EVANSTON CITY COUNCIL Second Regular M eeting M arch 21, 2017 The official record of proceedings of the second regular m eeting of the Evanston City Council for the m onth of March was held in the Council Cham bers of City Hall on the above date. These proceedings were video recorded. Mayor W illiam s led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent W illiam s called the m eeting to order at 5:30 p.m . and welcom ed everyone present. Revenue & Expenditure Report Councilmember Lynch moved, Councilm em ber Seller seconded, to approve the Revenue and Expenditure Report for December 2016. Council Comments The Mayor and Councilm em bers com m ented on the annual Celtic Festival which will be held this weekend and encouraged everyone to attend. They also thanked those involved with the festival and wished them luck. Councilm em ber Sellers stated that the work on the Roundhouse was looking good. Appointment/Director of Engineering and Planning Councilmember Schuler moved, Councilmember Lynch seconded, to confirm M ayor W illiams’ appointment of Dean Barker to fill the position of Director of Engineering and Planning, (w hich w as left vacant due to the retirement of Brian Honey) from M arch 27, 2017 until the first regular City Council meeting in January 2018. The m otion passed unanim ously with 5 yes votes: Lynch, Kopp, W elling, Sellers, Schuler. Mayor W illiam s then presented the Oath of Office to Mr. Barker, and he was sworn in as Director of Engineering and Planning of the City of Evanston, W yom ing.  Consent Agenda Councilmember Kopp moved, Councilmember Lynch seconded, to approve the follow ing Consent Agenda: A Limited M alt Beverage Permit requested by Shayne Lewis/M ayhem Productions, LLC., for a Concert Event at the Roundhouse on Saturday, April 1, 2017 from 7:00 p.m. to 11:00 p.m. The m otion passed unanim ously with 6 yes votes: W illiam s, Lynch, Kopp, W elling, Sellers, Schuler. Ordinance 17-01 Councilmember Schuler moved, Councilmember W elling seconded, to pass Ordinance 17-01 on third and final reading. ORDINANCE 17-01: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING SECTION 7-29 OF THE CITY CODE TO PROVIDE THAT THE AMOUNT OF THE FEE THE CITY W ILL CHARGE FOR BUILDING PERMITS SHALL BE SET IN THE ANNUAL BUDGET RESOLUTION, EXEMPTING CITY PROJECTS FROM THE PAYMENT OF THE FEE AND DELETING THE FEE FOR ELECTRICAL PERMITS. W HEREAS, the City’s practice for som e tim e has been to set the fee for building perm its in its annual budget resolution; and W HEREAS, it has also been the City’s practice for som e tim e to not issue electrical perm its for construction because the City does not have an electrical inspector; and W HEREAS, the governing body has determ ined that it does not m ake fiscal sense for the City to be paying a building perm it fee for construction projects on city owned facilities; and W HEREAS Section 7-29 of the Code needs to be am ended to reflect the above described practices and to form ally exem pt city projects from the paym ent of a building perm it fee; NOW , THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY O F EVANSTON, W YOMING THAT: Section 1: Section 7-29 of the Evanston City Code is hereby am ended and reenacted as set forth below: § 7-29. Issuance of building and electrical perm its; perm it fees; inspection fees. If, upon consideration of the detailed statem ents or plans required by section 7-27, it shall appear to the building inspector that the m anner of erection, installation, character of construction and kind of m aterial are in accordance with this chapter, the inspector shall thereupon grant a perm it to m ake such construction, installation or alteration, upon the payment of the correct fee which shall be set and established by the governing body of the City of Evanston in its annual budget resolution. All construction, remodeling and alteration projects conducted by the City of Evanston shall be exempt from paying the fee. Ordinance 17-02 Councilmember Welling moved, Councilmember Sellers seconded, to pass Ordinance 17-02 on third and final reading. ORDINANCE 17-02:AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING SECTIONS 7-16, 7-25, 7-27, 7-28,7-30 AND REPEALING SECTION 7-17.1 TO REMOVE THE REFERENCES TO A ELECTRICAL INSPECTOR AND ELECTRICAL PERMITS IN CHAPTER 7, BUILDINGS, IN THE CITY CODE. W HEREAS, several sections of the City Code in Chapter 7, Buildings, refer to a City Electrical Inspector and the issuance of electrical permits for construction; and W HEREAS, the City has not employed an Electrical Inspector or issued electrical permits for several years; and W HEREAS, the State of W yoming conducts electrical inspections in the City of Evanston;  NOW , THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: Section 7-17.1, Duties and authority generally of City electrical inspector., of Chapter 7 of the Evanston City Code is hereby repealed. Section 2: Sections 7-16, 7-25, 7-27, 7-28,7-30 of Chapter 7 of the Evanston City Code are hereby amended and re-enacted to provide the following: § 7-16. Supervision and control of building inspector. The