EVANSTON CITY COUNCIL Second Regular M eeting January 15, 2019 The official record of proceedings of the second regular m eeting of the Evanston City Council for the m onth of January was held in the Council Cham bers of City Hall on the above date. These proceedings were video recorded. Mayor W illiam s led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent W illiam s called the m eeting to order at 5:30 p.m . and welcom ed everyone present. Those present from the governing body at the start of the m eeting were: Mayor W illiam s; Councilm em bers Tim Lynch, Tib Ottley, Evan Perkes, David W elling, Mike Sellers, and Mikal W elling. W elling moved, Councilmember Ottley seconded, to pass Ordinance 18-07 on third and final reading. ORDINANCE 18-07: AN ORDINANCE OF THE CITY OF EVANSTON, W YOMING, AMENDING SECTIONS 4-26.2 C, 4-30 A AND 4-31 D, OF CHAPTER 4, ALCOHOLIC BEVERAGES, TO PROVIDE FOR THE SALE OF ALCOHOLIC BEVERAGES FROM A LICENSED BUILDING INSTEAD OF A DISPENSING ROOM AND TO ALLOW PERSONS TO REMAIN IN THE RESTAURANT OF A LICENSED BUILDING AFTER 2:30 A.M. W HEREAS, the W yom ing Legislature has am ended the state statutes to provide for the sale of alcoholic beverages from a licensed Building instead of a dispensing room ; and W HEREAS, the City of Evanston has previously m ended its Alcoholic Beverage Ordinance to provide for the sale of alcoholic beverages from a licensed Building; and W HEREAS, there is a need am end Sections 4-26.2 C and 4-31 D to correct scrivener errors that occurred in the previous ordinance am endm ent; and W HEREAS, Section 4-30 needs to be am ended to refer to a licensed building and to allow persons to rem ain in a restaurant in the building after 2:30 a.m .; NOW , THEREFO RE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, W YOMING THAT: Section 1. Sections 4-26.2 C, 4-30 A and 4-31 D of the Evanston City Code are hereby am ended to provide as follows: § 4-26.2. Bar and grill liquor license; authorized; requirem ents. C. Bar and grill liquor licenses shall be subject to the provisions of §§ 4-22 and 4-24C of the City Code to the sam e extent those provisions are applicable to restaurant liquor licenses. Bar and grill liquor licensees shall not sell alcoholic or m alt beverages for off-prem ises consum ption from the licensed building owned or leased by the licensee except as allowed under§ 4-24D of the City Code. §4-30. Hours of operation; m odifications. A. All licensees m ay open the licensed building at 6:00 a.m . and shall cease the sale of alcoholic and m alt beverages prom ptly at the hour of 2:00 a.m the following day. In addition, licensees shall clear the licensed building of all persons other than em ployees, by 2:30 a.m ., except for persons located in the room or room s being used exclusively to provide the public a restaurant, § 4-31. Location and other regulations and restrictions as to place of sale; inspections. D. If the licensee is engaged in the operation of or is a concessionaire for a public auditorium , civic center or events center, the licensee m ay dispense alcoholic liquors or m alt beverages in any room or other appropriate location within the confines of the licensed building approved by the governing body. Final Acceptance/Payment/Rec Center Pump Room Councilmember Lynch moved, Councilmember D. W elling seconded, to authorize final acceptance and payment of retainage to Intermountain Electric Service, Inc., for the Evanston Recreation Center Pump Room Electrical Project. W elling.  Public Participation Kayne Pyatt invited and encouraged everyone to attend the Sagebrush Theatre Productions on Friday, January 25th at 7:00 p.m . to celebrate the 100th anniversary of the19 th Am endm ent at the Strand Theater. Marly Thom pson invited everyone to attend the W yom ing Com m unity Foundation fundraiser on Saturday, January 26th in the Roundhouse at 7:00 p.m .. She stated that all m oney raised will be for the Evanston Chapter.
