Crow Rd Study Area & Irving Rd/Eagles (City Files MA 13-2, RA 13-1, Z 13-7)
The Eugene and Lane County Planning Commission will hold joint deliberations on a
package of efficiency strategies to accommodate more housing inside the existing
urban growth boundary (UGB). The Lane County Planning Commission is
participating in the Metro Plan amendments proposed on land outside of the city
limits but inside the UGB (e.g. within the Crow Road Study Area and the Irving
Road/Eagles site). These are the only two sites that will be the focus of
deliberations on December 3rd.

ACTION REQUESTED
Hold a joint Eugene and Lane County Planning Commission work session to deliberate and
provide a recommendation to the Eugene City Council and the Board of County Commissioners
on city initiated Metro Plan Diagram Amendments, and corresponding refinement plan
diagram/text amendments and zone changes as part of Envision Eugene. The Lane County
Planning Commission is only participating in those re‐designations proposed on land outside
the city limits but inside the UGB (e.g. within the Crow Road Study Area and the Irving
Road/Eagles site). These are the only two sites that will be the focus of deliberations on
December 3rd, and are therefore the only two sites that are addressed in this Agenda Item
Summary.
BRIEFING STATEMENT
As part of Envision Eugene, the city’s plan to establish a new Eugene‐only urban growth
boundary (UGB) and accommodate the next 20 years of growth in our community, the City
Council initiated land use re‐designations to accommodate more of the 20 year housing need
inside the current UGB.
Only two of five sites proposed for re‐designation will be considered at the December 3rd
Planning Commission deliberations. They are discussed in more detail below. The remaining
three sites will be addressed at the Eugene Planning Commission work session on December 16
and include:

BACKGROUND
The Eugene and Lane County Planning Commissions held a joint public hearing on November
19, 2013 to consider the proposed Metro Plan diagram amendments and associated refinement
plan amendments and zone changes. A total of 18 people testified at the public hearing; 3
testified regarding the Crow Rd Study Area and 2 testified regarding Irving Rd/Eagles. Following
the close of the public hearing, the record was left open for the various sites. The following
summarizes when the record was/will be closed and the amount of additional testimony that
was received. The additional testimony received for these sites as of Nov. 22, 2013 was
forwarded to the Planning Commission under separate cover and can be viewed at the website
at the end of this memo.

Following the close of the public hearing, the Planning Commissions asked staff to respond to
several issues raised in testimony. Staff responses are provided in Attachment B. For the
preliminary findings, refer to the draft included in the Nov 19, 2013 Planning Commission
meeting materials.
The proposed package of re‐designations and corresponding refinement plan and zone changes
directly implement several Envision Eugene strategies under the housing affordability and
compact development pillars. Specifically, these amendments achieve the following Envision
Eugene strategies in italics:
Accommodate more of the single‐family housing need inside the current UGB:

Re‐designate selected areas that are more suited to single‐family housing than
multi‐family housing. (Housing Affordability pillar, strategy 3.a)
Promote compact development and denser housing types (e.g. multi‐family housing)

RECOMMENDATION/NEXT STEPS
Staff recommends that the Planning Commissions review the testimony and the staff
recommended clarifications, and provide any suggested revisions before recommending
approval of the proposed Metro Plan amendments and corresponding refinement plan
diagram/text amendments and zone changes.

Subject: Staff Response to Testimony/Planning Commission –
Residential Re‐designations: Crow Road & Irving Rd/Eagles
This memo addresses major themes that have been raised in public testimony as part of the Residential
Re‐designation proposal process, as well as those raised by the Planning Commission. The issues are
identified in bold below, followed by staff response. This memo only addresses those comments related to
the joint city and county sites; Crow Road Study Area and Irving Rd/Eagles.
Crow Road Study Area
1. Public Involvement Process
Planning Commission asked what the timeline was for notification to property owners regarding the
current proposal and if they were allotted the same opportunities to change the re‐designation proposed
on their property.
Over the course of the Crow Road re‐designation planning process seven direct mailings, three meetings,
three questionnaires, two Planning Commission work sessions, and countless emails and phone calls have
provided property owners with step by step project information and opportunities for involvement and
input. Several different iterations of the proposed land use concept plans have been shared with property
owners and are attachments to this memo. The map that was mailed to property owners in August of
2013 clearly shows the concept for additional Medium Density Residential from previous proposals.
Specific letters, meetings, and emails requesting input and providing updates on the process included:
1. June 2011‐ Initial letter to property owners presenting Envision Eugene Low Density Residential
(LDR) land deficit and inquiring about interest in re‐designated to LDR.
2. Dec 2011‐ Letter to property owners regarding and announcing January 2012 meeting.
3. Jan 2012‐ Meeting and questionnaire to present re‐designation opportunity and gather input on
locations for future land uses and future development concepts.
4. July 2012‐ Letter to property owners with questionnaire and map regarding where future land
uses should be located and future development concepts.
5. Sept 2012‐ Meeting and questionnaire to present and gather input on Sept 27, 2012 locations for
future land uses and future development concepts. See Map 1: Draft Concept Plan (9/27/12).

