AGENDA UPDATE Dianne Kramer, Acting City Manager, informed the Commission that Ordinance No. 14-01 will need to be heard before Ordinance No. 14-02, although that is not how it is shown on the agenda. She reported that the City had received letters of objection to Ordinances 14-10, 14-11, 14-12, 14-17 and 14- 18 and stated that the City Attorney will be recommending the Commission continue indefinitely the consideration of those ordinances to allow time for the City to respond to those process concerns. II. APPROVAL OF MINUTES 14104 March 6, 2014- Regular City Commission Meeting March 6, 2014 - City Commission Workshop March 13, 2014- City Commission Workshop A motion was made by Commissioner Holland, seconded by Vice-Mayor Eckian, to Approve the Minutes. The motion carried by the following vote: Aye: 5 - Vice-Mayor Eckian; Commissioner Holland; Commissioner LeHeup-Smith; Commissioner Muenzmay; and Mayor Bob III. AUDIENCE TO BE HEARD Emily Lee, 705 E. Washington Ave. and representing the Bates Avenue Neighborhood Improvement Council, thanked the Commission for their participation in the opening and support of the new Community Garden. She commented on the Council's efforts to combat childhood obesity and invited the public to participate in the garden. She stated the plots are being offered for a cost of $20. Gregory Lucas, 215 Laurel Oak Dr. and one of the dealers from the City's farmer's market, thanked the Commission for the opportunity and asked that it be continued. He noted problems with the weather during the time it was open and conflicts with other open markets. CONSENT AGENDA 14100 Resolution No. 14-20: Foreclosure Authorization- 1411 Johnson Street, Case #13-033 14101 Resolution No. 14-21: Release of Lien, 836 Edgewater Circle 14102 Acceptance of Comprehensive Annual Financial Report (CAFR) for the Year Ended September 30, 2013 The Commission commented on the answer to the Management Letter in the CAFR and expressed concern regarding the statement about "adjusting business practices and personnel responsibilities as recommended by the third party consultant". It was stated that the Commission did not want to commit to whatever the third party consultant says in case the City does not think it is appropriate. Dianne Kramer, Acting City Manager, assured the Commission that the City would evaluate their recommendations prior to any implementation. The Commission confirmed with the City Attorney that the Consent Agenda did not need to be opened for public comment since an item was discussed. A motion was made by Commissioner Holland, seconded by Commissioner Muenzmay, to Approve the Consent Agenda. ORDINANCES, PUBLIC HEARINGS & QUASI-JUDICIAL HEARINGS 14103 Resolution No. 14-22: Gateway Corridor Improvement Matching Grant Program Derek Schroth, City Attorney, announced Resolution No. 14-22: A Resolution ofthe City Commission of the City of Eustis, Florida; Establishing a Corridor Improvement Matching Grant Program and Authorizing the Use of $45,000 of the Economic Incentive Budget to Provide Funding for the Program. Dianne Kramer, Acting City Manager, explained the proposed matching grant program stating $45,000 would be allocated for the current budget year for matching grants to be used for facade improvements along the major corridors. She cited the area to be included in the program as follows: SR 19 from Hwy. 441 to Pendleton and Orange Avenue between Bay Street and Abrams Road. She reviewed some of the eligible expenses and noted that the grants would be awarded on a first come, first serve basis. The Commission discussed eligibility and asked if a property owner with more than one parcel could apply multiple times with Ms. Kramer stating that, as proposed, the program restricts each property owner to one award per year. The Commission discussed that additional properties would probably be rentals or commercial property. Mr. Schroth opened the public hearing at 6:15p.m. Kevin Jenness, 36309 Brendenshire Court, Grand Island, and Peddler's Wagon, expressed support for the program and concern regarding not allowing the funds to be used for landscaping. Sean Jenness, 25 E. Magnolia Ave. , expressed opposition to including parking lot paving and providing funding to private property owners that have not kept up their property. A motion was made by Commissioner Muenzmay, seconded by Commissioner Holland, to approve Resolution No. 14-22 with the following amendments: Add landscaping and irrigation to the Eligible Expenditures with a $450 cap for the landscaping and remove Item #2 from the Program Guidelines. Lori Barnes, Senior Planner, explained the request for annexation of the property which is under contract to be sold to the Unitarian Universalist Church for development as a church property and will be followed by the related comprehensive plan amendment and