EVANSTON CITY COUNCIL First Regular M eeting October 2, 2018 The official record of proceedings of the first regular m eeting of the Evanston City Council for the m onth of October was held in the Council Cham bers of City Hall on the above date. These proceedings were video recorded. Councilm em ber Lynch led those in attendance in the pledge of allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent W illiam s called the m eeting to order at 5:30 p.m . and welcom ed everyone present. Those present from the governing body at the start of the m eeting were: Mayor W illiam s; Councilm em bers, Tim Lynch, David W elling, Mike Sellers and W endy Schuler. Councilm em ber Evan Perkes were excused. Staff m em bers present at the start of the m eeting were: City Attorney, Dennis Boal; Director of Adm inistrative Services/City Clerk, Am y Grenfell; City Treasurer, Trudy Lym ; Director of Engineering & Planning, Dean Barker; Police Chief, Jon Kirby; Public W orks Director, Oop Hansen; Director of Parks and Recreation, Scott Ehlers; Associate Planner, DuW ayne Jacobsen; and Deputy City Clerk, Nancy Stevenson. Council Comments Councilm em ber W elling encouraged everyone to participate in som e of the m any EHS Hom ecom ing events this week and also com m ented Evanston’s 150 year birthday celebration which will take place Novem ber 10, 2018. Councilm em ber Sellers com m ent on the im provem ents at the Recreation Center and what a wonderful facility it is. Councilm em ber Schuler also com m ented about all the Hom ecom ing activities, encouraging everyone to attend. Mayor W illiam s stated that he had receive a letter of resignation from Councilm em ber Andy Kopp. Andy is resigning from his seat on the City Council due to the fact that he is no longer living in W ard 2. Am y Grenfell addressed the Mayor and the City Councilm em ber telling them that she sincerely appreciated the tim e that she has been em ployed with the City. She thanked everyone for their help and support over the last five years. The Mayor and Council all expressed their appreciation for her and her service to the City as well as the com m unity. Special Orders/Interim City Clerk Councilmember Lynch moved, Councilmember Schuler seconded, to name Nancy Stevenson as the Interim Evanston City Clerk effective October 6, 2018. The m otion passed unanim ously with 5 yes votes: W illiam s, Lynch, W elling, Sellers, Schuler. Mayor W illiam s then swore in Nancy Stevenson as the Interim Evanston City Clerk. Consent Agenda Councilmember W elling moved, Councilmember Sellers seconded, to approve the follow ing on the Consent Agenda: An Open Container Permit requested by Urban Renew al/Evanston M ain Street for the annual Hunters’ W idow s Night Out, on M ain Street from 9 th Street to 11 th Street and 10 th Street from Front Street to M ain Street, on Thursday, October 18, 2018, from 5:00 p.m. to 8:30 p.m.; and A Street Closure Permit requested by Urban Renew al/Evanston M ain Street for the annual Dow ntow n Trick-or- Treating on W ednesday, October 31, 2018, on M ain Street from 7 th Street to 11 th Street, from 3:30 p.m. to 5:30 p.m. The m otion passed unanim ously with 5 yes votes: W illiam s, Lynch, W elling, Sellers, Schuler. Ordinance 18-06 Councilmember Schuler moved, Councilmember W elling seconded, to pass Ordinance 18-06 on third and final reading. ORDINANCE 18-05: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING, VACATING A PORTION OF AVENUE “D” OF THE UNION PACIFIC RAILW AY COMPANY’S FIRST ADDITION TO THE CITY OF EVANSTON, AS MORE PARTICULARLY DESCRIBED HEREIN. W HEREAS, the governing body of the City of Evanston, W yom ing, did on the 4th day of Septem ber, 2018, pass a Resolution declaring the intention of the City to vacate a portion of Avenue “D” of the Union Pacific Railway Com pany’s First Addition to the City of Evanston, as described hereafter and as requested by Matt Asay, Harrison Asay, Steve Cates and Julie Cates; and W HEREAS, said Resolution set a hearing for the 4th day of Septem ber, 2018, at 5:30 p.m ., at the City Council Cham bers at City Hall of the City of Evanston, to consider all protests, rem onstrances or objections to said vacation, and that a hearing was held on said date and all protests, rem onstrances and objections to said vacation were considered by the governing body; and W HEREAS, notice of the hearing and the City’s intent to vacate was published in a newspaper of local circulation once a week for four consecutive weeks prior to the hearing; and W HEREAS, after considering the evidence presented at the hearing, the governing body for the City of Evanston has determ ined that it is in the public’s interest to vacate the portion of the Avenue D, described below; NO W , THEREFORE, BE IT ORDAINED BY THE GOVERNING BO DY O F THE CITY O F EVANSTON, W YOMING, as follows: Section 1. The portion of the Avenue “D” which is m ore particularly described as follows, to-wit: A parcel of land located in the N1/2 SE1/4 of Section 17, Township 15 North, Range 120 W est, 6th P.M., City of Evanston, Uinta County, W yom ing, said parcel being