackson).
Vice Chairperson Jim Hartman asked the Board to read the Statement of Consistency.

Board Member Rebecca Kelly read the following Statement of Consistency:
“The proposed text amendment is compatible with all of the Town of Erwin’s regulatory documents,
according to Erwin’s 2023 Land Use Plan and Erwin’s Code of Ordinances. This amendment would best
provide regulation for lots wishing to develop on unimproved roadways.
Therefore, it is recommended that this amendment be approved.”
Board member Howard Godwin made a motion in the affirmative, which was seconded by Kathryn
Moore. The Board voted 5-1 (Michael Jackson).
ADJOURNMENT
Board Member Howard Godwin made a motion to adjourn the meeting at 7:18 P.M. and was seconded by

Memorandum
Rezoning Description
The Town of Erwin has received a request to rezone two adjacent parcels, of which one
has an address of 45 Red Hill Church Road and a Harnett County Tax Pin of 1507-14-3913.000.
The said parcel is 1.79 acres and under the B-2, M-1, and R-10 zoning classifications. The
second parcel does not have an address, but it can be identified by its Harnett County Tax Pin of
150715-4111.000, and is 1.62 acres under the M-1 and R-10 zoning classifications. The petition
would rezone both properties to be under the R-10 zoning classification.
Property Description
As stated previously this rezoning petition involves two parcels owned by Martha and
Joseph Stancil. With one of the parcels being located within Erwin’s corporate limits and the
adjacent parcel being just outside of Erwin’s corporate boundaries. The parcel that is located
within Erwin’s corporate limits has a listed physical address of 45 Red Hill Church Rd. This
parcel is currently occupied by two single-family homes, and according to Harnett County GIS,
they were built in the 1950’s prior to Erwin’s incorporation. Per Erwin’s ordinances, both of the
said homes are allowed to continue their use, provided that one is not destroyed or occupation is
not discontinued for a period greater than 180 days. This parcel is split zoned between three
zoning districts, with them being B-2, M-1, and R-10. One of the homes on the lot appears to be
within the B-2 and R-10 portion, while the second appears to be on the B-2 and M-1 portion. The
second adjacent parcel, petitioning to be rezoned, is located by its Harnett County Tax Pin of
1507-15-4111 and is just outside of Erwin’s corporate limits. Of which this parcel is occupied by
a single detached garage/shed used as an accessory for 45 Red Hill Church. This parcel's zoning
classification is R-10 and B-2.
In general, town staff believes the reasoning for the current B-2 zoning is due to a general
rezoning that was done after the construction HWY 421, when a blanket B-2 zoning
classification was placed to designate HWY 421 as a primarily commercial corridor. While the
industrial portions were likely a part of the adjacent property at 127 Red Hill Church Rd, but was
later deeded off within a will. While R-10 is believed to be the original zoning classification for
both parcels. In terms of wetlands and other possible environmental concerns located on the
properties, there does not appear to be any flood zones, wetlands, or protected watersheds. That
said, there is what appears to be a freshwater pond located on the property to its rear, located by
its address of 15 Red Hill Church Rd. The surrounding land uses are primarily comprised of
single-family residences, commercial establishments, and industrial uses, within the zoning

classifications being B-2, M-1, R-6, R-10, and RD. To the north of the property, there is M-1
zoning that contains uses such as EnviroBEE. To the direct east, there are both B-2 and R-10
zoning classifications, with the only uses being located on the R-10 lots being single-family
homes. Further east, there is also the RD zoning classification, with the parcel being vacant
woodland. To the south, the primary zoning is commercial with uses such as University Storage.
To the direct west, there is R-6 zoning with the use being a single-family dwelling. Further west,
there is additional M-1 zoning with the use being a solar farm.

Subject: Asphalt / Concrete Plants Text Amendment
The Town of Erwin Staff wishes to amend its Code of Ordinances for the purpose of adding
asphalt / concrete plants as a special use within the M-1 zoning classification, along with
definitions and regulations. The said amendment would add asphalt / concrete plants as a special
use within Chapter 36, Article XI, Section 36-312, while giving them a definition within Article
II, Section 36-24, and regulation within Article XV, Section 36-447 entitled General Provisions
Reserved.
Proposed Special Use to be Added to 36-312:
• Asphalt / Concrete Plants (see exact regulation for site plan preparation)
Proposed Definition to be Added to 36-24:
• Asphalt / Concrete Plants means a facility where asphalt, concrete, or other hardscape is
manufactured, mixed, recycled, and/or is stored in mass quantities for purposes such as
sale.
Proposed Regulation to be Added to 36-447:
• Asphalt / Concrete Plant standards shall be as follows:
o An asphalt / concrete plant shall have a minimum of 10 acres and all plant
operations shall be a minimum of 100ft away from any property line.
o No portion of an asphalt/ concrete plant's operations shall be located closer than
1,500 feet from a residentially zoned property, conservation zoned property,
hospital, nursing home, retirement home, school, children’s nursery, child
daycare, or church.
o A pre-construction sound study shall be conducted at the property before the
special use application is submitted, showing the current noise levels of the
property and the potential noise level of the property post-construction of said
development. In no case shall an asphalt/ concrete plant exceed 75 decibels at any
time of day, as measured at the property lines.
o A 6ft chain-linked fence with opaque slats shall be erected to entirely screen the
view of the development from all adjacent properties and right-of-way/access