design district designation. Mr. Schroth explained staff is also recommending continuance of Ordinance No. 14-17 due to a letter of objection that was delivered Sunday evening. Mr. Schroth opened the public hearing at 6:32p.m. Mr. Ardaman, Fishback Dominick law firm, presented three submittals including a letter addressed to the Mayor dated March 17, 2014, signed by Attorney Dan Langley, an email from Mr. Langley to Mr. Schroth and 20 maps. He stated their firm's request that the Commission either withdraw or deny Ordinances No. 14-17 and 14-18. Mr. Schroth opened the public hearing at 6:34p.m. Mr. Ardaman stated his firm 's same objections and submittals from Ordinance No. 14-17 also apply to Ordinance No. 14-18. Joan Bryant, President of Trout Lake Nature Center, expressed opposition to Ordinance No. 14-18 citing the condition of the property and expressing environmental concerns. She asked the Commission deny the ordinance rather than postponing and asked the Commission consider turning control of the subject property over to the Nature Center. Mr. Schroth requested that the audience refrain from applauding or booing the public comments. Linda Bystrak, President of the Ocklawaha Audubon Society, expressed support for Ms. Bryant's comments and confirmed that Trout Lake has been rated the #1 most impaired lake in the Harris Chain of Lakes according to DEP with Lake Yale #2 and Lake Denham #3. She reported that the Lake County Water Authority has appropriated $150,000 to hire consultants to study all three lakes to determine the source of the pollution. She stated the Society will also be seeking grants to help resolve the surrounding pollution issues. She commented on property north of CR 44 that was recently transferred to Lake County from the St. John's River Water Management District to be developed as a park and urged the Commission to not allow any development on the property adjoining the Nature Center. Albert Sweidler, former professor of biology, expressed his concern for the environment and asked the motivation for the change. City of Eustis, Florida Page6 Printed on 312812014 City Commission Meeting Minutes - Final March 20, 2014 Mr. Schroth explained that the hearing is for the Commission to hear public comments and that the Commission and staff are not required to answer questions at that time . Ms. Kramer stated it would be better addressed during the re-advertised public hearing so that all of the information can be provided at that time as there have been some misunderstandings and without a full presentation there may continue to be misunderstandings. Charlene Edwards, County resident, expressed support for the statements made by Ms. Bryant. Taylor Lockwood, Mount Dora resident, commented on the possible effects of noise pollution on the wildlife at the Nature Center. There being no further public comment, the hearing was closed at 6:50p.m. The Commission clarified for the public that the property in question does not intrude on the Trout Lake Nature Center property and expressed support for the Nature Center. It was further explained that the City received letters from Attorney Langley as well as email correspondence and that the City Attorney has not had adequate time to evaluate those comments and issues. The Commission also commented on the sources of pollution in that area as well as in the Wekiva Basin Protection Area particularly from agricultural sources. A motion was made by Vice-Mayor Eckian, seconded by Commissioner Holland, to continue Ordinance No. 14-18 until such time as the City Attorney and the Acting City Manager are of the opinion it is ripe for consideration. Laurel Oak Drive Mr. Schroth read Ordinance No. 14-19 by title only on first reading: An Ordinance of the City Commission of the City of Eustis, Lake County, Florida; Amending the Design District Map to Correct a Mapping Error; Assigning the Design District Designation of Suburban Neighborhood to Approximately 2.19 Acres of Real Property Located at 215 E. Laurel Oak Drive. Ms. Barnes explained staff discovered a number of errors in the City's design district map and the next three ordinances will address those errors. She emphasized that the changes are only to the design district designations and do not affect the allowed land uses which is covered by the future land use designation. She then reviewed the proposed change under Ordinance No. 14-19 stating that the subject property was annexed into the City in 1993 but was not shown on the design district map adopted in 2009 so it never received a design district designation . She stated that the proposed Suburban Neighborhood designation is consistent with the established development patterns in the area and compatible with the current use and the current land use designation. Mr. Schroth opened the public hearing at 6:59p.m. Gregory