a portion of Avenue “D” as said Avenue is platted and recorded in the Office of the Uinta County Clerk on the Map of the Union Pacific Railway Com pany’s First Addition to Subdivision of a Part of the SE1/4 of Section 17, and being m ore particularly described as follows: BEGINNING AT THE Northernm ost corner of Lot 1, Block 10 of said First Addition and running thence S 42°52'54" W , 150.00 feet along the Northwesterly boundary of said Lot 1 to the W esternm ost corner thereof; thence N 47°07'44" W , 50.00 feet along the northwesterly prolongation of the Southwesterly boundary of said Lot 1 to a point on the Northwesterly boundary of said Avenue ‘D’; thence N 42°52'54" E, 150.00 feet along said Northwesterly boundary of Avenue ‘D’ to a point on the northwesterly prolongation of the Northeasterly boundary of said Lot 1; thence S 47°07'44" E, 50.00 feet along said northwesterly prolongation of the Northeasterly boundary of Lot 1 to the POINT OF BEGINNING. Said parcel containing 7500 square feet, m ore or less. Section 2. The Mayor and City Clerk are hereby authorized to execute all docum ents, including but not lim ited to quitclaim deeds, which are necessary to carry out the vacation of said portion of Avenue “D”. RESOLUTION 18-68: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING, APPROVING AND ADOPTING THE CLASSIFICATION AND COMPENSATION STUDY PREPARED BY CONDREY AND ASSOCIATES, INC. FOR THE CITY OF EVANSTON. W HEREAS, the governing body for the City of Evanston has determ ined there is a need to update the city’s classification and com pensation system for city em ployees; and W HEREAS, Condrey & Associates, Inc. was retained by the City to conduct a study to enable the City to adopt an updated com pensation plan for city em ployees; and W HEREAS, the study has been com pleted and Condrey & Associates, Inc. has subm itted for the City’s consideration, a Job Classification and Com pensation Plan for the City of Evanston, a copy of which is attached hereto; NOW , THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1: The City of Evanston hereby approves and adopts the attached Job Classification and Com pensation Plan to enable the City to im plem ent an updated com pensation plan for city em ployees. ___________________________ Kent H. Information Technology Coordinator Position Councilmember Lynch moved, Councilmember Schuler seconded, to create a new City of Evanston Permanent Position entitled Information Technology Coordinator. The m otion passed unanim ously with 5 yes votes: W illiam s, Lynch, W elling, Sellers, Schuler. Resolution 18-69 Councilmember Sellers introduced Resolution 18-69. Councilmember Sellers moved, Councilmember W elling seconded, to adopt Resolution 18-69. RESOLUTION 18-69: A RESOLUTION OF THE CITY OF EVANSTON, W YOMING AUTHORIZING THE EXECUTION OF A ENFORCING UNDERAGE DRINKING CONTRACT W ITH THE W YOMING ASSOCIATION OF SHERIFFS AND CHIEFS OF POLICE. W HEREAS, funds are available from the W yom ing Association of Sheriffs and Chiefs of Police which are to be used to reduce underage drinking of alcohol within the com m unity; NOW , THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, W yom ing as follows: Section 1. The Police Departm ent of the City of Evanston is authorized to accept and execute the attached Enforcing Underage Drinking Contract with the W yom ing Association of Sheriffs and Chiefs of Police. Section 2. The Mayor, City Clerk and Police Departm ent are authorized to sign and attest all docum ents and take all other actions which are necessary to accept and receive the funds. ___________________________ Kent H. Police Handguns Councilmember Welling moved, Councilmember Lynch seconded, to authorize the Police Department to trade-in specified handguns for trade-in value, or as an alternative, sell them to police officers for the trade-in value. Final Acceptance/City View W ater M ain Project Councilmember Schuler moved, Councilmember Sellers seconded, to authorize final acceptance and payment of retainage to Longhorn Construction, Inc., for the City View W ater main Replacement Project-Phase I, contingent that no claims are filed prior to the expiration of the notice period. Public Participation Jeana Reichenberg addressed the City Council regarding concerns the Evanston Boat Club have with the access to the property they lease from the City, adjacent to Sulphur Creek Reservoir. Kayne Pyatt rem inded everyone that the Sagebrush Theatre’s new play will begin on October 18 th and there will be a discount to ladies participating in Hunter’s W idow Night and a discount also for First Responders. Comments/Remarks The Departm ent Heads all thanked the Mayor and Council for approving the new Classification and Com pensation plan. They also wished Am y Grenfell best wishes in her new position with the W yom ing Business Council in Cheyenne. The Mayor and Council again thanked Mrs. Grenfell for her service to the City and wished her and her fam ily well in their new endeavors. The Mayor presented her with a parting gift and invited everyone to a reception in her honor after the m eeting.
