ACKNOWLEDGEMENT OF QUORUM AND PROPER NOTICE PRESENT: Commissioner Emily Lee, Vice Mayor Karen LeHeup-Smith, Commissioner Robert Morin, Commissioner Marie Aliberti, and Mayor Michael Holland 1. AGENDA UPDATE 2. PRESENTATIONS 2.1 Presentation of proclamation by the Bill Hughes Leatherneck Detachment 1240 of the Marine Corps League Commander Paul Butler, Marine Corps League Detachment 1240, explained the history of the League and its organization, their mission, and their local charities. He noted the City's assistance in helping their fundraising efforts and presented a framed certificate to City Manager Ron Neibert who served in the Marines. Commander Butler read the certificate. Commander Butler then explained the national Marine Corps League donates funds annually to a children's hospital for equipment. He explained how the various units distribute "challenge" coins. He presented a challenge coin "Local Devil Dogs #345" to each Commissioner and read the accompanying proclamation citing the City's efforts with the "Four Paws for Vets" which trains service dogs for veterans. 2.2 Presentation of report by Christine Cruz on second anniversary of Clean Up Eustis Christine Cruz reviewed the history of the Clean Up Eustis organization and efforts to clean up debris along the Lake Eustis shoreline. She commented on the support of the local businesses and cited Eustis Public Works Department for their assistance. She specifically recognized Brent Matthews for his work. She estimated they pick up approximately 40 to 70 lbs. of trash at each cleanup, not including large items. She stated their greatest concern regarding drug syringes they find and the close proximity to the children's playground in Ferran Park. She asked the Commission to consider enacting a litter law with a higher fine for littering on or near waterways. She suggested installing Eustis City Commission Page 1 ofB September 19, 2019  surveillance cameras along the shoreline and near Trout Run and signage emphasizing the higher fine. She also asked the City to consider applying for grants to remove some of the invasive species along the shoreline and provide funds for enforcement. Mayor Holland noted that the Commission has a memo prepared by staff regarding littering fines and asked that it be placed on the next agenda for discussion. Mayor Holland then greeted a group of Girl Scouts in attendance and presented them with City pins. Angela, Troop #1995, noted the troop will be participating in the next cleanup. She asked that additional recycling containers be provided. She noted Mount Dora is doing a contest for artists and suggested the City could do a similar contest for decorating recycling bins. The Commission asked who has provided the grabbers with Ms. Cruz noting various organizations and individuals that have donated funds for supplies and equipment. She noted that the group also provides Bright Futures community service hours to the high school students. 3. AUDIENCE TO BE HEARD Gail Isaac-Thomas introduced Tomeka Rolle and asked about the dedication of the field in honor of Corey Rolle. She noted his grandmother is very ill and would like to see it. Tomeka Rolle, wife of the late Corey Rolle, commented on her late husband and his dedication to children. She asked for the Commission to consider the dedication of the field in his honor. Tom Carrino, Economic Development Director, reported that he and Kristina Rosenburg are working on the project. He explained the dedication is a two- meeting process. He indicated it would be brought forward soon with Mayor Holland asking if the first step could be on the October 3rd agenda. Darius Kerrison announced the next Comedy Show would be the following Saturday at the Mieluz Grand Hall and noted this would be the fifth anniversary of the show. 4. CONSENT AGENDA 4.1 Resolution Number 19-81: Revised Florida Department of Transportation (FOOT) Traffic Signal Maintenance and Compensation Agreement Moved by Commissioner Morin, seconded by Vice Mayor LeHeup-Smith, to approve Resolution Number 19-81 . ORDINANCES, PUBLIC HEARINGS & QUASI-JUDICIAL HEARINGS 5.1 Resolution Number 19-73: Final Millage Rate for 2019 Derek Schroth, City Attorney, announced Resolution Number 19-73: A Resolution by the City Commission of the City of Eustis, Lake County, Florida; adopting the final millage levy of ad valorem taxes for the City of Eustis, Lake County for Fiscal Year 2019-2020; providing for an effective date. Colleen Scott, Finance Director, stated per Florida Statute, that the taxing authority is City of Eustis, Florida, the rolled-back rate is 7.0382, the percentage increase over the rolled-back rate is 7. 