EVANSTON CITY COUNCIL First Regular Meeting November 3rd, 2020 The official record of proceedings of the first regular meeting of the Evanston City Council for the month of November was held in the Council Chambers of City Hall on the above date. These proceedings were video recorded. City Attorney Dennis Boal led those in attendance in the Pledge of Allegiance to the Flag. The roll was called and with a quorum being present, Mayor Kent Williams called the meeting to order at 5:30 p.m. and welcomed everyone present. Those present from the governing body at the start of the meeting were: Mayor Williams; Council members Tim Lynch, Tib Ottley, Evan Perkes, David Welling, Mike Sellers, and Mikal Welling. Staff members present at the start of the meeting were: City Attorney, Dennis Boal; City Clerk, Diane Harris; City Treasurer, Trudy Lym; Director of Engineering & Planning, Dean Barker; Public Works Director, Gordon Robinson and Police Chief Jon Kirby. Community Development Director, Rocco O’Neill and Director of Parks and Recreation, Scott Ehlers were excused. A group of interested citizens were also present. Approve Agenda Council member D. Welling moved, Council member M. Welling seconded, to approve the agenda with the addition of Resolution 20-86 under New Business. Welling, Sellers, M. Welling. Council Comments Council member Sellers commented that the hospital now has Covid Rapid Testing. He also reminded everyone to be aware of people that may be struggling. Mayor Williams reminded everyone they had about an hour and a half left to go vote. Consent Agenda Council member D. Welling moved, Council member Ottley seconded, to approve the following Consent Agenda: Limited Malt Beverage Permit requested by Juan Mariano of JP Marketing & Events, LLC dba Mountain Force MMA for the Mixed Martial Arts Exhibition at the Machine Shop for the following dates and times: Saturday, November 7th, 2020 6:00 pm to 9:30 pm The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling. Ordinance 20-14 Council member D. Welling moved, Council member Ottley seconded, to pass Ordinance 20-14 on third and final reading. AN ORDINANCE OF THE CITY OF EVANSTON, WYOMING ENACTING SECTION 12-17.1 OF CHAPTER 12, MOTOR VEHICLES AND TRAFFIC, OF THE EVANSTON CITY CODE REGULATING THE OPERATION OF OFF- ROAD RECREATIONAL VEHICLES ON CITY STREETS. WHEREAS, members of the community have approached the governing body about authorizing the operation of Off-road recreation vehicles on city streets which have been designated as part of the Wyoming Off-Road Vehicle Recreational Trail System pursuant to W.S. 31-5-1601; and WHEREAS, the governing body recognizes that Off-road Recreational vehicles are occasionally operated on city streets by citizens for a incidental, non-recreational purposes, such as traveling to a neighbor’s residence to plow their snow; and WHEREAS, the governing body desires to enact an ordinance which authorizes the operation of Off-road recreational vehicles on city streets in these limited circumstances subject to certain requirements; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: Sections 12-17.1 of the Evanston City Code is hereby enacted to provide as follows: Sec. 12-17.1.Operation of Off-Road Recreational Vehicles on City Streets. A. Definitions. OFF-ROAD RECREATIONAL VEHICLE per W. S. 31-1-101(K)" means: Type 1 - Any recreational vehicle primarily designed for off-road use which has an unladen weight of one thousand one hundred (1,100) pounds or less; Type 2 - Any unlicensed motorcycle which has an unladen weight of six hundred (600) pounds or less and is designed to be ridden off road with the operator astride upon a seat or saddle and travels on two (2) tires; and Type 3 - Any multi-wheeled motorized vehicle not required by law to be licensed and is designed for cross-country travel on or over land, sand, snow, ice or other natural terrain and which has an unladen weight of more than nine hundred (900) pounds. OPERATOR mean every person who operates or is in actual physical control of the operation of a off-road recreational vehicle. B. Wyoming Off-road Recreational Vehicle