City of Eugene Human Rights Commission The mission of the Human Rights Commission is to promote implementation of universal human rights values and principles in all City of Eugene programs and throughout the wider community. To carry out this mission the commission shall affirm, encourage and initiate programs and services within the City of Eugene and in the wider community designed to place priority upon protecting, respecting, and fulfilling the full range of universal human rights as enumerated in the Universal Declaration of Human Rights. Welcome from Chair; Agenda Review and Adjustment – Commenced at 5:35 pm Andrew Thomson moves to remove funding request and add the time to open discussion after staff update, Chris Nunes seconds, unanimous. Richie Weinman moves to approve the June minutes, Debra Merskin seconds, unanimous. 2. Council Liaison Report Attended ACLU forum on EPD stops policy. Well attended event. The discussion focused on what is the proper and appropriate police conduct in relation to racial profiling. 3. Work Plan Approval Objective 1 Task 1.3 Task 2: Refer to liaison list for specific bodies and assignments 3 Councilor Evans requesting Action 1.2, Task 2 language to be stronger. Requesting to make it more like “advocate for more diversity and request annual report on hiring practices”. Richie Weinman, thinks the next step might be to have HR staff come and talk with HRC about hiring practices and report card. Important to look at advisory bodies as well. Ken Neubeck thinks HRC should invite a report on demographics of city employees and hiring issues and problems on diversity from Jon Ruiz. Councilor Evans agrees. Brings up the point to invite Jon once or twice a year in general to meet with the HRC. Phil wants to make sure that HRC gets full information for applicants to the HRC to ensure transparency. Councilor Evans mentions perhaps inviting Alana Holmes, the H.R. director. Mary Clayton, could we add task “Review hiring data and host presentation from HR director on city hiring practices” Add boards and commissions to the list of Task 2 Andrew Thomson moves that we approve Objective 1 with proposed revisions, Richie Weinman seconds, unanimous. Councilor Evans, very concerned that UOPD not having a review process outside the University. EPD is overseen by Police Commission, Police Auditor, Civilian Review Board. Requesting message from HRC that would go to Council that would point out that there is a law enforcement agency in the City of Eugene that does not have the same level of accountability as EPD. Ken Neubeck, you could request a letter of inquiry regarding the situation, the letter could then be shared with Council with the message that the process is not adequate. Chris Nunes, seems to fit with Action item 2.1, staff flag this item for future agenda planning and Mayor/City Manager . Provide feedback to Council on trends and areas of concern, including all institutions, organizations, etc. that falls within the City of Eugene. Action 2.3, task 3 clarification requested by Michael Kinnison. Calendar Andrew Thomson calls attention to International Human Rights Day, requesting that the HRC decide the theme and begin planning. Refugee Children at the border, Fergusson police, UN Human Rights in Geneva regarding racial profiling, CERD should be highlighted at the event. Phil would like to help with planning if possible. Richie Weinman moves that the theme for international Human Rights Day be systemic and individual racism in Eugene community and relation to CERD, Chris Nunes seconds, unanimous Ken backup for Equity and Human Rights Board Andrew moves to approve, Ken seconds liaison assignments, unanimous Michael Kinnison, police commission, do you want a specific report back on votes. Might be worth providing clarification to liaison. Ken Neubeck, might be worth putting on the agenda to discuss role of Police Commissioners (who are filling HRC seat) and make sure he feels supported in his role and share info with backups. Flag for future agenda item to have a discussion with Edward. Objective Leads Phil moves to approve Objective 4, Deb Merskin seconds, unanimous 4. Staff Updates Michael Kinnison, October is the first meeting available for Council Work session on the HRC work plan, the HRNI updates are available in your packet. Nightingale Health Sanctuary group has put forward site in Whiteaker neighborhood at N. Polk and Railroad. Proposed site as a rest stop. Approved by Council but 5  determined by City Attorney to be in conflict with the ordinance that the rest stop is not eligible because it is abutting residential uses. Nightingale then requested to make the site a car camping location, under the City code this is allowed under the “car camping program”. Decision has not been made yet about the car camping request. Long term vision is to have micro housing with on-site support. A different process would be required for that, including a conditional use permit, similar to the OVE process. Jennifer Frenzer clarifies that the long term perspective for that being a health sanctuary in that particular site is not unanimous in the steering committee. The current discussion is just about a winter strategy. In the mean-time the NHS people are meeting with neighbors who have concerns while they are waiting for City determination. The long-term goal of micro-housing may happen at another location. The land is currently leased, there is 60 days notice required by either party to vacate and they are pursuing a purchase option so at least they have right of first refusal. LILA is looking at the site as a potential transition site. Councilor Evans discusses role of the Poverty and Homelessness Committee at the County and the importance of local groups like Nightingale to be engaged with that process. 