EVANSTON CITY COUNCIL First Regular Meeting February 4, 2020 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of February was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Councilmember Perkes led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Police Chief, Jon Kirby; Public Works Director; Gordon Robinson;and Director of Parks and Recreation, Scott Ehlers. Community Development Director, Rocco O’Neill and Director of Engineering & Planning, Dean Barker were excused. A group of interested citizens were also present. Approve Agenda Councilmember M. Welling moved, Councilmember D. Welling seconded, to approve the agenda. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Approve Minutes The official record of proceedings for the City Council Meeting held January 21, 2020, and the Work Session Meeting held January 28, 2020 were approved as presented. Welling, Sellers, M. Welling. Revenue & Expenditure Report Councilmember Perkes moved, Councilmember D. Welling seconded, to approve the Revenue and Expenditure Reports for September and October 2019. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Council Comments Councilmember David Welling thanked the Public Works Department for all their hard work with snow removal. Councilmember Sellers commented on the article in the newspaper explaining how the Wastewater Treatment Plant works. Mayor Williams commented on the proclamation he recently signed declaring February 3rd through February 9th, 2020 as Professional Water and Wastewater Operator Week in the City of Evanston. Appointment to Boards/Commissions Mayor Williams made an appointment to the following board. Councilmember D. Welling moved, Councilmember M. Welling seconded, to confirm the following appointment: Planning and Zoning Commission Rowdy Dean - January 2023 The motion passed unanimously with 6 yes votes: Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Public Hearing/Liquor License City Attorney Dennis Boal conducted a public hearing to receive public comment regarding an application to transfer the ownership of a Retail Liquor License from Grill at Purple Sage, LLC., dba: Grille at Purple Sage to Evanston Golf Club, Inc., dba: Evanston Golf Club Inc. Bill Law, spokesperson and secretary for the Evanston Golf Board explained the reason for the transfer and future plans for the restaurant and bar. No one else addressed the issue and the hearing was closed. Transfer/Liquor License/BK Management Councilmember D. Welling moved, Councilmember Ottley seconded, to approve the transfer of ownership of a Retail Liquor License from Grill at Purple Sage, LLC., dba: Grille at Purple Sage to Evanston Golf Club, Inc., dba: Evanston Golf Club Inc. The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Ordinance 20-01 Councilmember Lynch sponsored Ordinance 20-01. Councilmember Perkes moved, Councilmember D. Welling seconded, to pass Ordinance 20-01 on first reading. ORDINANCE 20-01: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 15-33. RESISTING ARREST, AND REPEALING SECTION 18-8, RESISTING, TO ELIMINATE DUPLICATION WITHIN THE CITY CODE AND TO MIRROR THE LANGUAGE OF THE STATE STATUTE FOR THE CRIME OF “INTERFERENCE WITH POLICE OFFICER”. The motion to pass Ordinance 20-01 on first reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Ordinance 20-02 Councilmember Sellers sponsored Ordinance 20-02. Councilmember Lynch moved, Councilmember M. Welling seconded, to pass Ordinance 20-02 on first reading. ORDINANCE 20-02: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SUBSECTIONS B, C AND D OF SECTION 15-12, DRUG PARAPHERNALIA, OF THE CITY CODE TO MAKE IT POSSIBLE FOR THE COURT TO ISSUE A SENTENCE WHICH INCLUDES BOTH A FINE AND JAIL TIME FOR A CONVICTION INVOLVING DRUG PARAPHERNALIA. The motion to pass Ordinance 20-02 on first reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Ordinance 20-03 Councilmember Perkes sponsored Ordinance 20-03. Councilmember Ottley moved, Councilmember Sellers seconded, to pass Ordinance 20-03 on first reading. ORDINANCE 20-03: AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING AMENDING SECTION 12-38, RECKLESS DRIVING, OF THE CITY CODE TO MAKE IT POSSIBLE FOR THE COURT TO ISSUE A SENTENCE WHICH INCLUDES BOTH A FINE AND JAIL TIME FOR A CONVICTION OF RECKLESS DRIVING. The motion to pass Ordinance 20-03 on first reading passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Resolution 20-05 Councilmember Lynch introduced Resolution 20-05. Councilmember Lynch moved, Councilmember D. Welling seconded, to adopt Resolution 20-05. RESOLUTION 20-05: RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF A CONTRACT FOR SERVICES WITH ARTS, INC. D/B/A YOUNG MUSICIANS, A WYOMING NONPROFIT CORPORATION TO PROVIDE THE ANNUAL CELTIC MUSIC FESTIVAL. WHEREAS, Young Musicians has for a number of years put on a Celtic Music Festival in Evanston which provides music education and cultural activities for members of the community; and WHEREAS, the Celtic Music Festival also promotes tourism with in the City; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, a Contract for Services with Arts, Inc. D/B/A Young Musicians, a Wyoming nonprofit corporation to provide the annual Celtic Music Festival, a copy of which is attached hereto. Award Bid/Wheel Loader w/Equipment Councilmember D. Welling moved, Councilmember M. Welling seconded, to award the bid for one (1) Wheel Loader equipped with auto-lube, bucket, coupler, snowplow, and snow wing with end gate, to Wheeler Machinery, the apparent low bidder meeting all City specifications, in the amount of $213,799.00 (with trade-in). The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Comments/Remarks Gordon Robinson thanked Mayor Williams for signing a proclamation declaring this week Professional Water and Wastewater Operator Week.