building department shall be under the supervision and control of the City Engineer. § 7-25. Building permits required; exceptions generally. It shall be unlawful for any work to be done upon any building or structure within the City limits, except necessary repairs, without a permit from the building inspector, except in conformity with the provisions of this chapter. § 7-27. Construction plans to be submitted and approved. It shall be unlawful for any person, as owner, agent or architect, to commence or continue the construction, erection or alteration of any building or structure or any part of a building or structure, within one-half mile of or within the limits of the City, without first having submitted to the City building department, a detailed set of the plans or description of the alteration, as determined by the building inspector, of such proposed work, together with the full name and residence, street and number of the owner and location of such building, and having such plans or description approved by said inspector, the permit fees paid and the permit issued. Such detailed statement, plans or description shall be kept on file in the office of the City building department until the proposed work is completed. Nothing in this section shall be construed to allow the building inspector to grant approval for the erection of any part of the building, when plans and detailed statements have been presented for the same, before the entire plans and detailed statements have been submitted, and no contracts for the erection of any building or part of a building shall be let until the plans have been approved by the City inspector in writing upon the face of such plans.It shall be unlawful for any person to alter, enlarge, raise or build upon any building without a permit from the City inspector, which permit shall be issued only after any examination of the premises shall have been made by such official. § 7-28. Unauthorized alterations in plans. It shall be unlawful for any owner, his agent or architect, after the permit shall have been granted for the erection, construction, or alteration of any building or structure or installation within any building or structure within the limits of the City, to alter or change the plans for such building or structure without giving notice and receiving written approval of such alteration or change from the building inspector. § 7-30. Authority of building inspector to order work stopped; interference with inspector; penalty. The building inspector shall have the power to order the construction or the making of alterations or repairs on any building or structure stopped where such work is being done in violation of this chapter or where the individual performing the work does not hold the proper license to perform such work from the state and It shall be unlawful for any owner, architect, builder, contractor or other person employed in such work to fail to comply with such order. It shall also be unlawful for any of such persons or for any other person to interfere with, hinder, delay or obstruct the inspector in the discharge of their duties. RESOLUTION 17-10: RESOLUTION OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE APPROVAL AND EXECUTION OF A FAA APPROVAL AGREEMENT FOR TRANSFER OF ENTITLEMENTS W ITH THE UNITED STATES OF AMERICA, THE FEDERAL AVIATION ADMINISTRATION.  W HEREAS, the Evanston-Uinta Airport Joint Powers Board has requested the City approve and execute the attached FAA Approval Agreement for Transfer of Entitlements with the United States of America, the Federal Aviation Administration; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The City of Evanston hereby approves and authorizes the execution of a FAA Approval Agreement for Transfer of Entitlements with the United States of America, the Federal Aviation Administration, a copy of which is attached hereto. Section 2: The Mayor and City Attorney are hereby authorized to sign the Agreement with the Federal Aviation Administration on behalf of the City of Evanston. W HEREAS, the City of Evanston has determined there is a need to undertake a massive shredding of documents held by the City; and W HEREAS, Shred-it has agreed to provide the shredding services pursuant to the attached Customer Service Agreement, Purge Service; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Customer Service Agreement, Purge Service between the City of Evanston and Shred-it International ULC, a copy of which is attached hereto, to undertake a massive shredding of documents held by the City. Comments/Remarks The Department Heads welcomed Dean Barker and congratulated him on his new position with the City. Jay Dee Nielsen announced that the Spring Meet & Greet BBQ is scheduled for W ednesday, April 26 th. Dean Barker thanked the Mayor and Council for his appointment and stated that he is excited for this opportunity and to be back home again. Public Participation Maryl Thompson thanked Oop Hansen and Public W orks Department for the clearing out around the fire hydrants this winter. She also thanked Councilmember Kopp for responding to her email.
