Workshop Item 15014 Large Scale Text Amendments to the Comprehensive Plan Mayor Eckian explained the purpose of the workshop is for the Commission to review a large scale text amendment to the Comprehensive Plan. Dianne Kramer, Acting City Manager, explained the review of the comprehensive plan conducted by the Commission beginning in 2012 with the purpose being to eliminate those sections that no longer needed to be included under state requirements. She noted that the Commission held multiple public workshops to review the plan element by element. She noted that a first reading of an adoption ordinance was brought forward in October 2013; however, the Commission tabled the consideration at that time to allow further review of some issues. She explained staff's intent to review the previously discussed changes prior to bringing forward an ordinance . . She also noted that the transportation concurrency had already been eliminated. She further explained that the Commission previously agreed to retain the public school concurrency; therefore, the Public School Facilities Element is proposed to be eliminated but the concurrency would remain . Mayor Eckian recommended that Ms. Kramer review the changes element by element with his intent to request public input no later than 8:00p.m. II. Commission Discussion Ms. Kramer stated the purpose of the comprehensive plan is to set general guidelines and principles with specific regulations to be placed in the Land Development Regulations (LOR) . She reviewed the proposed revisions to the Future Land Use Element and Appendix noting the following changes: 1) Elimination of the Development Patterns and Energy Conservation Strategy Maps; 2) Clarification of the purpose of the Future Land Use Map series for general information and not for specific development; 3) Clarification that the site analysis should not be done at the time of a comprehensive plan amendment but at the time of the site plan or subdivision approval; 4) The nitrate/nitrogen loading analysis would only be required if the particular development was not connecting to central sewer; 5) Elimination of specific open space percentage requirements with the requirement now to fall . under maximum impervious surface for all of the districts unless the property is within the Wekiva Study Area. If so and a specific vegetative community was identified then there would be a minimum 35% open space required; and 5) Elimination of the Light Industrial/and use designation. The Commission suggested deleting the following bullet point from Policy FLU 1. 1. 1: "Strengthening and directing development towards existing communities". Ms. Kramer agreed the statement is misleading and commented on the need to avoid placing obstacles to infill development. She suggested the following replacement wording: "Encourage development in existing communities and remove any barriers to infi/1 development". CONSENSUS: It was a consensus to replace the statement as suggested by Ms. Kramer. City of Eustis, Florida Page 1 Printed on 2111/2015 City Commission Workshop Meeting Minutes - Final January 29, 2015 The Commission discussed Policy FLU 1.1.4 bullet point- "Protection of environmentally sensitive lands". It was suggested to add some clarification with Ms. Kramer suggesting to change the beginning as follows: "including participation in programs and LOR development standards such as the following:" CONSENSUS: It was a consensus to amend the opening statement as suggested by Ms. Kramer The Commission discussed standardizing the terminology regarding plants to "Florida Friendly". CONSENSUS: It was a consensus to change the terminology to "Florida Friendly". The Commission discussed the minimum open space requirement in the FLU Appendix and use of maximum impervious surface with Ms. Kramer explaining that the definition of open space is contained in the Land Development Regulations not in the comprehensive plan. She noted that the proposed change is consistent with what other local governments have been permitted to do but may not be approved by the State. The Commission questioned the general range of uses under Suburban Residential and the elimination of "limited neighborhood commercial uses" with Ms. Kramer suggesting that the next to last sentence be amended to read: "Apartments and neighborhood commercial/office uses may be permitted through the PUD process." The Commission asked if the neighborhood commercial could be limited to new PUD's and not allow retrofits with Mr Schroth indicating a rep/at would have the same rights as a new development. CONSENSUS: It was a consensus of the Commission to revise the sentence as recommended by Ms. Kramer Ms. Kramer next reviewed the proposed revisions to the Capita/Improvements Element with no additional changes discussed. Ms. Kramer then reviewed the revisions to the Conservation Element including the following: 1) Removal of the hazardous materials section as it is regulated by Lake County; and 2) Elimination of the specified support for Trout Lake Nature Center The Commission discussed Policy CON 1.1.5 regarding lakeshore development limitations- (a) "Erosion control plans will be required for all subdivisions and building site areas within 400 feet from the lake shorelines". It was suggested that section be changed to read "Erosion control plans will be required for all development in areas within 400 feet. " CONSENSUS: It was a consensus of the Commission to change the wording of 1.1.5 as suggested. Ms. Kramer explained only the titles were changed in the Economic Development Element noting that is not a required element. She then reviewed the Housing Element revisions with no additional changes by the Commission. Ms. Kramer explained that most of the recommended changes for the Intergovernmental Coordination Element are to keep it consistent with changes made to the other elements. There were no further changes recommended by the Commission. Ms. Kramer stated that the entire Public School Facilities Element is recommended for elimination. There were no further changes suggested. Ms. Kramer explained that the primary changes to the Recreation and Open Space Element are to keep it consistent with the other elements. She noted the recreation concurrency has been eliminated however the level of service standards were retained to be used for planning purposes but not as an adopted level of service. Public Input Mayor Eckian opened the floor to public comment at 7:25p. m. Nancy Muenzmay, 33121ndian Trail, asked about the removal of school concurrency with Ms. Kramer explaining that concurrency was retained but the Public School Facilities Element was removed due to it being covered by the interlocal agreement. Kress Muenzmay, 33121ndian Trail, commented on the section regarding inti// development, private property rights and urban sprawl. He questioned the effect of the impervious surface standard versus "open space" and expressed concern about leaving the definition of open space in the land development regulations. Ms. Kramer clarified that the maximum impervious surface was always in the comprehensive plan but a developer had to meet criteria for both maximum open space and maximum impervious surface. The Commission asked that staff go back and look at the FLU Policy 1. 1. 1 regarding infi/1 development and for staff to provide a more in depth explanation and examples of impervious surface versus open space. CONSENSUS: It was a consensus of the Commission to eliminate the next to last bullet point and for staff to bring back an explanation of the impervious surface. Joan Bryant, 707 Poinsettia Drive and representing the Trout Lake Nature Center, expressed opposition to the removal of Trout Lake Nature Center from the Comprehensive Plan. The Commission discussed the decision to remove the Nature Center from the comprehensive plan due to not wanting to single out an individual organization and their support for the mission of the Trout Lake Nature Center. Mr. Muenzmay expressed support for eliminating the Nature Center from the plan. There being no further public comment, the floor was closed at 8:04p.m. IV. Commission Direction The Commission took a straw poll regarding the elimination of the Trout Lake Nature Center from the comprehensive plan with a consensus for its removal.