easements. The said fence may be topped with barbed wire in order to provide
security to the site.
o When adjacent to a residentially zoned property, there shall be a buffer yard that
is 30ft in width placed at the property line with a minimum of 6 shade trees per
100 linear feet, with 4 understory trees per 100 linear feet, and, 15 evergreen
shrubs per 100 linear feet. At least 50% of all trees must be evergreen. All plants
shall be evenly spaced.
o When adjacent to any commercially or industrially zoned property, there shall be
a buffer yard that is 20ft in width placed at the property line with a minimum of 6
shade trees per 100 linear feet, and 25 shrubs per 100 linear feet. At least 75% of
all plants shall be evergreen. All plants shall be evenly spaced.
o When adjacent to the right-of-way or access easement, there shall be a buffer yard
that is 10ft in width, placed 20ft within the right-of-way or access easement with a
minimum of 3 shade trees per 100 linear feet, and 15 shrubs per 100 linear feet.
At least 50% of all plants shall be evergreen. Plants may be placed evenly or
clustered together to give a more natural appearance.
o Existing vegetation along property boundaries should be preserved to the fullest
extent as feasible.
o All shrubs shall be a minimum of 3 feet at planting. All trees shall be a minimum
of 6 feet at planting.
Statement of Consistency
The proposed text amendment is compatible with all of the Town of Erwin’s regulatory
documents and the proposed text amendment would ensure that the Town of Erwin has clear
guidelines and regulations for asphalt/concrete plants if one wishes to construct in Erwin or its
planning jurisdiction.

regulatory documents and the proposed text amendment would not ensure that the
Town of Erwin has clear guidelines and regulations for asphalt/concrete plants, if one
wishes to construct in Erwin or its planning jurisdiction.
Therefore, it is recommended that this text amendment NOT be approved.

Subject: No Tractor-Trailer Trucks Allowed on Certain Streets Text Amendment
The Town Staff of Erwin wishes to amend Chapter 32 of the Code of Ordinances entitled
“Traffic and Vehicles” Section 32-1 within Article 1, and Section 32-165 within Article 7 to
prohibit tractor-trailer trucks from using streets that the Erwin Board of Commissioners deems to
be dangerous for large tractor-trailer use.
Proposed Definition to be added to Section 32-1
Tractor-Trailer Trucks- Any truck or truck tractor with an overall length exceeding 30 feet,
which enters and exits the jurisdiction.
Proposed Addition to Section 32-165
Sec. 32-165 No Tractor-Trailer Trucks Allowed on Town-Maintained Streets
The following streets are designated as no-tractor-trailer truck streets. A tractor-trailer truck
making a stop at a parcel within a designated no tractor-trailer truck street that lacks another
form of ingress/egress shall be excluded from this provision. Those found in violation of this
article shall be charged a $50.00 penalty for each offense.
Each town maintained street designed as a no-tractor-trailer truck street shall have adequate
postings within the right-of-way designated as a no-truck street.

streets provided that they have another form of ingress/egress. It is recommended that this text
amendment be approved.

Subject: Allowing Recombinations, Permitting Lots Meet Substandard Lot Ordinance
The Town Staff of Erwin wishes to amend Chapter 30 of the Code of Ordinances entitled “Subdivisions”
Section 30-168 Subsection (a) within Article VI, to allow the recombination of non-conforming parcels,
provided that the owner does not own sufficient land to make a conforming lot, and the created lot’s
width and area are within 20% of the required width and area of the zoning district in which the parcel is
located.
Proposed Addition to Section 30-168
For the purposes of this article, "subdivision" means all divisions of a tract or parcel of land into two or
more lots, building sites, or other divisions for the purpose of sale or building development (whether
immediate or future) and shall include all divisions of land involving the dedication of a new street
or a change in existing streets; but the following shall not be included within this definition nor be
subject to the regulations enacted pursuant to this chapter:
(1) The combination or recombination of portions of previously subdivided and recorded lots
where the total number of lots is not increased and the resultant lots are equal to or exceed the
standards of the municipality as shown in this chapter; or when an owner does not own
sufficient land to enable them to conform to the dimensional requirements of the zoning
district, provided that the lot created is not more than 20% below the minimum specified lot
area and width of the zoning classification.
(2) The division of land into parcels greater than ten acres where no street right-of-way dedication
is involved;
(3) The public acquisition by purchase of strips of land for the widening or opening of streets; and
(4) The division of a tract in single ownership whose entire area is no greater than two acres into
not more than three lots, where no street right-of-way dedication is involved and where the
resultant lots are equal to or exceed the standards of the municipality as shown in this chapter.
