AGENDA UPDATE Tom Carrino, sitting in for the City Manager, reported that the Band Boosters had withdrawn their request to address the Commission at this time. Mayor Morin announced he would like to postpone consideration of the Home Rule resolution to a workshop and invite a member of the legislative delegation. He explained the purpose of the resolution was to express the City's support or nonsupport of an issue. He asked for a consensus of the Commission to postpone the resolution . CONSENSUS: It was a consensus of the Commission to schedule a workshop and invite a member of the legislative delegation and the League of Cities to attend. II. APPROVAL OF MINUTES 16453 September 7, 2017- Regular City Commission Meeting September 21 , 2017 - City Commission Workshop September 21, 2017 - Regular City Commission Meeting A motion was made by Commissioner Sabatini, seconded by Commissioner Gnann- Thompsen, that the Minutes be Approved. On a voice vote, the motion passed unanimously. III. PRESENTATIONS 16455 Proclamation declaring October 17, 2017, as "White Cane Safety Day" Mayor Morin presented a proclamation declaring October 17, 2017, as "White Cane Safety Day" to Chantel Buck, CEO, New Vision for Independence. 16463 Presentation by EHS Band Boosters regarding Annual Jazz Band Revue This item was withdrawn from agenda at the request of the Band Boosters. I'V. AUDIENCE TO BE BEARD Gail Isaac Thomas addressed the Commission regarding the recently installed streetlights. She thanked them for the new lights but noted that Kensington Street is still very dark. She also thanked the City workers for all their work following the hurricane. He asked staff to find out how soon that street might be cleared. Erin Bailey, City Events Coordinator, provided an overview of the upcoming City events including the following: 1) First Friday featuring the Jeff Howell Blues Band; 2) the annual Cruisin' Couples Car Show and Concert on Saturday, October 7th; 3) the 2018 Georgefest to be held February 23 - 25, 2018; and 4) the Annual Lake County Folk Festival on October 14 and 15. Commissioner Sabatini announced the Eustis Service League Buncoween fundraising event to be held October 20th at the Community Center. He noted they award scholarships to Eustis High School students. V. APPOINTMENTS 16461 Reappointment to Eustis Housing Authority Board - James Trent Mary Montez, City Clerk, explained Mr. Trent was appointed in January 2016 to a partial term. The Housing Authority Board and Mr. Trent are requesting his reappointment to a full term to expire September 17, 2021. James Trent addressed the Commission and commented on his experience with the Housing Authority. A motion was made by Commissioner Sabatini, seconded by Commissioner Gnann- Thompson, that James Trent be reappointed to the Eustis Housing Authority Board of Directors. On a voice vote, the motion passed unanimously. VI. CONSENT AGENDA 16457 Memorandum of Agreement for Early Voting Site - 2018 16462 Resolution No. 17-66: Budget Amendment Recognizing Unanticipated Revenues and Expenditures due to Hurricane Irma A motion was made by Commissioner Bob, seconded by Commissioner Gnann-Thompson, to Approve the Consent Agenda. The motion carried by the following vote: Aye: 5 - Vice-Mayor Aliberti ; Commissioner Bob; Commissioner Gnann-Thompsen ; Commissioner Sabatini; and Mayor Morin VII. ORDINANCES, PUBLIC HEARINGS & QUASI-JUDICIAL HEARINGS 16456 Resolution No. 17-63: Building Permit and Inspection Fee Schedule Derek Schroth, City Attorney, announced Resolution No. 17-63: A Resolution of the City Commission of the City of Eustis, Florida; rescinding Ordinance No. 10-08 and establishing an amended schedule of building permit and inspection fees to be kept on file in the City Clerk's office per Section 118-19 of the Land Development Regulations; and providing an effective date. Lori Barnes, Development Services Director, presented the proposed amendments to the building permit and inspection fee schedule as follows: 1) Adds new categories to offer options that expedite projects: Early start permit ($1 00 resident and $200 commercial); Master plan filing for $50 and a General Permit for $25 for jobs not specified with a cost less than $1 000; and 2) Adds a contractor registration to clarify the City does not collect a fee. She reviewed the proposed fee schedule