Approved unanimously. Minutes Review - March minutes approved with amendment to correct Councilor Groves involvement with food distribution for unhoused people and correction from Councilor Iboa to Commissioner Iboa. Approved unanimously. Public Comments No public comments offered Eugene Police Liaison Updates Lieutenant Chris Harrison discussed the 07 bias crimes reported to EPD up to March 16, 20201 and a comparison with the 12 reports made in the same period of 2020. Lieutenant Harrison presented details of some cases and answered questions presented by the commission including the type of recent incidents, location, and communities impacted. HRNI staff provided details about the support being provided to a victim of a supposed bias crime that EPD has been unable to confirm due to lack of evidence and changing narratives from the victim. Lieutenant Harrison also discussed the damaged done to a mural with civil rights leaders at the CALC office. Support request The commission approved R$1350 to support a campaign to raise awareness of reporting channels for bias crimes against the unhoused community in Eugene. The campaign is to be carried by the Homelessness and Poverty Work Group of the HRC. The work group will bring details of the campaign during the April HRC meeting. He presented the set of priorities used by the IGR committee and staff to categorize bills under discussion at the Oregon Legislature and in Congress. Fabio Andrade also presented a list of equity-related bills HRNI is tracking through the IGR process. Resolution in support of changing the 13th amendment to the US Constitution The commission approved the draft resolution (Attached). Ad Hoc Committee on Police Policy Commissioner Borson presented a summary of recent meetings taken by the Ad Hoc Committee. He answered questions regarding recommendations under discussion at the Use- of-force subcommittee. Commissioner Coulibaly asked HRC representatives at the Ad Hoc Committee to focus on the application of a Human Rights framework to their work. Work Group and Liaison updates Homelessness and Poverty Work Group – Heather Sielicki reported the work group is following discussion of the Right to Rest Act at the Oregon Legislature and COVID-19 vaccinations via white Bird, which will include a mobile clinic. The commission discussed Police Commission – Written updates were included in the meeting packet for March 16, 2021. Council Liaison Updates Councilor Groves mentioned that Council is going on break until April 12. Councilor Groves discussed the need for large designated spaces for the unhoused community to shelter. He expressed concern regarding the homelessness crisis including the large camp in the Jefferson- Washington area and the increased number of unsanctioned camps in West Eugene. Some businesses and community members have complained about the negative impacts of the homelessness crisis to their businesses and neighborhoods. He described how Council has taken some action to provide incentives to increase affordable housing units, but the rate of housing creation in much slower than the rate by which more people find themselves unhoused in Eugene. Commissioner Coulibaly questioned what members of the HRC are doing to address the homelessness crisis. Commissioner London described her engagement with the issue and the need for discussion of solutions rather than re-stating the problem. Oregon Rep. Mike Nearman Councilor Iboa described the actions representative Nearman took to support an invasion of the Oregon Capitol. Commissioner Iboa motioned for the HRC to support a petition to hold Representative Nearman accountable for his actions. Fabio Andrade also updated the commission on upcoming Belonging training for neighborhood association board members and members of other City boards and commissions. Mike Kinnison announced his resignation from the City of Eugene to pursue a career change. He expressed how much he enjoyed working with the HRC and thanked commissioners for their work. Senator Jeff Merkley has introduced an amendment to the Constitution that would eliminate the incarceration exclusion to the Thirteenth Amendment which abolished slavery.* The WeCU workgroup believes that the passage of this amendment is critical for the protection of human rights, especially for members of marginalized communities. *Penal labor in the United States is explicitly allowed by the 13th Amendment of the U.S. Constitution: "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction." ... As the City’s Intergovernmental Relations Manager, I wanted to take a moment to share some information regarding public testimony during this Oregon Legislative Session and to provide my contact information in case you have any questions. Your volunteer service to the City of Eugene is very important to City leadership, staff, and the elected City Councilors. Thank you for volunteering your time to work on important City policies and projects. As passionate advocates for the issues that you care about, you may occasionally be interested in providing testimony to the Oregon Legislature or a Rule Making Committee for a state agency. With this in mind, I wanted to provide you with a copy of Resolution 4908 which outlines the rules for providing testimony or making funding requests on behalf of the City - that is, in your capacity as a member of a City board or commission. The Resolution provides that generally if you are testifying on behalf of the City, or representing the City, your testimony must first be approved by the City Council and be consistent with the City’s adopted policies. You are always free to testify as an individual, but in that case your testimony should clearly state that you are speaking on your own behalf and not for the City. If you wish to testify on behalf of your board or commission you should bring that request to the full board/commission for review, modification (if necessary), and approval. Then the board or commission chair would need to bring that request to the City’s IGR Manager, the Chair of the IGR Committee, or the assigned Council Board/Commission Liaison for review, modification (if necessary), and approval by the IGR Committee. The IGR Committee serves as a Standing Committee for Council on policy advocacy items, and under the Working Agreements can approve these types of requests, with a unanimous 3-0 vote. If there is any dissension by an IGR Committee member, then the issue will be brought before the full City Council for review, modification (if necessary), and approval. As you can see, there is a robust process in place to ensure that the City has one clear and consistent voice with respect to our position and priorities when engaging at the state and federal level. The City Council of the City of Eugene finds that: A. Under the Eugene Charter, it is the exclusive role of the City Council to set legislative policy for the City. 4139 B. On September 13, 1989 the City Council adopted Resolution No. establishing policy governing testimony and funding requests by City representatives. C. The City Council has determined that Section 7 of Resolution No. 4139 should be repealed. D. The Council finds that Resolution No. 4139 should be repealed in its entirety, and its provisions, other than Section 7, be readopted as hereinafter set forth as City policy governing testimony before the Federal government, the Legislative Assembly of the State of Oregon or its committees, State agencies, or municipal corporations, and submission of funding requests to such entities. Any officer, employee or agent of the City, the Mayor, or a member of the Councilor a City board or commission may take a position before or request from funding administrative staff of State agencies, municipal corporations, the Federal government, or private foundations without prior approval of the Council, but must declare that consideration and approval of the Council has not been obtained if that is the case. This declaration need not be given if the position or funding request presented represents application of previously adopted Council policies with respect to the issue being considered. Section 6. If the City Manager, or his or her designee determines it is important that the City of Eugene speak on a legislative issue or apply for available funds and the hearing schedule or funding application deadline does not permit prior Council approval, the City Manager or his or her designee is authorized to speak on behalf of the City of Eugene after consultation with the Council Legislative Committee Chair. Summaries of all testimony delivered or funding applications submitted under this section shall be provided to the Council. Section 7. This Resolution is not to be construed to abridge the rights of individuals to testify in their own names. Section 8. The provisions of this Resolution do not apply to testimony before an agency or court in a quasi-judicial or judicial proceeding. Section 9. Copies of this Resolution shall be distributed to the departments, boards and commissions of the City of Eugene and, as deemed appropriate by the City Manager, to the Federal government, State Legislative Assembly, State agencies, municipal corporations, and private foundations before presentation of testimony or funding requests.
