EVANSTON CITY COUNCIL First Regular Meeting June 4, 2019 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of June was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Councilmember Perkes led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers: Tim Lynch, Tib Ottley, Evan Perkes, Mike Sellers, and Mikal Welling. Councilmember David Welling was excused. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Community Development Director, Rocco O’Neill, Police Chief, Jon Kirby; Director of Engineering & Planning, Dean Barker; Public Works Director, Gordon Robinson;and Associate Planner, DuWayne Jacobsen. Director of Parks and Recreation, Scott Ehlers was excused. A group of interested citizens were also present. Approve Agenda Councilmember M. Welling. Revenue & Expenditure Report Councilmember Lynch moved, Councilmember M. Welling seconded, to approve the Revenue and Expenditure Report for April 2019. Council Comments Councilmember Ottley commented on the National Guard Members that have recently been deployed, with five of those being from Evanston. Councilmember Sellers congratulated all the high school graduates in the area on their achievements. He also commented on the drag races that will be held this weekend. Mayor Williams reminded everyone that the Renewal Ball is this weekend. Consent Agenda Councilmember Lynch moved, Councilmember Ottley seconded, to approve the following: A Street Closure Permit requested by Elijah Robinson for a neighborhood 4th of July Block Party on Thursday, July 4, 2019 on Sage Street between 4th Street and 5th Street from 6:00 p.m. to 12:00 a.m. The motion passed unanimously with 5 yes votes: Williams, Lynch, Ottley, Sellers, M. Welling. 1 abstain: Perkes Councilmember Sellers moved, Councilmember Lynch seconded, to approve the following: A Limited Malt Beverage Permit request by Katherine Bella for the Evanston Bluegrass Festival at Depot Square on Saturday, June 22, 2019 from 11:00 a.m. to 10:30 p.m.; A Limited Malt Beverage Permit requested by the Evanston Urban Renewal Agency for the Evanston Brewfest fundraiser event in Depot Square on Saturday, July 20, 2019 from 12:00 p.m. to 5:00 p.m.; and An Open Container Permit requested by the Evanston Urban Renewal Agency for the Evanston Brewfest fundraiser event on Saturday, July 20, 2019 on Front Street and Main Street from 9th Street to 11th Street and 9th, 10th, and 11th Streets from Front Street to Main Street, from 12:00 p.m. to 6:00 p.m. The motion passed unanimously with 6 yes votes: Williams, Lynch, Ottley, Perkes, Sellers, M. ORDINANCE 19-05: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 24-15.(b) OF THE CITY CODE TO SET FORTH THE PERMITTED AND CONDITIONALLY PERMITTED USES FOR THE COMMERCIAL AND BUSINESS DISTRICTS AND AMENDING SECTION 24-105 TO ADD THE DEFINITIONS OF LIGHT RENTAL SERVICE AND OFFICE. The motion to pass Ordinance 19-05 on first reading as amended, passed with 5 yes votes: Williams, Lynch, Ottley, Perkes, M. Welling. 1 no vote: Sellers Ordinance 19-06 Councilmember Perkes sponsored Ordinance 19-06. Councilmember Perkes moved, Councilmember Sellers seconded, to pass Ordinance 19-06 on first reading. ORDINANCE 19-06: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING ENACTING SECTION 24-108.1 OF THE CITY CODE AUTHORIZING THE PLANNING DEPARTMENT TO APPROVE THE TRANSFER OF A CONDITIONAL USE PERMIT AND AN EXISTING USE IN CERTAIN CIRCUMSTANCES. The motion to pass Ordinance 19-06 on first reading passed unanimously with 6 yes votes: Williams, Lynch, Ottley, Perkes, Sellers, M. Welling. Resolution 19-26 Councilmember Lynch introduced Resolution 19-26. Councilmember Lynch moved, Councilmember M. Welling seconded, to adopt Resolution 19-26. RESOLUTION 19-26: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING A BROWNFIELDS ASSESSMENT APPLICATION TO THE EPA FOR ENVIRONMENTAL ASSESSMENT ASSISTANCE FOR THE SUNSET CABINS PROPERTY. WHEREAS, the City owns the real property located at 196 Bear River Drive and known as the Sunset Cabins property; and WHEREAS, the City of Evanston has a need to establish a baseline of the environmental conditions existing on the Sunset Cabins property to facilitate further development; and WHEREAS, Federal Environmental Protection Agency has a program to assist communities with technical assistance to obtain an appropriate environmental assessment of such property ; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Community Development Director is hereby authorized to submit a Brownfields Assessment Application to the EPA for Environmental Assessment Assistance for the Sunset Cabins Property. Welling seconded, to adopt Resolution 19-27. RESOLUTION 19-27: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING A RECREATION ECONOMY FOR RURAL COMMUNITIES APPLICATION TO THE EPA FOR TECHNICAL ASSISTANCE IN EXPANDING AND INCREASING THE OUTDOOR RECREATION ECONOMY WITHIN THE COMMUNITY. WHEREAS, the City of Evanston has an opportunity and need to improve its economy by leveraging outdoor recreation; and WHEREAS, Federal Environmental Protection Agency has a program to provide communities with technical assistance in building and expanding the outdoor recreation economy within a community; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The Community Development Director is hereby authorized to submit a Recreation Economy for Rural Communities Application to the EPA for technical assistance in expanding and increasing the outdoor recreation economy within the community. Resolution 19-28 Councilmember Perkes introduced Resolution 19-28. Councilmember Perkes moved, Councilmember Ottley seconded, to adopt Resolution 19-28. RESOLUTION 19-28: RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE ACCEPTANCE OF A CASELLE SOFTWARE & SERVICES PROPOSAL TO PROVIDE THE CITY WITH COMPUTER SOFTWARE WHICH WILL ENABLE DEPARTMENT HEADS AND THE GOVERNING BODY TO MONITOR BUDGETS AND ACCOUNTS AND FACILITATE ADVANCED REPORTING. WHEREAS, the Caselle, Inc. has submitted to the City a proposal for computer software which will enable Department Heads and the Governing Body to monitor budgets and accounts and will facilitate advanced reporting by the City; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City Director of Finance is hereby authorized to accept and execute on behalf of the City of Evanston the Caselle Software and Services Proposal , a copy of which is attached hereto, to enable Department Heads and the Governing Body to monitor budgets and accounts and to facilitate advanced reporting by the City.