2. Increase in amount of Medium Density Residential (MDR) Designation from Earlier Drafts
Planning Commission and public testimony asked why the amount of Medium Density Residential
proposed to remain was increased from earlier versions of the draft concept plan.
In continued discussions with the property owner on the east side of the study area (Owens), the
property owners informed staff that they would like to retain more of the MDR on their properties.
Specifically, they are interested in retaining more MDR on the flattest portion of their property to
make up for the cost of mitigating the development of wetlands on their site.
The property owners of the largest area proposed for retaining MDR (DAG Trust) note in their
testimony that keeping 2/3 of the property as MDR and re‐designating 1/3 of the property to LDR
fits well with their desire to have their land outside of the UGB brought into the UGB for single‐
family residential. Their concept plan provided in their testimony also shows significant parks and
open space; staff notes that retaining more MDR can help offset those costs.
Given these conversations, the MDR is shown mostly in the flatter portions of these lots, near the
major streets and planned commercial area.
3. Public testimony Requesting to Retain Additional Medium Density Residential
One additional property owner on the western side of the site (St. Jacques’) has indicated that they would
like to retain their entire property with the existing MDR designation and rezone to R‐2. If additional
testimony is submitted before the close of the record on Nov. 27, 2013, staff will provide this information
prior to Planning Commission deliberations on Dec 3.
4. Is the Property to the South of the Crow Road Study Area Proposed for UGB Expansion
Planning Commission asked whether the property to the south of the Crow Road Study Area is proposed
for a potential UGB expansion area. On June 14, 2012, the City Council directed staff to study four areas
for a potential residential UGB expansion. One of those areas is known as the DAG Trust property. It is
about 207 acres south of the Crow Rd Study Area and south of the urban growth boundary (UGB). Staff
has initiated environmental studies of all four potential expansion areas. Additional analysis of the
potential expansion areas is not anticipated until the work on the single‐family efficiency strategies, such
as these proposed re‐designations, is completed. Once complete, the actual amount of single‐family homes
that cannot be accommodated inside the current UGB will be refined which will inform how much acreage
is need for expansion. As such, the DAG Trust property to the south of the Crow Rd Study Area as well as
the three other UGB expansion study areas are still under study.
5. Effects of Envision Eugene on tree removal for properties to the south of the Crow Road Study
Area
Public testimony was received indicating that tree removal is occurring on property south of the UGB
(and south of the Crow Rd Study Area); possibly as a result of Envision Eugene work. The property that
was described is not one of the four areas being studied for a potential residential UGB expansion in
Envision Eugene. The properties are within the county and designated as forest land. Tree removal is a
regular use of forest land and is subject to county regulations.
6. Planning Crow Road Study Area with Potential UGB Expansion Area
Public testimony from the DAG Trust property owner states it would be prudent to blend the planning
efforts for both the Crow Rd Study Area re‐designation work with long‐range planning that would be in
conjunction with any UGB expansion area in the DAG Trust property south of the UGB (referred to as the
Willow Creek Hills Expansion Property in the testimony), should this property be selected for inclusion
into the UGB. Staff doesn’t disagree that it would be ideal to plan the area inside the UGB with the area
outside the UGB if the area south of the Crow Rd Study Area was selected for inclusion into the UGB.
However, the amount of land re‐designated to low density residential (LDR) directly affects the amount of
UGB expansion for LDR that is needed. Therefore, by necessity the amount of re‐designation to occur