amendments as follows: 1) Sign permits based on size and type; 2) Sliding scale for fences and utility buildings based on the cost of the project or size of the shed; 3) Increasing single family plan review City of Eustis, Florida Page2 Printed on 1011012017 City Commission Meeting Minutes - Final October 5, 2017 fee from $100 to $250 to better cover staff costs; and 4) Increasing fee imposed for starting work without permits from $100 to $150. She noted the costs charged by surrounding cities. The Commission questioned what is the typical type of project started without a permit with Ms. Barnes providing an example of a recent incident involving a demolition. She indicated that contractors are aware they have to have a permit before tearing out walls. She stated staffs recommendation for approval. She noted that adding the lower cost permit options for minor projects, smaller signs and early start permit opportunities will help both homeowners and businesses. The Commission discussed the possibility of approving the resolution minus any fee increases. Mr. Schroth opened the public hearing at 6:26p.m. There being no public comment, the hearing was closed at 6:26p.m. MOTION: Commissioner Sabatini moved to approve Resolution No. 17-63 with the removal of any permit increases. The motion failed for lack of a second. The Commission commented on the master plan permit and how it would speed up the process. A motion was made by Commissioner Bob, seconded by Commissioner Gnann- Thompsen, to Approve Resolution No. 17-63. The motion carried by the following vote: Aye: 4- Vice-Mayor Aliberti; Commissioner Bob; Commissioner Gnann-Thompson; and Mayor Morin Nay: 1 - Commissioner Sabatini 16459 Resolution No. 17-64: Expressing Support for "Home Rule" in Florida and Opposition to the Erosion of "Home Rule" Powers by the State and Federal Government Postponed by Commission to a workshop or town forum. 16460 Resolution No. 17-65: Appointing Alternate Member to Lake-Sumter Metropolitan Planning Organization (MPO) Governing Board Mr. Schroth announced Resolution No. 17-65: A Resolution by the City Commission of the City of Eustis, Lake County, Florida, appointing an Alternate Member to the Lake-Sumter Metropolitan Planning Organization Governing Board. The Commission discussed who wanted to serve as the Alternate Member to the Lake-Sumter MPO Governing Board with Commissioner Sabatini and Vice Mayor Aliberti both volunteering. Mr. Schroth opened the public hearing at 6:29p.m. There being no public comment, the hearing was closed at 6:29p.m. A motion was made by Commissioner Gnann-Thompson, seconded by Commissioner Bob, to Approve Resolution No. 17-65 and appoint Vice Mayor Aliberti as the Alternate Member to the Lake-Sumter MPO Governing Board. The motion carried by the following vote: Aye: 4 - Vice-Mayor Aliberti ; Commissioner Bob; Commissioner Gnann-Thompson ; and Mayor Morin Nay: 1 - Commissioner Sabatini City of Eustis, Florida Page3 Printed on 1011012017 City Commission Meeting Minutes - Final October 5, 2017 SECOND READING 16448 Ordinance No. 17-12: Amendment to the Code of Ordinances, Chapter 46 - Historic Preservation Mr. Schroth read Ordinance No. 17- 12 by title on second and final reading: An Ordinance of the City Commission of the City of Eustis, Florida; amending Chapter 46, Historic Preservation, of the City Code of Ordinances, to provide for changes to procedural requirements; exceptions for fences and shutters; rename Article V to the Eustis Central Business District Building Design Standards; provide new geographic boundaries; determine Historic Preservation Board duties; providing for codification, severability and an effective date. Mr. Schroth opened the public hearing at 6:30p.m. There being no public comment, the hearing was closed at 6:30p.m. A motion was made by Commissioner Gnann-Thompson, seconded by Commissioner Bob, to Adopt Ordinance No. 17-12 on second reading . The motion carried by the following vote: Aye: 5 - Vice-Mayor Aliberti ; Commissioner Bob; Commissioner Gnann-Thompsen ; Commissioner Sabatini ; and Mayor Morin 16447 Ordinance No. 17-13: Allowing an Extension of the Flow Evaluation Period for New Industrial Uses and Expansions Mr. Schroth read Ordinance No. 17-13 by title on second and final reading: An Ordinance of the City Commission of the City of Eustis, Lake