International numbers available: https://eugene-or-gov.zoom.us/u/acRDLxDSxE Page 2 of 6  AGENDA ITEM SUMMARY December 14, 2021 To: Eugene Planning Commission From: Terri Harding, Principal Planner & Project Manager Jeff Gepper, Senior Planner & Land Use Code Lead Sophie McGinley, Assistant Planner & Public Engagement Lead Subject: Middle Housing Code Amendments (CA 21-1 & MA 21-1) Deliberations ACTION REQUESTED At this work session, the Planning Commission will continue deliberations on the draft land use code and plan amendments to implement the requirements of ORS 197.758 (House Bill 2001 (2019)). BACKGROUND The Eugene Middle Housing Code Amendments project implements Oregon House Bill 2001 (2019), which requires large cities such as Eugene to allow middle housing including duplexes, triplexes, fourplexes, cottage clusters, and rowhouses, in more places across the City, to increase housing choice and supply. By June 30, 2022, the City must have regulations in place that comply with state law. Otherwise, the state’s adopted model code will apply in Eugene. Based on 10 months of community engagement, technical analysis and work sessions with the Planning Commission, the project team developed a draft set of land use code and plan amendments (September 21, 2021) to implement House Bill 2001. The Guide to the Adoption Process includes background information, summaries of proposed code changes, and how to get involved. The Guide has been broadly distributed and posted on the project website and serves as a reference that summarizes the choices for various code sections along the Allow, Encourage, and Incentivize spectrum. In general, the Allow option meets the state’s minimum standards, the Encourage option removes barriers to middle housing, and the Incentivize option removes even more barriers and lowers the cost of providing housing. The Planning Commission held a public hearing on the draft amendments on November 16, 2021. Following the public hearing, the Planning Commission voted to hold the record open until 5:00 pm on November 29, 2021 for written testimony. Public comments can be found on the project website in batches. Copies of all testimony received through 5:00pm on November 29, 2021 has been provided to the Commission, and a staff summary of public testimony themes is included as Attachment A to the Commission’s December 7 Agenda Packet. Page 3 of 6 Deliberations Approach Since the initial draft code amendments were published on September 21, 2021, staff have continued to review the code as well as public testimony and Commission comments. A set of staff recommended changes, based on public testimony and staff review was included in the Commission’s November 30 meeting packet. Based on the outcomes of the November 30 deliberations, staff prepared Version 2 of the draft code amendments, which incorporated the staff recommended changes. Version 2 of the draft code was published in the Commission’s December 7, 2021 meeting packet. Deliberations began on November 30, 2021 and continued on December 7, 2021. The items discussed on December 7 are shown below. The Commission conducted straw polls to determine their recommendation on the following specific items: 1. Continue Definitions 2. Middle Housing Lot Standards and Design Standards a. Duplex b. Triplex & Fourplex c. Townhouse d. Cottage Cluster 3. Parking Reductions 4. Small Unit Incentives 5. Tree Preservation and Removal Standards Through a series of straw polls, the Commission voted to support the recommended amendments for the above topics. Two items were pulled for further discussion at a future meeting. These include alterations to design standards based on Commissioner Taylor’s comments and changes to cottage cluster height (25’ or 2 stories not to exceed 30’). Version 2 of the draft code, dated December 2, 2021 with changes agreed to by the Commission on November 30, 2021 incorporated, is available on our website. Topics for the January 11, 2022 deliberations will also include anything not yet finished. The January 25, 2022 meeting is dedicated to the Commission wrapping up its recommendation and letter to City Council. Staff is working to schedule a joint meeting with Council ahead of their public hearing, anticipated for March 2022. The project website and Engage Eugene page and are frequently updated with opportunities to engage community members and provide information about middle housing in Eugene. NEXT STEPS Following Planning Commission’s deliberations and recommendation, City Council will hold a public hearing, anticipated for March 2022. The City must have regulations in place by June 30, 2022 that comply with state law, or the state’s model code will apply directly. ATTACHMENTS A.
