EVANSTON CITY COUNCIL First Regular Meeting July 2, 2019 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of July was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Council Comments Mayor Williams and the Councilmembers wished everyone a happy 4th of July. They also reminded everyone times to light fireworks have changed and asked everyone to use caution and be safe. Councilmember David Welling reminded everyone of the annual 4th of July Festival which will be held at Bear Meadows this year. Councilmember Sellers thanked all the Veterans for their service. Mayor Williams welcomed all the EHS Alumni that will be participating in that annual event. Appointment to Boards/Commissions Mayor Williams made appointments to the following boards and commissions. ORDINANCE 19- 05: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 24-15.(b) OF THE CITY CODE TO SET FORTH THE PERMITTED AND CONDITIONALLY PERMITTED USES FOR THE COMMERCIAL AND BUSINESS DISTRICTS AND AMENDING SECTION 24-105 TO ADD THE DEFINITION OF OFFICE. Whereas, following notice and a public hearing, the Planning and Zoning Commission has recommended the City amend Section 24-15. The rental of equipment or other items may be conducted onsite only if the cleaning, maintenance and repair of all rental equipment or other items shall be conducted and performed in an enclosed on-site building which shall confine and contain any noise, smoke, vapor, dust, odor, glare, vibration, fumes, or other environmental contamination. All waste, contamination or other environmental discharges produced by the cleaning, maintenance and repair of equipment or other rental items shall be controlled, treated and disposed of in accordance with the applicable state or federal regulations. An enclosed building means a structure surrounded by full length walls from roof to ground, which may include doors and windows, and having a roof enclosing the entire structure. Any outdoor storage of equipment, equipment parts or other rental items shall be screened from view by landscaping or a fence. Section 2 : The definition of “Office” and “Office, Professional” are hereby added to Section 24-105 of the Evanston City Code to read as follows: Sec. 24-105. Definitions and standards enumerated. OFFICE –-Office means a structure, room, or suite of rooms in which clerical, bookkeeping, administrative work or other activity is carried out for a business, service or person and which is not considered a professional office, as defined below. OFFICE, PROFESSIONAL--A professional office is a office of a member of a recognized profession maintained for the conduct of that profession. A profession is a vocation, requiring advanced study in a specialized field which also requires licensing or certification by the state and maintenance of professional standards applicable to the field. Professional office shall include the office of a doctor, dentist, lawyer, architect, engineer, geologist, surveyor, insurance agent, real estate agent, real estate appraiser, accountant, or similar professions or professional services. ORDINANCE 19-06: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING ENACTING SECTION 24-108.1 OF THE CITY CODE AUTHORIZING THE PLANNING DEPARTMENT TO APPROVE THE TRANSFER OF A CONDITIONAL USE PERMIT AND AN EXISTING USE IN CERTAIN CIRCUMSTANCES. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: WHEREAS, following notice and a public hearing, the Planning and Zoning Commission has recommended the City add a Section to the City Code which would allow the the transfer of conditinal use permit without a public hearing or review by the Planning and Zoning Commission; Section 1: Section 24-108.1. of the Evanston City Code is hereby enacted to provide as follows: Sec. 24-108.1 Transfer of a conditional use permit. A. The Evanston Planning Department may, without a public hearing or review by the Planning and Zoning Commission, approve the transfer or assignment to a subsequent landowner, lessee or tenant a Conditional Use Permit for a site, if the use is the same as the most recently approved Conditional Use Permit and the use by the subsequent land owner, lessee or tenant will comply with the terms and conditions of the permit. B. To obtain the approval of a transfer or assignment of a Conditional Use Permit or an existing use, a person shall submit a completed application and fee to the Evanston Planning Department C. If an applicant is unable to obtain the approval of a transfer or assignment from the Evanston Planning Department, the applicant may bring the matter before the governing body for its consideration. RESOLUTION 19-42: RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES WITH COWBOY DAY’S INCORPORATED, A WYOMING NON PROFIT CORPORATION. WHEREAS, the City of Evanston has a strong interest in promoting tourism within the community; and WHEREAS, Cowboy Day’ Incorporated increases tourism within the community by providing the Cowboy Days Rodeo in Evanston, Wyoming, each year; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:  Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the Contract for Services with Cowboy Day’s Incorporated, a Wyoming non profit corporation, a copy of which is attached hereto. RESOLUTION 19-43: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE UINTA COUNTY HUMAN SERVICE BOARD TO PROVIDE HUMAN SERVICES FOR THE CITIZENS OF EVANSTON. WHEREAS, the City of Evanston desires to assist, by providing funding, to the Uinta County Human Services Board, in the provision of human services for the citizens of the City of Evanston. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The City of Evanston is authorized to execute the Contractual Agreement with the Uinta County Human Services Board, a copy of which is attached hereto. Section 2. Resolution 19-44 Councilmember Lynch introduced Resolution 19-44. Councilmember Lynch moved, Councilmember M. Welling seconded, to adopt Resolution 19-44. RESOLUTION 19-44: RESOLUTION DECLARING THE INTENTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING, TO VACATE A PORTION OF KIMBERLY AVENUE OF THE FAIR MEADOWS PARK ADDITION TO THE CITY OF EVANSTON, AS MORE PARTICULARLY DESCRIBED HEREIN AND HOLD A PUBLIC HEARING. WHEREAS, the City of Evanston has received a request from Jonsey Fearn and Mark Mcgurn to vacate a portion of Kimberly Avenue of the Fair Meadows Park Addition to the City of Evanston; and WHEREAS, the governing body of the City of Evanston deems it in the public interest to initiate the procedure to consider the vacation of a portion Kimberly Avenue; BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: It is hereby declared to be the intention of the governing body of the City of Evanston, Wyoming, to vacate a portion of the Kimberly Avenue, as requested by Jonsey Fearn and Mark Mcgurn which is more particularly described as follows, to-wit: A parcel of land located within the boundaries of Fair Meadows Park, City of Evanston, Uinta County, Wyoming, as said Park is platted and recorded in the Office of the Uinta County Clerk, said parcel being part of Kimberly Avenue as laid out upon the plat of said Park, and being more particularly described as follows: BEGINNING at the Southeast corner of said Park and running thence S 89°48'15" W, 40.00 feet along the South boundary of said Park to the Southeast corner of Lot 43, Block 1 therein;  thence N 0°02'47" W, 100.00 feet along the East boundary of said Lot 43 to the Northeast corner thereof; thence N 89°48'02" E, 40.00 feet to a point on the East boundary of said Park; thence S 0°02'47" E, 100.00 feet along the East boundary of said Park to the POINT OF BEGINNING. Said parcel containing 0.092 acres, more or less. The City of Evanston shall reserve all necessary easements for the construction, repair, replacement and maintenance of overhead and underground utilities, including but not limited to electrical lines, natural gas lines, water lines, sewer lines, storm sewer lines, television transmission lines and telephone lines. Section 2: The governing body of the City of Evanston will meet to consider all protests, remonstrances or objections to said vacation on the 6th day of August, 2019, at 5:30 o'clock p.m., at the City Council Chambers Room, in the Evanston City Hall located at 1200 Main Street, Evanston, Wyoming. Section 3: All protests, remonstrances or objections to said vacation should be filed with the city clerk of Evanston, Wyoming, in writing at or prior to said hearing. Section 4: The city clerk will forthwith publish notice in the manner and in the time provided by law of the intention of the governing body of the City of Evanston, Wyoming, to vacate said portion of Kimberly Avenue.