County, Florida, amending certain sections of the Code of Ordinances regarding an extension of the now evaluation period for new industrial uses and expansions; providing for codification; and providing for an effective date. Mr. Carrino clarified the now evaluation period is for postponement of the impact fees only. The customer still pays their water and sewer bill, they just postpone payment of the impact fees. Mr. Schroth opened the public hearing at 6:32p.m. There being no public comment, the hearing was closed at 6:32p.m. A motion was made by Commissioner Bob, seconded by Commissioner Gnann-Thompson, to Adopt Ordinance No. 17-14 on second reading. The motion carried by the following vote: Aye: 5- Vice-Mayor Aliberti; Commissioner Bob; Commissioner Gnann-Thompsen ; Commissioner Sabatini ; and Mayor Morin FIRST READING 16454 Ordinance No. 17-14: Amendment to Chapter 90 "Traffic and Vehicles" regarding Parking Enforcement Mr. Schroth read Ordinance No. 17-14 by title on first reading: An Ordinance of the City Commission of the City of Eustis, Lake County, Florida; amending the Eustis Code of Ordinances, Chapter 90 "Traffic and Vehicles"; providing for severability; providing for codification; providing an effective date. Capt. Gary Winheim, Eustis Police Department, explained the proposed amendment to Chapter 90 regarding parking enforcement. He explained there are no changes to the violations or the actual fines only a change to administration. He noted it does change the time for a violator to respond from five days to ten days. He stated it also builds in a mechanism for the violator to appeal the ticket and adds a nonpayment notice with a $20 fee. He stated it also gives the City the opportunity to send nonpayment to collections. City of Eustis, Florida Page4 Printed on 1011012017 City Commission Meeting Minutes - Final October 5, 2017 The Commission questioned how many parking tickets are being issued with Capt. Winheim explaining they have not been writing tickets due to the inability to enforce. Mr. Schroth opened the public hearing at 6:35p.m. Gail Isaac Thomas asked about parking along Bates Avenue near Carver Park stating there are "no parking" signs along the street and no parking available for events. Capt. Winheim responded that there is parking available in the back field and in the main parking lot. He stated they will seek compliance before issuing tickets. There being no further public comment, the hearing was closed at 6:36p.m. The Commissioner noted they can see how it works and change it later if it doesn't. A motion was made by Vice-Mayor Aliberti, seconded by Commissioner Gnann-Thompson, to Approve Ordinance No. 17-14 on First Reading. The motion carried by the following vote: Aye: 5 - Vice-Mayor Al iberti ; Commissioner Bob; Commissioner Gnann-Thompsen; Commissioner Sabatini ; and Mayor Morin 16452 Ordinance No. 17-15: Implementing a Service Charge for Additional Utility Pollings Mr. Schroth read Ordinance No. 17- 15 by title on first reading: An Ordinance of the City Commission of the City of Eustis, Lake County, Florida; amending Chapter 94 "Utilities" and adding Section 94-262 (n) "Service Charge for Additional Pollings" to the Code of Ordinances for the City of Eustis; providing for severability; providing an effective date. Colleen Scott, Finance Director, explained the purpose for the proposed service charge due to numerous requests for multiple pollings at a single location. She explained that a ''polling" is a detailed hourly water consumption analysis over a 90-day period. She stated the benefit of a polling can assist the customer in better understanding their water consumption. She displayed a data graph and analysis to show how it can reveal how water is being used and identify unknown problems. She noted staff receives numerous requests for one location and the polling process creates a drain on City resources due to the staff time involved in doing a polling. She stated they are proposing the City provide one free polling per calendar year per location. Additional pollings would have a service charge of $35; however, if a faulty meter is discovered there would be no charge. The Commission questioned if they find a number of faulty meters with Ms. Scott indicating they have found a few. She explained that the purpose of the charge isn't for