EVANSTON CITY COUNCIL Second Regular Meeting February 18, 2020 The official record of proceedings of the second regular meeting of the Evanston City Council for the month of February was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. Mayor Williams led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Councilmembers Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Nancy Stevenson; City Treasurer, Trudy Lym; Community Development Director, Rocco O’Neill; Director of Engineering & Planning, Dean Barker; Director of Parks and Recreation, Scott Ehlers; Police Lieutenant, Ken Pearson; Senior Planner, DuWayne Jacobson; and Grant Writer, Mieke Madrid. Police Chief, Jon Kirby and Public Works Director, Gordon Robinson were excused. A group of interested citizens were also present. Approve Agenda Mayor Williams suggested the following change to the agenda: Under Public Hearings/Special Orders, add a Public Hearing to receive comments regarding a Planning Grant. Councilmember D. Welling, Sellers, M. Welling. Council Comments Councilmember Seller reminded everyone of the Art’s Inc., event that will be held at the High School this evening. Mayor Williams comment on the recent donation of a Grand Piano from the LDS Church to the City of Evanston. This piano now has a new home in the Roundhouse for the entire community to enjoy. Public Hearing City Attorney, Dennis Boal conducted a public hearing to receive public comments regarding a proposed Business Ready Community Planning Grant from the Wyoming Business Council to create an assessment and redevelopment plan for a portion of the existing Historic Wyoming State Hospital campus for various economic development opportunities. Grant Writer, Mieke Madrid gave an overview of what the grant would be used for. No one else address this proposal and the hearing was closed. RESOLUTION 20-06:RESOLUTION OF THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING AUTHORIZING A 70% REDUCTION OF OFF-STREET PARKING SPACES FOR THE CONSTRUCTION PROJECT OF THE EVANSTON CHILD DEVELOPMENT CENTER, INC., (ECDC) PURSUANT TO SECTION 24-57 B OF THE CITY CODE. WHEREAS, the governing body of the City of Evanston recognizes that it benefits the community to provide early childhood education and care for low income families and others; and WHEREAS, ECDC has for years provided such a service in city-owned buildings located at 419 Fourth Street, Evanston, Wyoming; and WHEREAS, ECDC has an opportunity to obtain federal Head Start funds which would be used to construct a new building on the city property and improve its early childhood education and care program; and WHEREAS, the City and ECDC have entered into a long term lease for the property to enable ECDC to obtain the Head Start Funds, undertake the construction project and provide early child care education for the community; and WHEREAS, ECDC has submitted a conceptual plan of the project which calls for a 70% reduction of the off-street parking requirement set forth in the City Code; and WHEREAS, Section 24-57 B of the City Code authorizes the City Council to reduce by up to 70% the number of parking spaces required by the City Code for governmentally sponsored projects; and WHEREAS, there will be approximately 81 on-street parking spaces available for persons who want to use the ECDC facility; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The City of Evanston hereby approves and authorizes a 70% reduction of the off-street parking requirement set forth in the City Code for the construction project proposed by the Evanston Child Development Center, Inc., upon the condition the ECDC project will meeting all other parking requirements set forth in the City Code. RESOLUTION 20-07: RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE SALE OF REAL PROPERTY AND THE EXECUTION AND DELIVERY OF A QUITCLAIM DEED TO CCA, LLC, A WYOMING LIMITED LIABILITY COMPANY. WHEREAS, the City of Evanston has advertised the intended sale of the real property described below pursuant to W.S. 15-1-112; and WHEREAS, the City conducted a public auction to sell the real property on January 28, 2020, in accord with the advertisement of intended sale; and WHEREAS, CCA, LLC submitted the high bid to purchase the property, in the sum of $75,000.00; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The sale of the real property described below to CCA, LLC for the high bid is hereby accepted and approved. RESOLUTION 20-08: A RESOLUTION OF THE GOVERNING BODY FOR THE CITY OF EVANSTON, WYOMING PROVIDING CONSENT FOR THE HOUSING AUTHORITY OF THE CITY OF CHEYENNE, A/K/A THE CHEYENNE HOUSING AUTHORITY TO PROVIDE SECOND LOAN OPPORTUNITIES FOR THE PURCHASE OF AFFORDABLE HOUSING WITHIN THE CITY OF EVANSTON, UINTA COUNTY WYOMING BY QUALIFYING LOW TO MODERATE INCOME HOUSEHOLDS. WHEREAS, available affordable housing in a community satisfies a basic human need for shelter, contributes the overall health and safety of a community and can attract and retain employees to your community, thus helping to stabilize populations within a community; and WHEREAS, available affordable housing is essential to the economic vitality of all communities and the construction of affordable homes can help stimulate economic growth to that community; and WHEREAS, the Housing Authority of the City of Cheyenne, a/k/a the Cheyenne Housing Authority was created by the City of Cheyenne, Laramie County, Wyoming in 1971 pursuant to the authority conferred in Wyoming State Statute §15-10-101; and WHEREAS, Wyoming Statute §15-10-103(a)(vi) provides the Housing Authority of the City of Cheyenne, a/k/a the Cheyenne Housing Authority to make loans for the provision of housing for occupancy by persons of low income; and WHEREAS, the Housing Authority of the City