71 % and the millage rate to be levied is 7.5810. She then provided a comparison of property values and tax collections from 2008 to 2019 noting the large drop in taxable value following the recession. She reviewed the estimated revenues for 2019-20 and commented on the various taxable values. She then provided a comparison with other area cities millage rates and fire assessment. She stated the final budget was advertised September 17th and this was the final budget hearing. Mr. Schroth opened the public hearing at 6:37 p.m. There being no public comment, the hearing was closed at 6:37 p.m . Moved by Vice Mayor LeHeup-Smith, seconded by Commissioner Aliberti, to approve Resolution Number 19-73. Motion carried by the following votes : Ayes: Commissioner Lee, Vice Mayor LeHeup-Smith, Commissioner Morin, Commissioner Aliberti and Mayor Holland 5.2 Resolution Number 19-74: Adopting the final budget for Fiscal Year 2019-2020 Mr. Schroth announced Resolution Number 19-74: A Resolution by the City Commission of the City of Eustis, Lake County, Florida , adopting the final budget for Fiscal Year 2019-2020; which shall include the Capital Improvement Program for the City of Eustis; providing for an effective date. Ms. Scott reviewed the proposed final budget for Fiscal Year 2019-2020 noting the number of meetings and workshops held in development of the budget. She reviewed the significant factors involved in development of the budget including the following: 1) Ad valorem based on a millage of 7.581 O; 2) Health and life insurance increase of 3%; 3) Police Pension increase from 46.66% to 47.09%; 4) Fire Pension increase from 39.70% to 40.60%; 5) COLA increase of up to 5%; and 6) GL/Work Comp/Property Insurance increase of 18%. Ms. Scott then explained the changes to the final budget including the following: 1) Addition of the scoreboard to the Parks & Recreation budget for $18,000; 2) Addition to the Library budget of $71,000 for a Library Tech 1 Eustis City Commission Page 3 of 8 September 19, 2019  position and additional book purchase; and 3) Removal of $40,000 from the Building Inspection budget due to the vehicle being added to the current year's budget. Ms. Scott then provided an overview of all funds and the general fund. She explained the importance of the Available Fund Balance and that is not used for recurring expenditures. She stated this is important in the event the City issues bonds and improves the City's bond rating. She provided an overview of revenue sources and expenditures. She then reviewed the Capital Improvement Plan citing the various planned projects. She cited the future challenges as follows: 1) funding for police and fire pensions; 2) insurance costs; 3) competitive compensation; 4) aging infrastructure; and 5) gas tax revenue formula favors those cities with more population growth and road expansion. Mr. Schroth opened the public hearing at 6:45 p.m . Gail Isaac-Thomas asked about budgeting for a pavilion for Villdale park and assistance for improving the Masonic Lodge. Mr. Neibert explained they were supposed to contact his office to set up a meeting. Once they meet, it could be incorporated into the budget through a budget adjustment. There being no public comment, the hearing was closed at 6:46 p.m. Commissioner Lee asked if the budget would be final with Mayor Holland explaining that the budget can be amended if needs arise. Moved by Vice Mayor LeHeup-Smith, seconded by Commissioner Morin, to approve Resolution Number 19-74. Motion carried by the following votes: Ayes: Commissioner Lee, Vice Mayor LeHeup-Smith, Commissioner Morin , Commissioner Aliberti and Mayor Holland 5.3 Resolution Number 19-82: Amending Emergency Management Plan Mr. Schroth announced Resolution Number 19-82: A Resolution of the City Commission of the City of Eustis, Lake County, Florida; amending the City of Eustis Emergency Management Plan to provide for the Mayor to issue the declaration for a state of emergency. Mr. Neibert explained the proposed amendment to the Emergency Management Plan to remove the requirement for a resolution for a state of emergency and provide for the Mayor to make a declaration of a State of Emergency in order to expedite the process. Motion carried by the following votes: Ayes : Commissioner Lee, Vice Mayor LeHeup-Smith , Commissioner Morin, Commissioner Aliberti and Mayor Holland 5.4 Ordinance Number 19-17 - Voluntary Annexation Ordinance Number 19-18 - Comprehensive Plan Amendment Ordinance Number 