the revenue but more as a deterrent to manage the City's resources. The Commission questioned if there are valid reasons for more than one polling with Ms. Collins indicating someone may request multiple pollings as they try to troubleshoot different reasons why their readings may be high. Mr. Schroth opened the public hearing at 6:43p.m. There being no public comment, the hearing was closed at 6:43p.m. A motion was made by Commissioner Bob, seconded by Commissioner Sabatini, to Approve Ordinance No. 17-15 on First Reading. OTHER BUSINESS 16458 Consideration of Cancellation or Rescheduling of December 21, 2017, Regular Commission Meeting Mayor Molin explained that the City in the past has occasionally cancelled the second meeting in December. A motion was made by Commissioner Sabatini, seconded by Commissioner Gnann- Thompsen, that the December 21, 2017, Commission meeting be cancelled. On a voice vote, the motion passed unanimously. IX. FUTURE AGENDA ITEMS Commissioner Gnann- Thompson asked if the City would be doing a fall festival or anything on Halloween. Joe LaPolla, Parks & Recreation Director, responded that there would be a Fall Festival in Ferran Park on October 28th, the weekend before Halloween, from 3 to 6 p.m. Ms. Bailey reported that staff has been talking with the Orlando Central Railroad train operators and they will be doing a Pumpkin Patch train run duling the festival. Commissioner Sabatini asked about the status of the discussion on the City's dollar threshold noting that Mount Dora has a threshold of $25,000 and Eustis' is $50,000. Ms. Scott reported that the City Manager would be presenting that discussion at the next Commission meeting. She noted that there will be other ramifications to changing the threshold. X. COMMENTS City Commission Commissioner Sabatini cited his desire for the City to begin an internship with the high school. City Manager Mr. Canino reported on the post-stonn cleanup noting they are about 90% complete with the first sweep. He stated an additional sweep will be conducted as more deblis is being put out. He added he would instruct Public Work to look at Reddick Street. He concluded noting that the burning of stonn deblis has begun. Commissioner Gnann- Thompson asked if the City has been notified about receiving any Puerto Ricans that may be coming to Flolida with Mr. Canino indicating he had not heard of any official notifications. City Attorney - None Mayor Mayor Molin commented on the excellent football game between Eustis and Tavares. He announced that the Eustis consolidated Special Olympics team won a national championship with Commissioner Gnann-Thompson indicating that it is actually a combined team with Orange County and she had sent infonnation to staff Mr. Canino stated that staff has the infonnation and will schedule a presentation at an upcoming Commission meeting. City of Eustis, Florida Page6 Printed on 1011012017 City Commission Meeting Minutes - Final October 5, 2017 Mayor Molin asked that each Commissioner provide either a wlitten or verbal report at the next meeting regarding any committees or board meetings they attend since they are approaching year end and the appointments may change in January. He then reported that TJ. Fish is continuing as the Lake Sumter MPO director until they find a replacement. He stated that the Lake County Emergency Medical Services Board is working on a study regarding their efficiency and effectiveness which should be completed in December. Commissioner Sabatini reported the Lake Eustis Area Chamber of Commerce Board is planning a golf tournament for the second week of December. He then reported the Lake Eustis Museum of Art recently met to discuss their future goals for the museum. He stated the Board has substantive goals for the museum. He emphasized that it is important for the City and residents to encourage them to stay in Eustis. He concluded stating the City needs to identify those organizations it wants to be heavily involved with and support. Mayor Molin commented that individuals can participate in the event even if they don't play golf Commissioner Gnann-Thompson reported on the Lake Community Action Agency. She commented on their assistance to area low income residents and stated it has been hard for them since they lost the Head start funding. XI. ADJOURNMENT-6:56p.m. MARY C.
