Council Comments Councilm em ber Kopp com m ented that the Casino Night Fundraiser for the Evanston Youth Club for Boys and Girls was a great success. Councilm em ber Sellers encouraged everyone to shop locally and support our great businesses. Councilm em ber Schuler rem inded everyone to support Sm all Business Saturday on Novem ber 25 th by shopping at our local businesses. She also com m ented on the Casino Night Fundraiser and the Sage Bush Theater play at the Strand Theater this weekend. Special Presentation/Evanston Youth Club for Boys & Girls Trudy Lym announced that the Evanston Youth Club for Boys and Girls won 1st prize in the “Caselle Com m itm ent to Com m unity Award” contest. The Youth Club was nom inated for this award by Carolyn Maddux for their efforts in bettering their com m unity. Mayor W illiam s then presented a check in the am ount of $2500.00, from the Caselle Software Com pany, to the Evanston Youth Club for Boys and Girls Director, Holly Slade and Board President, Kevin Kallas.  Consent Agenda Councilmember W elling moved, Councilmember Sellers seconded, to approve a Parade Route Permit requested by the Urban Renew al Agency for the Jingle Bell Jaunt 5K Fun Run/W alk on Saturday, December 9, 2017, beginning at 9:00 a.m. at the Strand Theater. Ordinance 17-06 Councilmember Schuler moved, Councilmember Lynch seconded, to pass Ordinance 17-06 on third and final reading. ORDINANCE 17-06: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING SECTIONS 4-7 A (1), 4-10 B & C, 4-13 B, 4-15 C, 4-26.2 C, 4-31 AND 4-32, OF CHAPTER 4, ALCOHOLIC BEVERAGES, TO PROVIDE FOR THE SALE OF ALCOHOLIC BEVERAGES FROM A LICENCED BUILDING INSTEAD OF A DISPENSING ROOM. W HEREAS, the W yom ing Legislature has am ended the state statutes to provide for the sale of alcoholic beverages from a licensed Building instead of a dispensing room ; and W HEREAS, the City of Evanston desires to am end its Alcoholic Beverage Ordinance in response to the am endm ents in state law. NOW , THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1. Sections 4-7 A (1), 4-10 B & C, 4-13 B, 4-15 C, 4-26.2 C, 4-31 and 4-32 of the Evanston City Code are hereby am ended to provide as follows: § 4-7. Applications. A. Any person desiring a license or perm it authorized by this Part 2 shall apply to the governing body. The application shall be m ade under oath upon a form prepared by the attorney general of the state, filed in the office of the City clerk, and shall contain the following provisions: (1) The location and a description of the room licensed building in which the applicant will sell under the license if the building is in existence at the tim e of application. If the building is not in existence, the location and an architect's drawing or suitable plan of the room licensed building in the prem ises to be licensed; § 4-10. Signing and attestation; contents; display. B. The following shall be shown in each license: (1) The nam e of the licensee; (2) A description of the place An address of the licensed building in which alcoholic and/or m alt beverages m ay be sold; (3) The date of issuance; and (4) The am ount of the fee and that the sam e has been paid. C. Each licensee shall display his license in a conspicuous place in the licensed room building. § 4-13. License constitutes authority to sell alcoholic liquor or malt beverage for use or consumption; fees. B. The fee for each retail liquor license shall be set forth in the annual budget resolution but shall not be less than $100 nor m ore than $1,500, payable in advance, for the principal dispensing room licensed building. If a license for an additional dispensing room is approved, the fee shall be equal to 2/3 of the cost of the original license, for a lim it of one additional dispensing room except, that the lim it of one additional dispensing room shall not apply in the case of a business operation with convention facilities, as determ ined by the City Council. If a license is issued at any tim e other than October 15, the fee shall be prorated on a 1/12 basis. The license fee shall be paid to the City Clerk before the license is issued. § 4-15. Generally. C. A club holding a lim ited retail liquor license shall not may sell alcoholic or m alt beverages for consum ption anywhere except within on the licensed prem ises and for consum ption by its m em bers and their accom panying guests only. It shall be the duty and obligation of the club to check and regulate sales to m em bers and their accom panying guests to insure that all alcoholic or m alt beverages sold are consum ed within the building. space or prem ises. § 4-26.2. Bar and grill liquor license; authorized; requirements. C. Bar and grill liquor licenses shall be subject to the provisions of §§ 4-22 and 4-24C of the City Code to the sam e extent those provisions are