of Cheyenne, a/k/a the Cheyenne Housing Authority has created and developed the “Welcome Home Wyoming Program” to assist qualified households purchase affordable housing through a partnership with lenders and loan services since 2015; and WHEREAS, the Housing Authority of the City of Cheyenne, a/k/a the Cheyenne Housing Authority desires to enhance and expand the “Welcome Home Wyoming Program” by providing a second loan option opportunity for qualified households in the City of Evanston, Uinta County, Wyoming; and  WHEREAS, the City of Evanston, Uinta County, Wyoming, as well as many other municipalities across the state are facing economic downturns, reductions in direct and indirect funding streams, and subject to a declining availability of affordable housing inventory units in our community; and WHEREAS, there are no additional municipal costs or associated municipal undertakings required in extending the availability of the “Welcome Home Wyoming Program” to our great city; and WHEREAS, municipalities are created statutorily and all rights are enabled through legislation; and WHEREAS, Wyoming State Statute §15-1-105 provides that any powers capable of exercise by a municipality or county under this chapter may be exercised jointly and the area of operation of any municipalities, county or housing authority or any combination of these bodies operating jointly may be increased to include additional contiguous areas upon the request or consent, by resolution of the governing body of the municipality within which the additional area lies; and WHEREAS, facilitating the ability and opportunities for low and moderate income households to purchase affordable housing within the City of Evanston, Uinta County, Wyoming, provides enumerable benefits to the City of Evanston, Uinta County, Wyoming, including but not limited to economic development, economic vitality, helps stabilize its’ population, provide stability for vulnerable families, helps reduce homelessness in addition to a plethora of other health and safety benefits to the community. NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, UINTA COUNTY, WYOMING, that the exercise within the corporal limits of the City of Evanston, Uinta County, Wyoming, by the Housing Authority of the City of Cheyenne, a/k/a the Cheyenne Housing Authority, to facilitate and provide second loan opportunities for the purchase of affordable housing by low and moderate income households is hereby consented to and the consent to the exercise of powers conferred herein shall remain in full force and effect until it has been withdrawn pursuant to formal action approved by a majority of the governing body hereto. Resolution 20-09 Councilmember Ottley introduced Resolution 20-09. Councilmember Ottley moved, Councilmember Sellers seconded, to adopt Resolution 20-09. RESOLUTION 20-09: A RESOLUTION OF THE CITY OF EVANSTON, WYOMING SUPPORTING AND AUTHORIZING AN APPLICATION TO OBTAIN PLANNING GRANT FUNDS FROM THE WYOMING BUSINESS COUNCIL FOR THE WYOMING STATE HOSPITAL HISTORIC CAMPUS ASSESSMENT & REDEVELOPMENT PLAN PHASE I. WHEREAS, the governing body recognizes there is a need to develop concrete data about the viability of reusing some of the structures of the Wyoming State Hospital which will be vacated as a result of new construction, and how they can best be preserved, razed and/or renovated for other business or educational opportunities; and WHEREAS, the proposed plan will create a detailed architectural/engineering blueprint of a portion of the historic property for economic development purposes and opportunities by evaluating six to ten structures on the eastern end of the site, which are the most visible and may contain the most potential for economic development; and WHEREAS, the economic outcome of this plan is to create a tangible plan with enough information regarding the property and its structures to effectively market it to higher educational entities, developers and entrepreneurs and to entice a company or developer to occupy the buildings, ensuring their continued use and economic vitality; and WHEREAS, a public hearing was held on February 18, 2020, by the governing body to explain the nature of the plan, the anticipated public benefits and to receive public input; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming as follows: Section 1. The City of Evanston hereby authorizes an application to obtain Planning Grant Funding from the Wyoming Business Council for the Wyoming State Hospital Historic Campus Assessment & Redevelopment Plan Phase I;  Section 2. The match for the grant ($25,000) shall be obtained from the Economic Development Administration and the request for these funds will commence in the fall of 2020. Section 3. The City of Evanston shall be responsible for the payment of any cost overruns associated with the Project, although none are anticipated. Section 4. The Mayor and City Clerk are authorized to sign and attest all documents and take all actions which are necessary to apply for the grant. RESOLUTION 20-10: A RESOLUTION APPROVING AND AUTHORIZING THE FINAL PLAT FOR THE KNEZOVICH ADDITION, A SUBDIVISION WITHIN THE CITY OF EVANSTON, WYOMING AS MORE PARTICULARLY DESCRIBED HEREIN. WHEREAS, Paula Knezovich and Ozzie Knezovich, (the “Subdivider”), has made application to the governing body of the City of Evanston, Wyoming for approval and authorization of the proposed subdivision entitled the Knezovich Addition, a subdivision located within the City of Evanston, Wyoming; and WHEREAS, the City of Evanston finds that said subdivision is a minor subdivision and can be approved pursuant to Section 22-10 of the Evanston City Code. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Evanston, Wyoming, that: Section 1.