Trail. Off-road recreational vehicles may be operated on the streets, roads and travel routes of the City of Evanston which have been designated as a Wyoming Off-Road Vehicle Recreational Trail by the governing body of the City of Evanston in conjunction with the Wyoming Department of State Parks and Cultural Resources as provided in W.S. 31-5-1601, and W.S. 31-2- 701through 31-2-707, subject to compliance with the following requirements: (1)The Off-road recreational vehicle shall display a current State of Wyoming Off-road recreational vehicle registration decal; (2)The operator must have a valid driver’s license; (3)Crossings of main-traveled road ways by the Off-road recreational vehicle shall be made at right angles to the roadway or as nearly so as practicable, but in any case yielding the right-of-way to all traffic in the main-traveled roadway; (4)When operating at any time from one-half (½) hour after sunset to one-half (½) hour before sunrise, the Off-road recreational vehicle shall be equipped with and use lighted lamps and illuminating devices in accordance with W.S. 31-5-910 through 31-5-940 ; (5)The Off-road recreational vehicle shall be equipped with an adequate braking device that may be operated either by hand or foot; and (6)The Off-road recreational vehicle shall be equipped with a noise muffler which produces a propulsion noise level of not more than one hundred two (102) decibels at twenty (20) inches in a stationary test. C. Incidental Operation. The occasional, incidental operation of Off-road recreational vehicles for non-recreation purposes shall be permitted on city streets subject to the requirements set forth in subsection B above. But in addition, wherever practicable, the Off-road recreational vehicle shall be operated off the main traveled portion of the city street. Welling, Sellers, M. Welling. Award Bid/Evanston Recreation Center Pool Liner Project Council member Lynch moved, Council member D. Welling seconded the Motion to award the bid for the Pool Liner Project to the apparent low bidder Aquatic Renovation Systems, Inc. in the amount of $44,755.00 The motion passed unanimously with 7 yes votes: Williams, Lynch, Ottley, Perkes, D. Welling, Sellers, M. Welling RESOLUTION 20-85 Council member Lynch introduced Resolution 20-85. Council member Lynch moved, Council member D. Welling seconded, to adopt Resolution 20-85. RESOLUTION OF THE CITY OF EVANSTON, WYOMING, AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH AQUATIC RENOVATION SYSTEMS, INC. FOR THE COMPLETION OF ALL WORK REQUIRED TO INSTALL A LINER FOR POOL OF THE RECREATION CENTER. WHEREAS, there a need to install a new liner for the swimming pool in the Recreation Center; WHEREAS, Aquatic Renovation Systems, Inc. has submitted the lowest bid for the project; and NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, the attached Agreement between the City of Evanston, and Aquatic Renovation Systems, Inc., for completion of all work necessary to install a new liner for the swimming pool in the Recreation Center. RESOLUTION 20-86 Council member Ottley introduced Resolution 20-86. Council member Ottley moved, Council member D. Welling seconded, to adopt Resolution 20-86. A RESOLUTION OF THE CITY OF EVANSTON, WYOMING AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE CONTRACT WITH UINTA ENGINEERING & SURVEYING, INC. TO PROVIDE ENGINEERING SERVICES FOR THE CITY VIEW WATER MAIN REPLACEMENT PROJECT-PHASE 2. WHEREAS, the City of Evanston and Uinta Engineering & Surveying, Inc. have previously entered into a contract whereby Uinta Engineering & Surveying, Inc., is to provide engineering and construction management services for the City View Water Main Replacement Project-Phase 2; and WHEREAS, there is a need to amend the contract for the reasons described in the attached Change Order No. 1 to the Uinta Engineering & Surveying, Inc. Contract; NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF EVANSTON, WYOMING THAT: Section 1: The Mayor is hereby authorized to execute, and the City Clerk attest, on behalf of the City of Evanston, Change Order No. 1 to the Uinta Engineering & Surveying, Inc.
