CITY OF ESCONDIDO October 28 1 2015 3:30 P.M. Meeting Minutes Escondido City Council CALL TO ORDER The Regular Meeting of the Escondido City Council was called to order at 3:30 p.m. on Wednesday, October 28, 2015 in the Council Chambers at City Hall with Mayor Abed presiding. ATTENDANCE: The following members were present: Councilmember Olga Diaz, Councilmember Ed Gallo, Councilmember John Masson, Deputy Mayor Michael Morasco, and Mayor Sam Abed. Quorum present. ORAL COMMUNICATIONS CLOSED SESSION: (COUNCIL/SUCCESSOR AGENCY/RRB) Attorney Jeffrey Epp requested the addition of one item to the agenda. MOTION: Moved by Councilmember Diaz and seconded by Councilmember Masson to add the following item to the Closed Session pursuant to Government Code section 54954.2(b)(2); that the need to take immediate action arose subsequent to the posting of the agenda and to recess to Closed Session. Motion carried unanimously. ADDED ITEM: Conference with Real Property Negotiator (Government Code §54956.8) Considering real property purchase and terms of payment for real property at the intersection of East Valley Parkway and Lake Wohlford Road, in connection with the East Valley Widening Project. The particular piece of property is APN 240-301-09, and the owners are Peter and Eunice Jauregi. The City negotiator has been Debra Lundy. I. Meeting Minutes Escondido City Council CALL TO ORDER The Regular Meeting of the Escondido City Council was called to order at 4:50 p.m. on Wednesday, October 28, 2015 in the Council Chambers at City Hall with Mayor Abed presiding. MOMENT OF REFLECTION: Assad Saif led the Moment of Reflection. FLAG SALUTE Mayor Abed led the Flag Salute. PRESENTATIONS: SANDAG ATTENDANCE: The following members were present: Councilmember Olga Diaz, Councilmember Ed Gallo, Councilmember John Masson, Deputy Mayor Michael Morasco, and Mayor Sam Abed. Quorum present. Also present were: Clay Phillips, City Manager; Jeffrey Epp, City Attorney; Jay Petrek, Community Development Director; Ed Domingue, Director of Public Works; Diane Halverson, City Clerk; and Michael Thorne, Minutes Clerk. Mayor Abed announced that the City Council unanimously approved hiring Graham Mitchell as City Manager upon retirement of current City Manager, Clay Phillips, on December 18, 2015. ORAL COMMUNICATIONS Kenneth P. Kestner, Escondido, requested information regarding his pending case with the Police Department. I I CONSENT CALENDAR MOTION: Moved by Councilmember Diaz and seconded by Deputy Mayor Morasco to approve the following Consent Calendar items. Motion carried unanimously. 1. AFFIDAVITS OF PUBLICATION, MAILING AND POSTING (COUNCIL/SUCCESSOR AGENCY/ RRB) 2. APPROVAL OF WARRANT REGISTER (Council/Successor Agency) 3. APPROVAL OF MINUTES: Regular Meeting of October 7, 2015 October 28, 2015 Escondido City Council Minutes Book 55 Page 387 4. RESOLUTION TO AUTHORIZE INITIATION OF AN OUT-OF-AGENCY SEWER SERVICE AGREEMENT, CASE NO. PHG 15-0034, 644 NORTH AVENUE - Request Council approve authorizing an application to LAFCO for an Out-of-Agency Sewer Service Agreement for connection to the City's sewer; authorize staff to process an Irrevocable Offer of Annexation; and authorize execution of agreements with the property owners to implement the service. (File No. 0850-20) Staff Recommendation: Approval (Community Development Department: Jay Petrek) RESOLUTION NO. 2015-185 5. UPDATE TO TRUCK ROUTES - Request Council approve authorizing the City Engineer to update the traffic schedule for truck routes to add portions of Second Avenue and Washington Avenue, and remove Grand Avenue from the list of established truck routes. (File No. 1050-50) Staff Recommendation: Approval (Public Works Department/Engineering: Ed Domingue) RESOLUTION NO. 2015-184 6. NOTICE OF COMPLETION FOR ESCONDIDO TRACT SUB 12-0014, LOCATED AT 537 NORTH ELM STREET (SAN DIEGO HABITAT FOR HUMANITY) - Request Council approve and accept the public improvements and authorize staff to file a Notice of Completion for Tract SUB 12-0014, located at 537 North Elm Street (San Diego Habitat for Humanity). (File No. 0800-10) Staff Recommendation: Approval (Public Works Department/Engineering: Ed Domingue) 7. FIRST AMENDMENT TO LEASE AGREEMENT WITH CHARROS DE EL CABALLO PARK AT 3400 VALLEY CENTER ROAD (POR.) - Request Council approve authorizing the Real Property Manager and City Clerk to execute a First Amendment to the Lease Agreement with Charros de El Cabello Park at 3400 Valley Center Road (Por.). THIS ITEM IS CONTINUED FROM OCTOBER 21, 2015. (File No. 0600-10 [A-3110]) Staff Recommendation: Approval (City Manager's Office: Joyce Masterson/Debra Lundy) RESOLUTION NO. 2015-181 CONSENT — RESOLUTIONS AND