EVANSTON CITY COUNCIL Second Regular Meeting May 21, 2019 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of May was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, Mike Sellers, and Mikal Welling. Councilmember David Welling was excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; Community Development Director, Rocco O’Neill; Police Chief, Jon Kirby; Director of Engineering & Planning, Dean Barker; Director of Parks and Recreation, Scott Ehlers; Senior Planner, DuWayne Jacobsen; and Police Lieutenant, Ken Pearson. City Treasurer, Trudy Lym and Public Works Director, Gordon Robinson were excused. A group of interested citizens were also present. Approve Agenda Councilmember Perkes moved, Councilmember M. Welling seconded, to approve the agenda. The motion passed unanimously with yes 6 votes: Williams, Lynch, Ottley, Perkes, Sellers, M. Welling. Welling. Council Comments Councilmember Sellers congratulated the Evanston Youth Club for Boys and Girls Club on their achievements over the past year. Appointment/City Prosecutor Councilmember Sellers moved, Councilmember Lynch seconded, to confirm Mayor William’s appointment of Amanda R. Kirby to fill the position of City Prosecutor, effective June 1, 2019 through the first regular City Council meeting in January 2020. The motion passed unanimously with yes 5 votes: Lynch, Ottley, Perkes, Sellers, M. Welling.  Consent Agenda Councilmember M. Welling moved, Councilmember Ottley seconded, to approve a Street Closure Permit requested by Travis and Jennifer Wilson for a neighborhood 4th of July Block Party on Thursday, July 4, 2019 on Summit Street between 6th Street and 7th Street, 5:00 p.m. to 11:59 p.m. The motion passed unanimously with 6 yes votes: Williams, Lynch, Ottley, Perkes, Sellers, M. Welling. Ordinance 19-05 Councilmember Lynch sponsored Ordinance 19-05. Councilmember Perkes moved, Councilmember Lynch seconded, to pass Ordinance 19-05 on first reading. Councilmember Lynch moved, Councilmember Sellers seconded, to table Ordinance 19-05 to the next regular meeting on June 4, 2019. ORDINANCE 19-05: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 24-15.(b) OF THE CITY CODE TO SET FORTH THE PERMITTED AND CONDITIONALLY PERMITTED USES FOR THE COMMERCIAL AND BUSINESS DISTRICTS AND AMENDING SECTION 24-105 TO ADD THE DEFINITIONS OF LIGHT RENTAL SERVICE AND OFFICE. The motion to table Ordinance 19-05 passed unanimously with 6 yes votes: Williams, Lynch, Ottley, Perkes, Sellers, M. Welling. Resolution 19-23 Councilmember Perkes introduced Resolution 19-23. Councilmember Perkes moved, Councilmember Sellers seconded, to adopt Resolution 19-23. RESOLUTION 19-23: RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF A STREET DECK LEASE WITH RACHEL’S, LLC D.B.A. KATES, TO LEASE TWO PARKING SPACES TO BE USED AS A STREET DECK. WHEREAS Rachel’s LLC D.B.A. Kates has requested the City lease two parking spaces located directly in front of its building for the installation of a street deck to be used for outdoor dining and drinking during the summer and early fall season; and WHEREAS, the City desires to enable opportunities for restaurants, taverns other businesses located on its historic Main Street to be able to provide additional outdoor eating and drinking opportunities; and WHEREAS, the City’s has an interest in maintaining and furthering the economic opportunities, as well as enhancing the economic viability of Evanston’s Historic Downtown District; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston approves and authorizes the execution of a Street Deck Lease with Rachel’s LLC for two parking spaces located directly in front of its building for the installation of a street deck to be used for outdoor dining and drinking during the summer and early fall season. Section 2: The Mayor and City Clerk are authorized to sign and attest the Street Deck Lease a copy of which is attached hereto. Resolution 19-24 Councilmember Lynch introduced Resolution 19-24. Councilmember Lynch moved, Councilmember Ottley seconded, to adopt Resolution 19-24. RESOLUTION 19-24: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING AN APPLICATION TO OBTAIN A BULLET PROOF VEST PARTNERSHIP GRANT FROM THE U.S. DEPARTMENT OF JUSTICE. WHEREAS, grant funds are available from the U.S. Department of Justice which are to be used to assist in th purchase of bullet proof vests for the police department;  NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Police Department of the City of Evanston is authorized to apply for a Bullet Proof Vest Partnership Grant from the U.S. Department of Justice. Welling introduced Resolution 19-25. Councilmember M. Welling moved, Councilmember Perkes seconded, to adopt Resolution 19-25. RESOLUTION 19-25: A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE RIMROCK DRIVE ADDITION, A SUBDIVISION WITHIN THE CITY OF EVANSTON, WYOMING AS MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Craig Lester a.k.a. Craig L. Lester and Christie Lester a.k.a. Christie D. Lester, (the “Subdivider”), has made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Rimrock Drive Addition, a subdivision located within the City of Evanston, Wyoming; and WHEREAS, the City of Evanston finds that said subdivision is a minor subdivision and can be approved pursuant to Section 22-10 of the Evanston City Code. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming, that: Section 1. The final plat of the Rimrock Drive Addition is hereby approved, accepted and authorized and described in particularity as follows, to-wit: The "Rimrock Drive Addition" to the City of Evanston, Wyoming, is a replat of Lots 2 and 3 of the Red Mountain Mesa V Subdivision as said Subdivision is platted and recorded in the Office of the Uinta County Clerk, said Addition being located in the NE1/4 NE1/4 of Section 16, Township 15 North, Range 120 West, 6th P.M., City of Evanston, Uinta County, Wyoming, lying entirely within the corporate limits of the City of Evanston, and being more particularly described as follows: BEGINNING at the Original Northeast corner of said Lot 2 and running thence S 13°09'44" E, 275.50 feet along the Easterly boundary of said Lot 2 and said Lot 3 to the Original Southeast corner of said Lot 3; thence N 68°31'25" W, 150.83 feet along the Southerly boundary of said Lot 3 to the Original Southwest corner thereof; thence N 7°45'33" W, 190.62 feet along the Westerly boundary of said Lot 3 and said Lot 2 to the Original Northwest corner of said Lot 2; thence N 76°50'16" E, 106.14 feet along the Northerly boundary of said Lot 2 to the POINT OF BEGINNING. Said Rimrock Drive Addition containing 0.624 acres, more or less. Section 2. The Mayor and City Clerk are hereby authorized and directed to enforce the mandates of chapter 22 of the Code of the City Evanston with regard to the filing of the final plat with the County Clerk of Uinta County, Wyoming as by law required.