inside the UGB (e.g. in the Crow Rd Study Area) needs to be completed before planning a UGB expansion
area can begin. That said, long‐range planning in conjunction with any UGB expansion area will
incorporate any long range planning for adjacent land, such as the Crow Road Study Area.
Irving Rd/Eagles
1. Public Involvement Process
Planning Commission asked what the timeline was for notification to and input from the adjacent
property owners/residents regarding the proposed re‐designation.
1. The Envision Eugene Recommendation was presented in March 2012. The Irving Rd/Eagles site
was not identified in that recommendation as a potential re‐designation area.
2. The Westside Baptist Church bought the property and submitted for a modification to the existing
conditional use permit (CUP) on the property to change the use from a fraternal use (Eagles
Lodge) to a religious use in December 2012. The application materials noted the intended use for
a portion of the property for a subdivision.
3. Public notice of the proposed CUP modification occurred in May 2013 with a decision approval
the proposed modification sent in June 2013.
4. Staff contacted the property owner around June 2013 regarding if they are intended for part of
their property to be used for housing in the future, which they confirmed. The property owner
indicated that they were intending to pursue re‐designation in preparation for a future
subdivision.
5. Staff sent a letter to adjacent property owners and residents within 300’ of the property in June
2013 notifying property owners that the city has a projected deficit of Low Density Residential
Land, that the Westside Baptist Church have indicated that they do not need the entire golf course
area (approximately 11 acres) for the church use (see map on reverse) and that the city is
considering re‐designating the site to Low Density Residential. The letter also included contact
information as well as notification of the Planning Commission’s July 8, 2013 Residential Re‐
designation work session. Staff also sent an email to those who submitted comments (by email) on
the CUP modification.
6. Several emails and phone calls were received in response to the above letter, most in opposition
due to concerns regarding development (number of homes, traffic), loss of open space, historic
significance of the site.
7. The Planning Commission held July 2013 Residential Re‐designation work sessions which this site
was discussed.
8. Staff met on‐site on July 26, 2013 with city Parks and Open Space (POS) staff, property owner
representatives, and an adjacent neighbor to explore the possibility of a park acquisition at this
location and hear neighborhood concerns regarding the proposed re‐designation.
9. The property owner requested time on the Santa Clara Community Organization’s August agenda
to discuss future development of the site. Prior to and after the meeting, staff coordinated with the
neighborhood leader on questions.
10. In October, staff emailed those who had previous inquired about the proposed re‐designation
(and had given an email address) updating them on future Nov. 19 public hearing to re‐designate
the site and the on‐going discussions with POS staff regarding potential park acquisition.
11. Notification of the Residential Re‐designation public hearing was sent to all property owners and
residents within 500’ of the proposed re‐designation/rezoning sites. Four letters were received in
opposition to the Irving Rd/Eagles re‐designation and two in support (including property owner)
prior to the Nov 19 public hearing.

Planning Commission asked for the background and timing of the existing land use approvals on this site.

1. Conditional Use Permit file no. CU 87‐16 was approved for a clubhouse expansion and golf course
for the Eagles Lodge in 1987.
2. In December of 2012, the new property owner Westside Baptist Church applied for a modification
(file no. MDR 12‐10) of that approval to change the use from a fraternal organization to a church
use and allow for future building additions.
3. The CUP modification was approved June 2013 and with no appeals, became effective July 2013.
4. In July 2013, Westside Baptist Church submitted an annexation application. That application is
pending.
3. Impact to Schools
Planning Commission and public testimony asked what the impact to schools would be due to re‐
designation of this site to LDR. Bethel School District has indicated that there is current adequate space at
the schools in that attendance area (Irving Elementary School, Shasta Middle School, and Willamette High
School. Additionally, Bethel School District is involved in long range planning that forecasts an increase in
enrollment in the district and is making plans accordingly.
4. Historical Significance
Planning Commission and public testimony asked whether or not the site has historic significance. Public
testimony also noted the proximity of the site to the former Chambers family house. The city’s historic
preservation regulations apply if the building/site is a city landmark or on the National Historic Register.
A building/site that is privately owned can only be nominated to be a city landmark or on the historic
register by the property owner. The Irving Rd/Eagles site is not currently a city or national historic site.
Regarding the former Chambers family house, it is on the National historic register and is located near the
subject property, to the east (see red triangle on map below):

5. Vehicle Trip Cap
Planning Commission and public testimony asked for clarification regarding the trip cap. Specifically,
clarification was requested regarding what the trip cap is, how it would be enforced, when/how it can be
removed, and clarifying whether a future developer would have to do a traffic analysis.