ORDINANCES (COUNCIL/SUCCESSOR AGENCY/RRB) The following Resolutions and Ordinances were heard and acted upon by the City Council/Successor Agency/RRB at a previous City Council/Successor Agency/Mobilehome Rent Review meeting. CONDUCT A PUBLIC HEARING TO CONSIDER RESOLUTIONS OF NECESSITY FOR EMINENT DOMAIN FOR THE EAST VALLEY PARKWAY/VALLEY CENTER ROAD PROJECT - ASSESSOR PARCEL NUMBERS: 240-020-23 [SERRATO]; 240-011-01 [TOSCANO]; 240-011-03 [HEATH]; AND 240-301-09 [JAUREGUI] - Request Council approve authorizing the eminent domain proceedings and direct the City Attorney to commence actions in the Superior Court for the purpose of acquiring said real property. THIS ITEM IS CONTINUED FROM OCTOBER 21, 2015. (File No. 0690-50) Staff Recommendation: Approval (City Manager's Office: Joyce Masterson/Debra Lundy) A) RESOLUTION NO. 2015-176 B) RESOLUTION NO. 2015-177 C) RESOLUTION NO. 2015-178 D) RESOLUTION NO. 2015-179 Julie Procopio, Assistant Director of Public Works, presented the staff report, utilizing a PowerPoint presentation. Matt Souttere, Assistant Engineer, was available to answer questions. MOTION: Moved by Councilmember Masson and seconded by Councilmember Diaz to approve authorizing the eminent domain proceedings and direct the City Attorney to commence actions in the Superior Court for the purpose of acquiring said real property and adopt Resolution No. 2015-176, Resolution No. 2015-177, Resolution No. 2015-178, and Resolution No. 2015-179. Motion carried unanimously. CURRENT BUSINESS 9. FINANCIAL STATUS REPORT FOR FISCAL YEAR 2014/15 AND BUDGET ADJUSTMENT - Request Council receive and file the annual financial status report for Fiscal Year 2014/15; approve a budget adjustment; authorize the use of General Fund Reserves of $258,340 to fund FY 2014/15 purchase order carryover requests and to transfer $131,000 to the Reidy Creek Golf Course to cover a year-end shortfall; and approve a reduction in the transfer of funds to the Recreation Fund from the General Fund in the amount of $136,000. (File No. 0430-30) Staff Recommendation: Approval (Finance Department: Sheryl Bennett) RESOLUTION NO. 2015-174 Sheryl Bennett, Director of Administrative Services, introduced Joan Ryan, Assistant Director of Finance, Scott Peterson, Accountant, and Christina Holmes, Revenue Manager, who presented the staff report, utilizing a PowerPoint presentation. Carlos Bonilla, Escondido, recommended keeping prices low to encourage golfing and to convert Reidy Creek Golf Course to executive style in order to lower maintenance costs. MOTION: Moved by Deputy Mayor Morasco and seconded by Councilmember Masson to receive and file the annual financial status report for Fiscal Year 2014/15; approve a budget adjustment; authorize the use of General Fund Reserves of $258,340 to fund FY 2014/15 purchase order carryover requests and to transfer $131,000 to the Reidy Creek Golf Course to cover a year-end shortfall; and approve a reduction in the transfer of funds to the Recreation Fund from the General Fund in the amount of $136,000 and adopt Resolution No. 2015-174. October 28, 2015 Escondido City Council M inutes Book 55 Page 389 10. 2015/16 CITY COUNCIL ACTION PLAN - FISCAL MANAGEMENT - Request Council provide direction regarding the Fiscal Management goal of determining the appropriate size of Reserves for the City's General Fund based on an analysis of risk factors defined by the Government Finance Officers' Association. (File No. 0610-90) Staff Recommendation: Provide Direction (Finance Department: Sheryl Bennett) Sheryl Bennett, Director of Administrative Services, and Joan Ryan, Assistant Director of Finance, presented the staff report, utilizing a PowerPoint presentation. COUNCIL DIRECTION: Council directed staff to evaluate appropriate reserve levels using a risk factor analysis. FUTURE AGENDA 11. FUTURE AGENDA - The purpose of this item is to identify issues presently known to staff or which members of the Council wish to place on an upcoming City Council agenda. Council comment on these future agenda items is limited by California Government Code Section 54954.2 to clarifying questions, brief announcements, or requests for factual information in connection with an item when it is discussed. Staff Recommendation: None (City Clerk's Office: Diane Halverson) COUNCIL MEMBERS SUBCOMMITTEE REPORTS Councilmember Gallo reported on the Borders Committee and Go Global San Diego's data; reported that the San Diego Water Authority will tour the Lake Hodges pump house and Olivenhein Dam. Mayor Abed reported on SANDAG's discussion of potential Quality of Life tax; the Boy Scouts of America honored Chief Carter for the 2015 Distinguished Citizens Award.