5. Open Discussion Ken Neubeck, and Phil Carrasco are involved in an effort called “Kids on the Border”, guest viewpoint in the RG coming out. Mariam Malcom is chairing it. Meeting Adjourned at 7:20 pm 6 GUIDELINES FOR COMMUNITY REQUESTS FOR SUPPORT Funding Authority and Purpose (City Code Sections 2.260, 2.265, 2.280, 2.285) The Human Rights Commission may spend public money to promote its purposes and activities. Its authority to spend public money is subject to 1) Oregon law; 2) City Charter; 3) City budget constraints; and 4) City Manager/delegate approval. The commission's activities and purposes are to:  Help the City provide equal opportunity for all its citizens  Work to eliminate discrimination  Monitor the status of civil and human rights in the community  Make recommendations to the City Council in human rights areas  Support and provide programs and services that help eliminate discrimination and improve human relations, and work with other community groups and public agencies in these efforts Funding Approval Guidelines The commission's authority to spend public funds allows it to consider only requests that meet the following guidelines: Purchase of a product or service State law prohibits the City from "giving" money to another organization, regardless of the worthiness of its purpose. The commission may consider purchasing a specific product or service, such as a brochure or workshop, as long as the product or service is related to the commission's own purposes and work plan and it clearly benefits the City organization. Compliance with commission and City Council goals and policies The City cannot purchase a product or service whose provision would conflict with its goals, policies, and stated positions. Spending public tax money for a service puts the City on record as supporting that service. The commission may not sponsor events whose other sponsoring groups and organizations are incompatible with the goals and purposes of the commission and City Council. The commission does not sponsor events that are not open to the public or that are strictly fund-raising events. The commission does not support events held in locations on the Lane County Labor Council's Unfair Labor Practices List. Accessibility Commission bylaws require that events it sponsors must be fully accessible. Facilities should meet Americans with Disabilities Act standards and sign interpretation should be provided if requested. Both wheelchair access and the availability of interpretation should be included in advertisements for the event. Levels of Support Endorsement The commission may endorse specific events whose values it supports but to which it does not contribute money. The commission's name may be used in advertising for these events. A short application for this level of support must be submitted to the commission prior to use of its name. The purpose of these events must be aligned with the commission's mission and goals. Co-sponsorship The commission may provide up to $200 for events meeting the guidelines and in which commissioners will be actively involved. Active involvement means that, at a minimum, the group planning the event works directly with a commissioner who serves as a formal liaison between the group and the commission and reports back to the commission regularly. If possible, a commissioner should participate in the planning process and the commission should have an information table at the event. Time Line for Application 1. Applications should be received by staff no less than 45-days in advance of the event. 2. City staff will forward the application to the chair of the HRC for inclusion on the agenda at the HRC meeting following the date the application was received. The HRC meets at 5:30 pm the third Tuesday of every month th in the Sloat Room of the Atrium Building (99 W 10 Avenue). A representative of the requesting group is encouraged to be present at the HRC meeting the application is being considered. 4. The full commission will consider the recommendation and vote to approve or deny request for support. The Commission reserves the right to fund at a level lower than that requested. 5. Within 72 hours following the commission meeting, staff will notify the applicant of the commission's decision regarding funding or endorsement. 6. If funding is approved the applicant must provide a follow-up report to the Human Rights Commission that includes information about the planning process, numbers of participants, ways the event succeeded, and how it could be improved in the future along with an accounting of how the funds were spent. This report must be submitted within 30-days of the event. Failure to provide this report may jeopardize future funding for the event or organization.