applicable to restaurant liquor licenses. Bar and grill liquor licensees shall not sell alcoholic or m alt beverages for off-premises consum ption off the prem ises from the licensed building owned or leased by the licensee except as allowed under§ 4-24D of the City Code. ARTICLE X Dispensing Rooms LICENSED BUILDING § 4-31. Location and other regulations and restrictions as to place of sale; inspections. additional dispensing rooms. A. Except as otherwise provided in this section, the principal place in which alcoholic and m alt beverages are sold under a license shall be located in the licensed building for which the license is issued and as approved by the governing body. Upon paym ent of an additional license fee equal to two-thirds of the fee paid for the original license, a licensee m ay have and m aintain one additional dispensing room in the sam e building under the authority of the original license. Alcohol beverages secured in the licensed room by the server m ay be served only in the licensed building in which the licensed room is located and in an im m ediately adjac ent fenced or enclosed area as approved by the governing body. T his a d ja c e n t area s hall not be in another building. an d s h a ll be located on the licensed prem is es . O nly alc oholic and m alt beverages, nonalcoholic beverages, food, tobacco and alc oholic liquor and m alt beverage prom otional sales item s sold to the licensee bearing the nam e and tradem ark of the alcoholic liquor an d m a lt b everage firm or com pany w hose produc ts the item is advertis ing m ay be sold and served in the licensed room . T he C ity shall, as often as nec es s ary, inspec t the licensed room and adjoining room s b u ild in g a n d a d ja c e n t a re a s w here alc oholic beverages are served to ensure that the licensee is in com plianc e w ith s anitation and fire hazard requirem ents and other applicable law s. A lic e n s e e m ay separate the fac ility for the s ale of alc oholic liquor and m alt bevera g e s for off-prem ises consum ption from the fac ility us ed to s erve c ustom ers for on-prem ises consum ption w ithout paym ent of an additional fee. A s eparated fac ility for m ak ing s a les for off-prem ises consum ption shall be loc ated adjoining the facility for m ak ing sales for on-prem ises consum ption. T he tw o fac ilities m ay be s eparated by glass or other suitable partition. B. If a lic ens ee is engaged in a business operation w ith c o n ve n tio n facilities, the licensee m ay m aintain m ore than one additional dispensing room under the sam e fee referred to in S ubs ec tion A of this sec tion. F or the purposes of this subsection, a convention facility shall have and m aintain all of the follow ing: (1) M otel or hotel s leeping room accom m odations; (2) R estaurant facilities; and (3) C onference fac ilities. C. T he C ity C ouncil m ay iss ue a tw enty-four-hour perm it to any licensee authorizing the s ale of alc oholic or m alt beverages in one additional dispensing room in the sam e building licensed by the original lic ens e for a tw enty-four-hour period only. N o one licensee shall be issued m ore than six perm its in any one-year period. T he fee for the period w ill be $10, payable in advance. D. If the lic ens ee is engaged in the operation of or is a concessionaire for a public auditorium , c ivic c enter or events c enter, the licensee m ay dispense alcoholic liquors or m alt beverages in any room or other appropriate location w ithin the confines of th e licensed prem ises b u ild in g approved by the governing body under the sam e fee specified in S ubsection A of this s ec tion. E. N otw iths tanding S ubs ec tion A of this section, a licensee w ho holds a license other than a club lic ens e is s ued under §4-15 or restaurant license issued under §4-21, and w ho is engaged in a bus ines s operation w ith m otel or hotel sleeping room accom m odations at the sam e prem ises m ay, at an additional fee of not to exceed one-half of the fee paid for the original license, sell alc oholic liquor and m alt beverages in sealed containers from a m inibar located in any s leeping room of the licensee's m otel or hotel ope ra tion occupied by a registered guest 21 years of age or older. S ales under this subsection are not subject to hours of operation im pos ed under § 4-30 and s hall be only fo r c o n s u m p tion w ithin the m otel or hotel sleeping room prem is es occ upied by the guest. R estrictions im posed upon m inors under § 4-37 apply to s ales authorized under this subsectio n. T he price im posed upon alcoholic liquor, m alt beverages and all oth e r ite m s available for sale from the m inibar shall be clearly posted. A m inibar us ed for purpos es of this subsection shall be a closed co n ta iner, refrigerated or nonrefrigerated, ac c ess