19-19 - Design District Assignment Mr. Schroth read Ordinance Number 19-17 by title only on second and final reading : An Ordinance of the City Commission of the City of Eustis, Florida; voluntarily annexing approximately 63 .05 acres of real property located at Lake Lincoln Lane east of Estes Road and E. Orange Avenue at SR 44, Eustis, FL. Mr. Schroth opened the public hearing at 6:49 p.m . The following individuals addressed the Commission to express concerns regarding the annexation and any development to be placed on the property: 1) Catherine Gonzalez; 2) Amber Hardy; and 3) Michael Minette. Mr. Neibert clarified that the issue under consideration is just the annexation of the property and that no specific development has been submitted for consideration as yet. Greg Beliveau responded to the comments on behalf of the applicant. Orange Avenue at SR 44 from Urban Low and Rural Transitiona l in Lake County to Suburban Residential (SR) and Mixed Commercial Residential (MCR) in the City of Eustis. Eustis City Commission Page 5 of 8 September 19, 2019  Mr. Schroth opened the public hearing at 7:08 p.m. Caroline Gonzalez stated that Estes Road is not the bypass but people are using it as a bypass. She commented on issues with semis using the road. Orange Avenue Mr. Schroth read Ordinance Number 19-26 by title on second and final reading : An Ordinance of the City Commission of the City of Eustis, Lake County, Florida , amending the City of Eustis Comprehensive Plan pursuant to 163.3187(1) F.S. ; changing the Future Land Use designation of0.24 acres located at 50 West Orange Avenue , as more particularly described herein, from Mobile Home Park/Recreational Vehicle (MHP/RV) to Central Business District (CBD) in the City of Eustis. Mr. Schroth opened the public hearing at 7:12 p.m. There being no public comment, the hearing was closed at 7: 12 p.m. Moved by Commissioner Morin, seconded by Commissioner Aliberti, to adopt Ordinance Number 19-27 on second and final reading. FUTURE AGENDA ITEMS Commissioner Lee commented on the need to educate the public on the community building project with Mr. Neibert explaining that he had just signed an agreement with a marketing firm who will develop the marketing materials to get the information out. He indicated that feedback will be available during the public meetings. He indicated that a resolution will be on the agenda for the first meeting in November to approve placement of a referendum on the March presidential preference primary ballot. 7. COMMENTS 7.1 City Commission Commissioner Aliberti commented on the Veteran's banners going up and noted that Peddler's Wagon also has information in their window regarding their individual banner. Commissioner Morin commented on the bingo event and the amount they raised for Special Olympics. He thanked George Asbate for his assistance with the event and noted their desire for a larger venue. Eustis City Commission Page 7 ofB September 19, 2019  Commissioner Lee reported on her attendance at the Parks and Recreation after school food program and the American Legion event. Vice Mayor LeHeup-Smith expressed support for the contest to decorate recycling cans with Mr. Neibert indicating staff would have to contact Waste Management for permission to do so. She commented on the purse bingo event and wished Mayor Holland a happy birthday. 7.2 City Manager Mr. Neibert asked the Commissioners to make sure they notify the City Clerk and his secretary when they are attending an outside event so they can be posted properly. He then commented on his attendance at the Bells Across America event. He reported the American Legion is moving their operations to the Women's Club facility. He announced he has two openings on the City Manager's team for the golf tournament and explained that the tournament raises funds for scholarships for the recreation programs. Commissioner Morin volunteered to join the City Manager's team. 7.3 City Attorney Mr. Schroth invited Commissioners to contact him if they had any questions regarding local enforcement of the Florida Air and Water Act. 7.4 Mayor Darius Kerrison thanked everyone for their participation in the Special Olympics bingo and explained how the funds will be utilized. Mayor Holland informed the audience that Tim Totten is the coordinator for the Veteran's banner program and stated he thought all of the banners are taken for this year. He announced the passing of former HR Director Ann Isaac's husband . He asked everyone to pray for one of the Lake County firefighters who recently had a heart attack. 8.