Lucas stated the property belongs to his parents and asked for an explanation of the proposed change. Ms. Barnes stated that the property owner was notified that the City was initiating the design district assignment. She explained that the property was inadvertently omitted when the Design District Map was created; therefore, the map must be amended to show that the property is in the City Limits and to provide a design district designation. Ms. Kramer explained that the ordinance does not change what the property owner can do with the property or any of the adjacent properties and merely places the property on the map. Ms. Barnes stated the Church of Jesus Christ of Latter-day Saints exists on the property and it has a future land use designation of Public Institutional which permits a variety of civic and community uses. She added that the property is shown as Conservation on the design district map. She further stated the proposed designation is Suburban Neighborhood which is consistent with the established development pattern in the area and compatible with the current use and the Public Institutional/and use designation. Dora Road Mr. Schroth read Ordinance No. 14-21 by title on first reading: An Ordinance of the City Commission of the City of Eustis, Lake County, Florida; Amending the Design District Map to Correct Mapping Errors; Assigning the Design District Designation of Suburban Neighborhood to Approximately 8.33 acres of Real Property Located at 751 Old Mt. Dora Rd. Ms. Barnes explained there is a single family home currently on the property which has a future land use designation of Agricultural and which allows both agricultural uses and residential at a density of one dwelling unit per five acres. She stated the property is currently shown as Conservation and the proposed designation is Suburban Neighborhood which is consistent with the established development patterns in the area and compatible with the current use and the current land use designation. COMMENTS City Commission Vice Mayor Eckian commented on the new Community Garden, announced an upcoming fishing tournament to be held as a fundraiser for the Eustis and Umatilla Boys & Girls Club and thanked the sponsors of the event. Commissioner LeHeup-Smith commented on the recent Wine-A-Fare benefit for the Lake Eustis Museum of Art and reported on her inaugural attendance at the Chamber of Commerce breakfast meeting noting their preliminary numbers show a slight improvement over last year for Georgefest. She cited a variety of upcoming local events including Jazzfest, the Fire Dept. groundbreaking and the Amazing Race. She expressed support for the improvements to the City's special event permit application process. Commissioner Muenzmay clarified the upcoming fishing tournament is to benefit the children but would not include the children and commented on the Jazzfest. He noted that both Sean and Kevin Jenness were thanked at the Community Garden opening for their support. Vice Mayor Eckian clarified that the time for the Fire Station groundbreaking was 11 :00 a.m. City Manager Ms. Kramer introduced Bill Johnston, Wastewater Supervisor. Bill Johnston reported to the Commission on the recent award received by the City's Wastewater Treatment Plant by FDEP and distributed to the Commission copies of a newsletter announcing the award. Ms. Kramer reported on the City's property at 300 N. Bay Street stating the paperwork is being finalized to show the lot has been cleared by DEP. She noted a recent article in the Sentinel regarding Winter Park and four Lake County cities being tops in drawing buyers for homes which did not mention Eustis; however, the zip code referenced as #3 is actually in the City of Eustis. She announced Commissioner Holland will be receiving the 2014 Community Service Award for Leadership. Commissioner Muenzmay recognized City Attorney Derek Schroth, his firm and family for their support of the local organizations and events. City Attorney Mr. Schroth reported that the City would probably be sued again and cited the letters from March 17th and 18th. He noted that there are a number of individuals that were on the Commission that hired him that are now involved in the possible litigation. He stated he would not be comfortable with litigating against a former client and recommended bringing in another attorney to represent the City. He recommended Don Hemke and stated the City already has a contract with him; therefore, the Commission will just have to authorize the use of Mr. Hemke. Due to the quick turnaround time in responding to the filing of a lawsuit, he recommended the Commission go ahead and authorize involving Mr. Hemke in the event a lawsuit is filed. CONSENSUS: It was a consensus of the Commission to authorize Mr. Hemke to represent the City in the event of a lawsuit.
