EVANSTON CITY COUNCIL Second Regular M eeting August 21, 2018 The official record of proceedings of the second regular m eeting of the Evanston City Council for the m onth of August was held in the Council Cham bers of City Hall on the above date. These proceedings were video recorded. Mayor W illiam s led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent W illiam s called the m eeting to order at 5:30 p.m . and welcom ed everyone present. Those present from the governing body at the start of the m eeting were: Mayor W illiam s; Councilm em bers Tim Lynch, Andy Kopp, Mike Sellers, and W endy Schuler . Councilm em ber Evan Perkes and David W elling were excused. Staff m em bers present at the start of the m eeting were: Director of Adm inistrative Services/City Clerk, Am y Grenfell; City Treasurer, Trudy Lym ; Police Chief, Jon Kirby; Director of Engineering and Planning, Dean Barker; Public W orks Director, Oop Hansen; Director of Parks and Recreation, Scott Ehlers; Associate Planner, DuW ayne Jacobsen; and Deputy City Clerk, Nancy Stevenson. Council Comments Mayor W illiam s and the City Councilm em bers read a press release announcing that Evanston Urban Renewal/Main Street has been nam ed a 2019 Great Am erican Main Street Award (GAMSA) Sem ifinalist by the National Main Street Center. W inners will be announced at the Main Street Now Conference in Seattle, W ashington, on March 25, 2019. The Mayor and Councilm em bers all com m ented on what a great honor it is to be a sem ifinalist and congratulated those involved in receiving this honor. Councilm em ber Schuler rem inded everyone of Cowboy Day’s and encouraged everyone to attend and support this great annual event. Councilm em ber Lynch invited everyone to attend the annual Rotary Labor Day Breakfast. Mayor W illiam s com m ented that it is election day and encouraged anyone that hasn’t voted to do so. Consent Agenda Councilmember Schuler moved, Councilmember Sellers seconded, to approve an Open Container Permit requested by the Uinta County M useum for the Dutch Oven Cook-off Challenge fundraiser on Saturday, September 15, 2018 on Front Street and M ain Street from 9 th Street to 11 th Street and 9 th Street and 10th Street from Front Street to Center Street, from 2:00 p.m. to 6:00 p.m. The m otion passed unanim ously with 5 yes votes: W illiam s, Lynch, Kopp, Sellers, Schuler. Ordinance 18-03 Councilmember Lynch moved, Councilmember Kopp seconded, to pass Ordinance 18-03 on third and final reading. ORDINANCE 18-03: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING AMENDING SECTION 7-7 OF THE CITY CODE TO ADOPT THE 2018 INTERNATIONAL BUILDING CODE, THE 2018 INTERNATIO NAL RESIDENTIAL CODE FOR ONE AND TW O FAMILY DW ELLINGS, THE 2018 INTERNATIONAL EXISTING BUILDING CODE, THE 2018 INTERNATIONAL MECHANICAL CODE, THE 2018 INTERNATIONAL FUEL GAS CODE, THE 2018 INTERNATIONAL PLUMBING CODE AND THE 2017 NATIONAL ELECTRIC CODE. W HEREAS, the governing body of the City of Evanston has determ ined that it is in the best interests of its citizens to adopt the 2018 International Building Code, the 2018 International Residential Code For One And Two Fam ily Dwellings, the 2018 International Existing Building Code, the 2018 International Mechanical Code, the 2018 International Fuel Gas Code, the 2018 International Plum bing Code And The 2017 National Electric Code; NOW , THEREFO RE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: Section 7-7 of the Evanston City Code is hereby am ended and reenacted as set forth below: Sec. 7-7. Adoption of Regulatory Codes. There is hereby adopted by the city, for the purpose of prescribing regulations for the m inim um standards for building to safeguard life, health, property and public welfare, the regulatory codes designated below and the sam e are hereby incorporated in this section as fully as if set out at length herein, to wit: A. 2018 International Building Code; B. 2018 International Residential Code for One and Two Fam ily Dwellings, exem pting therefrom Section R313.2 One-and two-fam ily dwelling autom atic fire system s; C. 2018 International Existing Building Code; D. 2018 International Mechanical Code; E. 2018 International Fuel Gas Code; F. 2018 International Plum bing Code; and the G. 2017 National Electric Code. ORDINANCE 18-04: AN ORDINANCE APPROVING AND AUTHORIZING A ZONE CHANGE FOR PROPERTY IN THE CITY OF EVANSTON FROM MEDIUM DENSITY RESIDENTIAL-ESTABLISHED AND AGRICULTURAL-ESTABLISHED TO RURAL RESIDENTIAL-1, AS REQUESTED BY PROPERTY OW NERS OF THE LAND MORE PARTICULARLY DESCRIBED HEREIN. W HEREAS, property owners, Stephen C. Aaron, Barbara J. McFadden, Am anda J. McFadden, Sean McFadden, the Stephanie Aaron Trust, the Sheridan G. Aaron Trust and the Shara Beth Aaron Trust, have filed an application with the Planning and Zoning Com m ission of the City of Evanston, W yom ing to change the zoning of the property described below from a Medium Density Residential-established and Agricultural- established Zone to a Rural Residential-1 Zone; and W HEREAS, the Planning and Zoning Com m ission scheduled a public hearing for said application on July 2, 2018; and W HEREAS, notice of the public hearing and application was published in a newspaper of general circulation and notices of the hearing were m ailed to affected landowners pursuant to City Ordinance; and W HEREAS, a public hearing was held by the Planning and Zoning Com m ission of the City of Evanston on July 2, 2012, to consider said application for a zone change; and W HEREAS, after receiving testim ony and evidence from the applicants, affected landowners and the public at large, the Planning and Zoning Com m ission voted to recom m end to the governing body that it approve the zone change. RESOLUTION 18-50: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT W ITH FORSGREN ASSOCIATES, INC. TO PROVIDE ENGINEERING SERVICES FOR THE EVANSTON SAFE ROUTES FOR SCHOOLS ASPEN ELEMENTARY AREA PROJECT. W HEREAS, the City of Evanston and Forsgren Associates, Inc. have negotiated an agreem ent whereby Forsgren Associates, Inc., will perform the services set forth in the Agreem ent for the Evanston Safe Routes for Schools Aspen Elem entary Area Project; and W HEREAS, the City of Evanston and Forsgren Associates, Inc. have set their agreem ent in writing, a copy of which is attached hereto; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Agreem ent between the City of Evanston and Forsgren Associates, Inc., a copy of which is attached hereto, for engineering services necessary for the Evanston Safe Routes for Schools Aspen Elem entary Area Project. W HEREAS, a public hearing was held by the Planning and Zoning Com m ission of the City of Evanston on July 2, 2018, to consider am ending the City's Master Plan, (the 2010 Plan), to authorize a Rural Residential-1 Zone for the real property described below as requested by property owners, Stephen C.