Transportation Planning Rule Background
The trip cap is a result of addressing the requirements of Statewide Planning Goal 12 and the
Transportation Planning Rule (TPR). The TPR provisions are required to be addressed as part of any
proposed comprehensive plan amendment (in this case, a change in the land use designation on the Metro
Plan diagram) or zone change (in this case, zone changes associated with the proposed Metro Plan
amendments). The applicable TPR provision in this case (Oregon Administrative Rule 660 012
0060(1)(c)), requires a determination of whether the future traffic projected as a result of the proposed
plan amendment will significantly impact (e.g. negatively impact) any existing or planned transportation
facilities (streets, intersections). This TPR provision also allows provides that it can be determined that
there is no “significant effect” on a transportation facility if an enforceable, ongoing requirement is
imposed that would demonstrably limit traffic generation on the site. The proposed trip cap is such a
requirement. In this case, enough analysis has been done to know that the proposed designation is
projected to generate more traffic than the existing designation. The trip cap is intended to be a
temporary measure, limiting traffic generated by new development on the site until the city’s
transportation system plan is updated, which will include the street and intersection level analysis and
identification of any mitigation (e.g. transportation projects) necessary for the transportation system to
support the future housing assumed for these sites. The trip cap is being proposed at this time so that the
re‐designations can be adopted while not getting ahead of the street and intersection level analysis and
identification of any necessary mitigation, which will be completed as part of updating the TSP.
Trip Cap Implementation
It is anticipated that the trip cap requirement would be imbedded in the ordinance that re‐designates the
property. The intent is that the trip cap will be temporary until the city’s long‐range transportation
system plan (TSP) called TransPlan is updated. As such, as part of the re‐designation ordinance two
options to remove/modify the trip cap in the future would be identified; both of the options include a TPR
analysis demonstrating that the new designation does not significantly affect an existing or planned
transportation facility or, if there is a significant effect, includes the necessary mitigation of that effect.
One option to remove the trip cap will be adoption of the TSP. While Envision Eugene plans for the city's
housing and employment needs over the next 20 years, the updated TSP will address Eugene's
transportation needs to support the projected housing and employment. That update will include the
street and intersection level analysis needed to address the TPR, including identification of any mitigation
needed. In the event that the property owner wants to develop before the TSP is adopted, a second option
will be identified in the ordinance allowing the trip cap to be removed/modified if a traffic analysis is
completed through a land use application process to determine whether, without the trip cap or with a
modified trip cap, any existing or planned transportation facilities will be significantly affected by the
designation change and, if effected, the needed mitigation.
In response to a specific Planning Commission comment, the findings will be revised to clarify the
temporary intent of the trip cap (revisions underlined) for both Irving Rd/Eagles and Willamette St/Rest‐
Haven as follows:
The city proposes to temporarily cap the allowed number of trips generated from the subject
property at the existing allowed trip generation rate of... (pages 13 and 15)
This analysis and, if necessary, adoption of mitigation measures, would occur as part of the City’s
update to its Transportation System Plan (TSP) or could occur through a separate process. (pages 14
and 15)
6. Transportation System Plan Update & Timeline
The city’s long‐range transportation system plan (TransPlan) is currently being updated. The project
started in 2010 and is anticipated for local adoption by the end of 2014. It is anticipated that the Envision
Eugene land use diagram (including whatever designation changes are adopted as part of this Residential
Re‐designation package) will be analyzed in mid‐ 2014.

7. Fire, Life, Safety Considerations
Planning Commission asked if fire, life, and safety concerns had been part of the considerations in
exploring this site for re‐designation to LDR. Any site within the UGB is served by either city or county
police and fire, depending on if it is annexed. Currently, the site is not annexed. However, the intent is for
future housing on the site. Prior to subdivision, the site will be required to annex into the city limits. Both
the annexation application as well as any future subdivision is referred to the Eugene Fire Marshal’s
Office to ensure that the specific development proposal includes adequate emergency provisions.
8. Status of Park Discussions
Planning Commission asked what the status is of the potential acquisition of a portion of this site for a city
park. Parks and Open Space staff are still in discussions with the property owner with the intent of being
able to secure a park site at this location. The discussions have been around a park of 2 acres or less and
the details are still being worked out.
