EVANSTON CITY COUNCIL First Regular Meeting December 3, 2019 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of December was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; Community Development Director, Rocco O’Neill; Police Chief, Jon Kirby; Director of Engineering & Planning, Dean Barker; Public Works Director, Gordon Robinson; Director of Parks and Recreation, Scott Ehlers; Police Lieutenant, Rhett Groll; and Detective, Jake Williams. City Treasurer, Trudy Lym was excused. A group of interested citizens were also present. Approve Agenda Councilmember D. Welling moved, Councilmember M. Welling seconded, to approve the agenda. Welling, Sellers, M. Welling. Council Comments Councilmember Sellers thanked the City Crews for putting up the Christmas lights and decorations. He thanked the citizens of the community for attending the public hearing regarding the proposed ICE Detention Center. Mr. Sellers also reminded everyone to shop locally whenever possible. Councilmember Mikal Welling reminded everyone of the Annual Light Parade this Thursday at 6:00 p.m. Consent Agenda Councilmember D. Welling moved, Councilmember Ottley seconded, to approve a Parade Route Permit requested by the Evanston Police Officers Association for the Annual Shop with a Cop Parade on Saturday, December 14, 2019, beginning at 7:50 a.m. at the Hampton Inn and ending at Walmart. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, Welling, Sellers, M. Welling. Ordinance 19-09 Councilmember D. Welling moved, Councilmember Perkes seconded, to pass Ordinance 19-09 on third and final reading. ORDINANCE 19-09: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTIONS 6-12 AND 6-13 AND REPEALING SECTIONS 6-2, 6-3, 6-4, 6-5, 6-6, 6-9,6-11,6-14 AND 6-15 OF CHAPTER 6, BICYCLES, OF THE EVANSTON CITY CODE TO UPDATE THE ORDINANCES REGARDING THE OPERATION OF A BICYCLE WITHIN THE CITY LIMITS. WHEREAS, a group of students has approached the City Council about the need to update and modernize the ordinances regarding the operation of bicycles within the city limits; and WHEREAS, the students and Police Department have jointly developed amendments to the bicycle ordinances which they are recommending be adopted by the City Council; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Sections 6-12 and 6-13 of the Evanston City Code are hereby amended and re- enacted to provide as follows: § 6-12. Equipment. A. Every bicycle, when in use at nighttime, shall be equipped with a white lamp on the front of the bicycle or operator, and a red reflector shall be visible on the back of the bicycle or operator. §6-13 Riding on sidewalks. When operating a bicycle on a sidewalk within the City, operators shall yield the right of way to all pedestrians and shall give an audible or verbal signal before overtaking or passing a pedestrian or other cyclist. Section 2: Sections 6-2, 6-3, 6-4, 6-5, 6-6, 6-9, 6-11, 6-14 and 6-15 of the Evanston City Code are hereby repealed. PASSED AND APPROVED on First Reading this 5th day of November, 2019. Welling, Sellers, M. Welling. Ordinance 19-10 Councilmember Lynch moved, Councilmember Ottley seconded, to pass Ordinance 19-10 on third and final reading. ORDINANCE 19-10: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING ENACTING SECTION 17-1.3 OF THE EVANSTON CITY CODE TO ENABLE THE GOVERNING BODY TO ESTABLISH THE HOURS IN WHICH A CITY PARK MAY BE OPEN FOR PUBLIC USE. WHEREAS, the City has determined there is a need to limit the hours in which some of the City parks can be used by the public in order to maintain the public's safety and general welfare. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Section 17-1.2 of the Evanston City Code is hereby enacted to provide as follows: Sec. 17-1.3. Hours of use for other City Parks. A. The governing body may by resolution set forth and establish the hours in which a city park shall be open for public use, except for those parks where the hours have been established by ordinance. B. In the event of an emergency or law enforcement need, the Mayor shall have, for all of the city parks, the authority to establish or modify the hours in which the park shall be open to the public, for a period not to exceed 30 days. C. Any person who fails to comply with the hours of permitted public use established for a city park pursuant to this section shall be guilty of a misdemeanor, punishable by a fine or imprisonment as set forth in Section 1-5. Welling seconded, to authorize final acceptance and payment of retainage to Hydro-Tech, Inc., for the Evanston Railyards Roundhouse Sections 2, 3 & 4 Doors and Concrete Project. Welling seconded, to award the bid, for one (1) Wheel Loader equipped with auto-lube, bucket, coupler, snowplow, and snow wing with end gate, to the apparent low bidder. The motion failed with 7 no votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Award Bid/Sewer Camera & Trailer Councilmember Lynch moved, Councilmember M. Welling seconded, to award the bid, for one (1) Sewer Camera and Trailer, to Brad Vercimak of Western Precision LLC., the apparent low bidder meeting all City specifications, in the amount of $124,580.68. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Resolution 19-70 Councilmember Perkes introduced Resolution 19-70. Councilmember Perkes moved, Councilmember D. Welling seconded, to adopt Resolution 19-70. RESOLUTION 19-70:RESOLUTION AUTHORIZING THE CITY OF EVANSTON, WYOMING TO ENTER INTO A SCADA SERVICE AGREEMENT RENEWAL WITH WETCO, INC. TO PROVIDE MAINTENANCE SERVICES FOR THE SCADA SYSTEM IN THE WASTE WATER TREATMENT PLANT AND THE WATER TREATMENT PLANT. WHEREAS, the City has need to provide maintenance services to the SCADA System of the waste water treatment plant and water treatment plant; and WHEREAS, WETCO, INC. is able to provide such services pursuant to the attached SCADA Service Agreement Renewal: NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to sign, and the City Clerk is hereby authorized to attest, on behalf of the City, the attached SCADA Service Agreement Renewal with WETCO, Inc. to provide maintenance services for the SCADA System in the waste water treatment plant and water treatment plant. Award Bid/Facilities Key Card/Fob Project Councilmember Ottley moved, Councilmember Sellers seconded, to award the bid for the Evanston Facilities Key Card/Fob Project to Utah Yamas Controls, the apparent low bidder meeting all City specifications, in the amount of $44,400.00. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Resolution 19-71 Councilmember D. Welling introduced Resolution 19-71. Councilmember D. Welling moved, Councilmember M. Welling seconded, to adopt Resolution 19-71. RESOLUTION 19-71: RESOLUTION AUTHORIZING THE CITY OF EVANSTON, WYOMING TO ENTER INTO AN AGREEMENT AND ADDENDUM WITH UTAH YAMAS CONTROLS TO PROVIDE CERTAIN CITY BUILDINGS A CARD ACCESS SYSTEM. WHEREAS, the City has need to update the system used to allow access to certain city buildings which in part are used by members of the public; and WHEREAS, Utah Yamas Controls has submitted the best proposal to the City to provide a card access system to the designated buildings; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT:  Section 1: The Mayor is hereby authorized to sign, and the City Clerk is hereby authorized to attest, on behalf of the City, the Agreement and Addendum with Utah Yamas Controls City to provide a card access system to designated buildings of the City.