to the interior of w hich is restricted by m eans of a lock ing device requiring the us e of a k ey, m agnetic card or sim ilar device. T he governing body of the C ity m ay im pos e additional reas onable restrictions on the operation a m inibar lice nsed under this s ubs ec tion. F. A holder of a res ort retail liquor license m ay dispense alcoholic beverages from any loc ation w ithin the boundaries of the resort prem ises. T he resort prem ises shall be single property w ithin a contiguous boundary upon w hich the resort is located and w hich shall be identified in the lic ens e. S ubsections A through C and E of this section do not apply to holders of a res ort retail liquor license w ith respect to alcoholic beverages dispensed w ithin the c ontiguous boundaries of the resort prem ises for w hich a resort retail liquor lic ens e is is s ued, ex c ept that Any location on the resort prem ises w here alcoholic beverages are dis pens ed as approved by the governing body shall com ply w ith applicable s anitation and fire hazard requirem ents and other applicable law s. T he C ity m ay as often as nec es s ary, ins pec t the lic ens ed location w here alcoholic beverages are dispensed to ensure that the lic ens ee is in com pliance with sanitation and fire hazard requirem e n ts . F o r each additional fixed dis pensing loc ation, the applicant shall pay an annual fee equal to 66 2/3% of the original lic ens e fee. G A ny golf c lub as defined by § 4-1 w hich holds a retail liq u o r lic ense or a club lim ited retail liq u o r lic ens e under §4-15 m ay dispense alcoholic beverages from any location w ithin the boun d aries of the golf c lub prem ises. T he prem ises shall be a single property w ith a c ontiguous boundary upo n w h ich the golf club is located and w hich shall be identified in the lic ens e. S ubs ec tions A thro u g h C and E of this section do not apply to golf clubs as defined by § 4-1 of the C ity C ode whic h are holders of a retail liq u o r lic e n s e o r a club lim ited retail liquor lic ens ed w ith respec t to alcoholic beverages dispensed w ithin the c o n tiguous boundaries of the golf c lub prem ises, except that A ny location on the golf club prem ises w here alc oholic beverages are dis pensed as approve d by the governing body shall com ply w ith applic able s anitation and fire hazard requirem ents and other applic a b le law s. T he C ity m ay, as often as nec es sary, ins pec t the licensed location w here alcoholic beverages are dispensed to ensure that the lic ens ee in com pliance w ith sanitation and fire hazard requirem ents. H . W ith the approval and on the c onditions im posed by the governing body, any restaurant liquor lic ens ee operating on a golf c ourse m ay dispense alcoh o lic beverages from any location on the prem is es of the golf c ours e. S ubsections A through C and E of this section do not a p ply to holders of suc h lic ens es , b ut such H olders shall com ply w ith all applicable sanitation and fire hazard requirem ents and other applicable law s. I. T he governing body m ay authorize a licensee hold in g a re tail liquor license to hold an event on in the licensed prem is es b u ild in g at w hich persons under the age of tw en ty-o n e are perm itted upon the prem ises if: (1) No alcoholic liquor or m alt beverages are sold, served, consum ed or possessed by any person in the dispensing room during attending the event; (2) The dispensing room is closed during the event and all No alcoholic liquor and or m alt beverages are rem oved from the dispensing room in which the event is held and are stored in an area on the licensed prem ises not accessible to persons in the closed dispensing room during the event or stored in a m anner preventing dispensation during attending the event. § 4-32. Storage of alcoholic liquor outside licensed premises. No retail licensee shall store alcoholic liquor outside of the licensed prem ises building, unless he files with the state liquor com m ission a written statem ent that he stores liquor in a place other than his place of business and states the exact location of the storage place. W HEREAS, the Golf Course Advisory Board has recom m ended that the City of Evanston set and charge the green fees and other related fees for the Purple Sage Municipal Golf Course for the 2018 golf season as set forth in the attached Recom m endation; and W HEREAS, the governing body for the City of Evanston concurs with the recom m endation of the Golf Course Advisory Board; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The City of Evanston shall set and charge the green fees and other related fees for the Purple Sage Municipal Golf Course for the 2018 golf season as set forth in the Golf Course Advisory Board Recom m endation, which is attached hereto and incorporated herein.
